Abstract

Abstract This article deals with the divorce occurred during the wife’s menstrual period. It aims to examine the status of hadiths on the law of divorce during the wife’s menstrual period and also the opinion of fiqih madhab on it. The research is library research with analysis and descriptive method. Some hadiths on it are analyzed with takhrij method, either the text of hadith or the chains of transmitter (sanad). The article also analyses the opinion of fiqh scholars on the law of divorce during the wife’s menstrual period. Based on shariah, the divorce is allowed if the husband divorce the wife in non-menstrual and before having a sexual intercourse. But if the divorce occurred during the wife’s menstrual period, there are many opinions among ulama. The result of this research shows that majority ulama stated it is unlawful if if the husband divorce the wife during her menstrual period, and his divorce is unlawful. But, Ibnu Qayyim al-Jauziyyah said that the divorce is not in line with shariah and unlawful and the husband is regarded sin doer. Abstrak Artikel ini adalah berkaitan dengan Talak Isteri Ketika Haidh. Penulisan ini bertujuan untuk meneliti status hadis-hadis berkaitan hukum talak isteri ketika haidh serta pandangan mazhab fiqh mengenainya. Jenis penelitian yang digunakan adalah penelitian kepustakaan (library research) dengan menggunakan metode deskriptif-analisis. Penulis menganalisis hadis-hadis tersebut melalui kaedah takhrij (redaksi) hadis yaitu, analisis matan (teks) dan sanad hadis seterusnya meneliti pandangan para fuqaha sekitar hukum talak ketika isteri dalam keadaan haidh. Menurut hukum syarak, talak sah apabila suami menceraikan isteri pada saat isteri dalam keadaan suci yang sebelumnya tidak digauli. Namun jika talak dijatuhkan saat isteri dalam keadaan Haidh, antara jumhur dan Ibn Qayyim al-Jauziyyah serta beberapa fuqaha berbeda pandangan. Hasil penelitian menunjukkan bahwa menurut jumhur ulama, hukum suami yang mentalak isteri ketika Haidh adalah haram dan hukum talaknya adalah sah. Namun, menurut Ibnu Qayyim al-Jauziyyah, talak tersebut tidak disyariatkan dan talak yang dijatuhkan tidak sah, serta suami tetap dianggap telah berdosa.

Abstract

This study examines hadiths concerning religious moderation through a maqāṣid al-sharī'ah framework in the context of contemporary interreligious relations. Despite extensive hadith scholarship, few studies systematically apply the maqāṣid framework to moderation discourse, especially in addressing religious extremism rooted in literalist interpretations that overlook Islamic law's normative objectives. Employing a thematic (mawḍū'ī) method, this study analyses hadiths from Ṣaḥīḥayn and al-Sunan al-Arba'ah concerning tolerance, the prohibition of ghuluw (excessiveness), and the Prophet Muhammad's interfaith practices. Al-Shāṭibī's maqāṣid framework serves as the interpretive lens, focusing on the protection of religion (ḥifẓ al-dīn), life (ḥifẓ al-nafs), and human dignity. The findings show three guiding principles: rejecting religious extremism (ghuluw), putting ease (taysīr) over difficulty, and accepting religious pluralism as a normal part of life. This study is the initial effort to implement al-Shāṭibī's classical framework for contemporary interfaith ethics, which illustrates that religious moderation in hadith transcends doctrinal mandates to provide contextual ethical-operational guidance. The research offers a maqāṣid-based hermeneutical paradigm that bridges scriptural authenticity with plural social realities, equipping Islamic scholars, policymakers, and interfaith practitioners with methodological tools to counter extremism and develop inclusive public theology in religiously diverse societies.

Abstract

The protection of women’s economic rights in marital property disputes within Indonesia’s Religious Courts remains problematic, particularly due to the risk of asset dissipation during divorce proceedings and the limitations of procedural safeguards. This study examines the interpretation and application of marital seizure (sita marital) as a legal mechanism to secure women’s property rights, while also identifying disparities in judicial decision-making. Employing a qualitative socio-legal approach, this research analyzes 42 court decisions issued between 2018 and 2023, sourced from the Indonesian Supreme Court database. Data were analyzed through qualitative content analysis focusing on judicial reasoning, evidentiary standards, and gender-related considerations. The findings reveal three dominant judicial patterns: approval, rejection, and partial approval of marital seizure requests. These variations are largely influenced by inconsistent evidentiary thresholds and the broad scope of judicial discretion. Although a small number of decisions demonstrate gender-sensitive reasoning aligned with feminist legal theory and maqāṣid al-sharīʿa (ḥifẓ al-māl), most rulings remain procedurally formalistic, which tends to disadvantage women, particularly those lacking access to financial documentation. This study argues that marital seizure constitutes a potentially effective yet inconsistently applied procedural safeguard. It reconceptualizes marital seizure as a gender-responsive legal instrument and underscores the urgency of doctrinal reform, the establishment of standardized evidentiary guidelines, and the integration of gender-sensitive judicial approaches. These measures are essential to ensuring substantive equality and strengthening the protection of women’s economic rights in marital property disputes.
