Abstract

This study seeks to analyze the process of embodiment and electronic/online services at the Ministry of ATR/BPN, as well as data conditions and strategies for preparing land data towards valid electronic/online data services which are needed for legal certainty for land rights owners and for making strategic decisions in National level. In this study, researchers used qualitative research methods. This research is located and has an object at the National Land Agency (BPN) of North Jakarta City Administration, and other agencies involved in connection with this research, the Ministry of Law and Human Rights, for the Heritage Center or the so-called DITJEN AHU and the Regional Development Tax and Ritribution Service Unit (UPPPD). Taman Sari and the Regional Development Tax and Ritribution Service Unit (UPPPD), which is a valid requirement for a request for transfer of rights at the National Land Agency (BPN) of North Jakarta City Administration, while the research period is 1 year. In selecting a qualitative research sample, the data source sample is selected purposively and is snowball sampling. Based on the results and discussion of the Land Data Readiness research towards Electronic/Online Services, it can be concluded as follows: (1) The Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of BPN RI Number 5 of 2017 concerning Electronic Land Information Services has not been implemented in its entirety. The implementation of these regulations is hampered by the content in the regulations that are not yet in line with other regulations governing the same thing. The lack of socialization, communication, and resources related to the implementation of regulations makes many Land Offices tend to have a negative response and are less concerned about the existence of online service programs, although there are also Land Offices that act in harmony with the substance of online services; (2) The readiness of land data for online services has not yet reached 100%. (3) Strategies for implementing and preparing land data for electronic services that can be carried out (4) The implementation of Presidential Regulation Number 95 of 2018 concerning the Electronic-Based Government System (SPBE), is constrained due to the Regional Development Tax and Ritribution Service Unit (UPPPD) of Tamansari District and the Regional Development Tax and Ritribution Service Unit (UPPPS) of Penjaringan District, so that Validation takes a long time, and if there is a request for a reduction in Duties on the acquisition of Land and Building Rights (BPHTB), it is not systematically granted.

Abstract

The agreement in the Civil Code has several legal requirements to be precise in Article 1320 of the Civil Code. For the validity of an agreement, 4 conditions are needed, namely the existence of an agreement, skill, the existence of certain things that have been agreed upon and the existence of a lawful cause. The first and second terms are called subjective conditions, because with regard to the subjects who make the agreement, if the agreement made is not in accordance with the first and second conditions, the agreement can be declared null and void. Meanwhile, the third and fourth terms are called objective conditions because they relate to the object in the agreement. If the agreement made does not meet the third and fourth conditions, the agreement is null and void. This writing uses normative juridical legal research methods (normative research). The nature of this research is descriptive, which aims to provide an overview of social symptoms regarding the role of psychiatrists in proving psychological violence in criminal acts of domestic violence. Sources of research data are primary legal materials, secondary legal materials and tertiary legal materials. The data collection method was carried out using document study techniques, which were analyzed using qualitative analysis techniques. The regulation regarding this Fiduciary Guarantee is regulated in Law NO. 42 of 1999 concerning the Fiduciary Guarantee. The presence of Law no. 42 of 1999 in essence only formalizes Normative rules from legal practice that have been enforced by Jurisprudence which are then encouraged again by the emergence of the Fiduciary Guarantee in Article 15 of Law No. 4 of 1992 concerning housing and settlements which stipulates that a house built on land owned by another party can be burdened with a Fiduciary Guarantee, as well as in Law no. 16 of 1985 concerning Flats, where it is found that the property rights over units of Flats can be used as collateral for debt by means of Fiduciary. Basically the full power of the fiduciary agreement has violated the rules of the validity of the agreement in Article 1320 of the Civil Code, then from that full power a criminal act can occur

Abstract

Pengguna atau pemakai narkotika pada dasarnya merupakan korban penyalahgunaan tindak pidana narkotika yang melanggar peraturan perundang-undangan di Indonesia dan mereka itu semua merupakan warga Negara Indonesia yang diharapkan dapat membangun negeri ini dari keterpurukan hampir di segala bidang. Untuk itu pemerintah memandang perlu untuk memulihkan kondisi para pengguna atau pemakai narkotika dari pengaruh buruk narkotika. Kebijakan untuk memulihkan kondisi para pengguna atau pemakai narkotika berupa rehabilitasi terhadap pengguna atau pemakai narotika. Kebijakan rehabilitasi terhadap pengguna atau pemakai narkotika telah dituangkan dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Penulisan ini menggunakan metode penelitian hukum yuridis normatif (normatif research). Sifat penelitian ini adalah deskriptif, yang bertujuan untuk memberikan gambaran tentang gejala-gejala sosial yang tentang peran psikiater dalam pembuktian kekerasan psikis pada tindak pidana kekerasan dalam rumah tangga. Sumber data penelitian berupa bahan hukum primer, bahan hukum sekunderdan bahan hukum tersier. Metode pengumpulan data dilakukan menggunakan teknik studi dokumen, yang dianalisis dengan menggunakan teknik analisis kualitatif. Berdasarkan hasil penelitian bahwa Ketua Mahkamah Agung, Menteri Hukum dan HAM, Menteri Kesehatan, Menteri Sosial, Jaksa Agung, Kepala Kepolisian RI, dan Kepala BNN menyepakati peraturan bersama mengenai Penanganan Pecandu Narkotika dan Korban Penyalahgunaan Narkotika ke dalam Lembaga Rehabilitasi. Alasan disusunnya peraturan bersama ini adalah karena adanya ketentuan Pasal 54 undang-undang Nomer 35 Tahun 2009 tentang Narkotika, yang menyatakan bahwa Pecandu Narkotika dan Korban Penyalahgunaan Narkotika wajib menjalani rehabilitasi medis dan rehabilitasi sosial, serta Hakim dalam memutus perkara Penyalahguna Narkotika wajib memperhatikan ketentuan Pasal 127 ayat (2) dan ayat (3) Undang-Undang Narkotika
