Abstract

There is a fact that the pollution of the marine environment in the bay region of Balikpapan is caused by a ship anchor that hit and is related to the oil refinery pipes at the sea floor. The purpose of this legal research is to find out what forms of liability must be given by the parties concerned and what legal mechanism to use in resolving the case. First, forms of state responsibility for the leaking of oil refineries owned by PT. Pertamina is in the form of compensation, restoring and overcoming pollution of the marine environment. Second, the mechanism used by PT. Pertamina and the MV Ever Judger Ship can go through litigation and non-litigation channels. The Indonesian government should be able to affirm the prevailing laws and regulations so that those who commit pollution are responsible for resolving environmental disputes.Keywords: Environmental Pollution, Liability form, Sticky Settlement Mechanism

Abstract

Wabah Covid-19 terjadi hampir di seluruh penjuru dunia yang kemudian muncul kebijakan tentang karantina wilayah  yang ada di seluruh dunia. Indonesia juga menjadi salah satu Negara yang menerapkan kebijakan karantina wilayah tersebut. Tentu hal ini berdampak pada seluruh sendi kehidupan masyarakat yang salah satunya pada sektor ekonomi. Dengan melihat kondisi seperti itu, kami mencoba untuk melakukan studi kasus untuk mengetahui dampak dan solusi serta dasar hukum yang ada untuk menyelesaikan dampak ekonomi, termasuk efektivitas kebijakan Pemerintah untuk mengatasi dampak yang disebabkan penyebaran wabah Covid-19 ini. Metodologi yang digunakan dalam penelitian ini yuridis normatif, yaitu mengkaji dari bahan-bahan pustaka yang ada kaitannya dengan pokok penelitian ini. Dengan tujuan untuk mengetahui bagaimana penerapan regulasi dari kebijakan Pemerintah atas penanggulangan dampak Covid-19 agar tidak semakin meluas dengan salah satunya menerapkan karantina wilayah, khususnya dalam hal pemulihan ekonomi. Dari penelitian yang dilakukan ditemukan bahwa taraf efektivitas karantina wilayah membaik seiring berjalannya waktu. Namun tidak akan turun hingga ke titik nol dengan cepat dan masih memerlukan proses yang relatif panjang.

Abstract

Sexual violence is a phenomenon of human rights violations that can occur in various countries, including Indonesia.Based on the annual disability data of the Indonesian Women's National Commission recorded in 2019 there were 89 cases and in 2020 there were 87 cases with a specific increase in sexual violence cases from 69% in 2018 to 79% in 2019. Although it does not have a variable pandemic situation, in 2020, the picture of cases of violence experienced by women with disabilities is dominated by rape. From the case of violence against women with disabilities, it is illustrated that women with intellectual disabilities are the most vulnerable group with a percentage of 47%. The purpose of this study is to find out the legal protection and rights of victims of sexual violence for persons with disabilities. This research uses normative research methods with a statutory and literature approach. The results of the study examined the rights of victims of sexual violence for persons with disabilities stipulated in Law No. 12 of 2022 concerning Sexual Violence Crimes including Special Enforcement by Law Enforcement Officials, handling procedures, protection, and recovery, state responsibility in guaranteeing the rights of persons with disabilities, and education related to public sexual violence. The regulation to protect the rights of persons with disabilities in Law No. 8 of 2016 concerning Persons with Disabilities contains: (a) The right to be free from torture, exploitation, and discrimination for persons with disabilities. (b) Interact and socialize in society, family, state, and get protection from all forms without fear of a single form

Abstract

Abstract— In this digital era, the influence of social media on people's lives is increasingly unstoppable. In fact, due to economic factors, more and more parents are exploiting their children for social media content. Children are heirs to the future of the nation and state whose dignity and worth as well as devoting their lives must be preserved. Exploitation of children for social media content is a crime, if this happens then there must be a party who is criminally responsible. The purpose of this study is to find out whether parents of child exploiters can be held criminally responsible and to find out the legal consequences and criminal liability for parents of child exploiters for social media content. This research is a normative juridical research with a statutory approach. From the results of the study, it can be seen that parents who exploit children for social media content can be subject to criminal liability as regulated in Law no. 35 of 2014 Amendments to Law Number 23 of 2002 concerning Child Protection and Law Number 11 of 2008 concerning Information and Electronic Transactions.

Abstract

Telecommunication network is a necessity needed today and ever after. This momentum is exploited by several cheaters who looking for big profits. The one of bad trick is misuse someone else's ID card to register cellphone SIM Card so it can be sells faster. And that’s actually against not only Law no. 24 of 2013 concerning Population Administration but also Law No. 19 of 2016 concerning Amendments to Law no. 11 of 2008 concerning Information and Electronic Transactions. The regulations about criminal liability misuse ID cards other person for registration cellphone SIM card not get serious attention from government. Therefore, the purposes of this research are : (1) using someone else's Personal Identity Number and Family Identity Number for cellphone SIM Cards registration illegally is an act of crime; (2) criminal liability of misuse other people's Personal Identity Number and Family Identity Number for registration cellphone SIM Cards based on the ITE Law and the Population Administration Law. This research using normative legal research, while methods using Statute Approach and Conceptual Approach. The results of this research found criminal liability sanctions for misuse someone else’s Personal Identity Number and Family Identity Number for registration cellphone SIM Cards illegally based on the ITE Law, the Criminal Code Law, and the Population Administration Law.
