Abstract

The essence of Article 18 of Constitution of 1945 has mandated that areas held autonomous representative body areas, because the government will also jointed area on the basis of deliberation. The significance of the representative body is the attribute of democratization in the regional administration.Basically Indonesian State which adopts a unitary state in the implementation of government was fixed by the applicable law in order to realize the national objectives as defined in the preamble of the Constitution of 1945, with reference to the then drafted the direction of the overall state administration to establish order society, nation and state and to realize progress in all fields. Implementation of state and government in a country not only in the central government alone. Central Government giving authority to local governments to organize their own government. In the State of Indonesia is the local government is the organization of government affairs by the Local Government and Regional Representatives Council (DPRD) in accordance with the principles of autonomy and assistance with the principles of local autonomy as possible.Keyword : government, Rule of Law.

Abstract

The formation of Act No. 12 year 2011 about the formation of Legislation and put the TAP MPR as one type of legislation is an implementation of the command section 22a NRI CONSTITUTION 1945 and fix errors of LAW No. 10 of 2004. TAP MPR can be classified as basic rules of State/cardinal rules state (staatsgrundgesetz) because it gives guidelines and guidance to the activities of the establishment of legislation but contain normative nature.The establishment of laws and regulations was the creation of legislation covering the stages of planning, drafting, discussion, endorsement or assignment, and enactment. And laws and regulations are regulations written that contains a binding legal norms in General and created or established by the institutions of the State or the competent authority via procedures specified in the legislation.In the system of governance of the country there are parts of the Government, each of which has its own tasks and functions however the overall such parts constitute an inseparable mix and work rationally. In this system of Government Indonesia subscribes to the principle of unitary State in desentralisasikan, unitary State was the Foundation of the content of the notion of autonomy, based on the evolving rules governing mechanism that became a balance between unity and autonomy demands.Keyword : Rule of Law, Constitution.

Abstract

Otonomi daerah yang luas dan utuh yang diberikan kepada kabupaten dan kota serta otonomi daerah terbatas kepada propinsi, Undang-Undang Nomor 22 Tahun 1999 mengakui hak-hak yang dimiliki dalam mengelola segala aspirasi, tuntutan dan kebutuhan masyarakatnya. Hal ini juga sekaligus mendorong timbul dan tumbuhnya kreativitas daerah dalam mengelola segala sumber daya yang terdapat di daerah untuk kepentingan dan kesejahteraan seluruh masyarakat.Lahirnya Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah sebagai pengganti Undang-Undang Nomor 22 Tahun 1999 diharapkan sebagai momentum tegaknya kedaulatan rakyat melalui pemilihan para pemimpin secara langsung. Selain itu perlu diantisipasi kecendrungan global dan regionalisasi yang membawa peluang sekaligus tantangan baru dalam perumusan stategi pembangunan daerah dan semua itu bisa diantisipasi memalui kebijakan pembangunan yang berbasis kekhasan Daerah (endogenous development).Tampilan Otonomi Daerah yang begitu paradoks tidak dapat dilepaskan dari pendekatan politik kekuasaan dalam menyusun Undang-Undang Pemerintah Daerah baik Undang-Undang 22 Tahun 1999 maupun Undang-Undang Nomor 32 Tahun 2004, yang motivasi utamanya umtuk menghindari diri dari sintegrasi,sementara semangat untuk membangun demokrasi ditingkat lokal tidak mendapatkan porsi yang memadaiKata Kunci:     Desentralization, Government, Law

Abstract

Criminal cases involving minors, such as abuse cases, are still being found. Criminal acts of maltreatment involving children, in particular criminal acts of abuse by minors committed by more than one child resulting in the death of the victim are not only categorized as reasonable delinquency, but have led to a crime. Lots of children commit acts of violence and thrown into prison or detention and often they are treated like adults. However, it is not uncommon for children who commit crimes not to be detained but to be fostered in child development institutions. This is because the juvenile criminal justice process has been regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System which prioritizes the settlement of legal issues involving children as perpetrators in the recovery and compensation experienced by victims from punishing children as perpetrators of crimes, but related to the act of a child committing maltreatment causing the death of another person, this matter needs to be considered.
