Abstract

Waqf is a form of worship which is a concrete example of a sense of justice. In this case, the Al-Qur'an calls it al-habs, a synonym of the word al-waqaf, namely property belonging to a person given to the public so that it can be used as long as the item remains. So, the essence of waqf lies in the form of the goods which in Islamic teachings are a continuous charity. In line with the enormous need for funds for poverty alleviation and the location is scattered outside the area of the waqifs, this has led to the idea of donating with money. With the convenience of cash waqf, people can easily spend their money to be waqf on the path of religion. The basis for waqf in the Koran is in Surah Ali-Imran verse 92, besides that, in the Qur'anic verse of Surat Al-Hajj verse 77. There is also the hadith of the Prophet Muhammad which is more explicit in describing the recommendation of waqf worship, namely the Prophet's command to Umar to donate his land in Khaibar. The Hanafi Mahzab also allows cash waqf as an exception, on the basis of istihsan bi al urfi (custom), because many people have done it. According to al Bakri, the Syafi'I school does not allow cash waqf, because dinars and dirhams (money) will disappear when they are paid so that they no longer exist. The opinion of the scholars regarding the object of waqf shows that the conditions for waqf objects (must be objects, useful, not disposable, not haram in substance and must belong to waqf perfectly). Cash waqf is not supported by hadith specifically, and uses verses from the Koran and hadiths of a general nature. Therefore, the determination of the conditions for the waqf object is included in the ijtihadi area.

Abstract

Cooperation agreement in the principles of Tabadul al-manafi and An'taradhin is very effectively applied. For this is evident from the fundamentals of the law. This principle is aqidah, shari'ah and morals. This economic system is based on Islamic values, namely equality, usefulness, balance, kindness and universality (rahmat li al-aalmin), so that the people of Indonesia in the future experience improved economic welfare on the basis of sharia principles. According to thrifty authors that the cooperation agreement has the benefit to be applied to the actors of the production of halal food products. The source of the law that underlies all economic activities, and other philosophical foundations of Islamic law that form the basis in developing the Islamic economy anywhere and in any form, and should not be out of the sharia corridor. Benefit is the main objective in Islamic economic activities and avoids all forms of normality. Through this paper by qualitative research method, with normative juridical approach through literature study. So that with this method can be excavated filosifis values in the development of Islamic economy in the field of halal product production.

Abstract

Penelitian ini menjelaskan mengenai penyelesaian konflik ekonomi syariah melalui jalur non litigasi dalam perspektif teori maslahah al-Syaitibi. Saat ini penyelesaian ekonomi syariah sudah diatur dalam UU Peradilan Agama bahwa yang menyangkut ekonomi syariah harus dilakukan pada Pengadilan Agama. Namun, dalam Islam sudah sejak dulu dikenal bahwa dalam menyelesaikan suatu konflik bisa diselesaikan diluar pengadilan, hal ini juga menjadi penting sebab dengan penyelesaian diluar pengadilan meminimalisir beresiko yakni biaya rendah bahkan bisa gratis. Rasulullah SAW pun menuntut umatnya dalam menyelesaikan suatu konflik dengan cara damai maupun musyawarah. Sebab musyawarah adalah suatu yang baik dalam Islam. Metode yang digunakan dalam penelitian ini yakni melalui metode deskriptif kualitatif dengan pendekatan yuridis normatife sehingga dapat mendeskripsikan teori maslahah Al-Syaitibi dalam menyelesaikan sengketa ekonomi syariah pada jalur non litigasi ialah agar tercapai tujuan banyak kemaslahatan dan meminimalkan ketidakadilan, dengan menggunakan teori maslahah Al-Syatibi. Dari dasar itu semua berhak mendapatkan kebebasan dalam meyelesaikan sengketa ekonomi syariah baik jalur litigasi maupun non litigasi. Hasil penelitian menunjukan bahwa ada prinsip-prinsip teori maslahah Al-Syaitibi yang bisa digunakan yakni ada tiga dalam menilai suatu maslahah. Pertama, maslahah yang ditujukan oleh dalil syara’ agar diterima. Kedua, maslahah yang ditujukan oleh dalil syara’ untuk ditolak. Ketiga yakni dibagi dua, pertama maslahat yang ditujukan oleh dalil khusus namun dapat membenarkan maupun tidak, namun ada maslahat yang sejalan dengan nash itu. Kedua maslahah yang tidak ditujukan oleh dalil syara’ yakni dapat membenarkan maupun tidak dan maslahah tersebut seiring dengan suatu tindakannya, ini sering disebut maslahah mursalah. Hal ini dalam penyelesaian sengeketa ekonomi syariah termasuk kepada maslahah mursalah.Kata Kunci: Al-Syaitibi; Mashlahah; Sengekta Ekonomi Syariah Settlement of Sharia Economic Conflicts through Non-Litigation Paths in the Perspective of Maslahah Al-Syaitibi TheoryAbstractThis study describes the resolution of sharia economic conflicts through non-litigation channels in the perspective of the maslahah al-Syaitibi theory. Currently, the settlement of sharia economics has been regulated in the Judicial Law that concerning sharia economics must be carried out in the Religious Courts. However, in Islam it has been a long time since resolving a conflict can be resolved out of court, this is also important because out-of-court settlement carries the risk of low costs and even free of charge. Rasulullah SAW also asked his people to resolve a conflict by peaceful means or deliberation. The method used is descriptive qualitative method, trying to describe Al-Syaitibi's maslahah theory in resolving sharia economic disputes on a non-litigation path, namely in order to achieve the goal of many benefits and minimize injustice, using Al-Syatibi's maslahah theory. From that basis, all have the right to freedom in resolving sharia economic disputes, both litigation and non-litigation channels. The results of the study show that there are principles of Al-Syaitibi's maslahah theory that can be used that there are three in assessing a maslahah. First, the maslahah indicated by the syara' argument to be accepted. Second, the maslahah intended by the syara' argument to be rejected. The third is divided into two, first, the benefits that are addressed by specific arguments but can be confirmed or not, but there are benefits that are in line with the text. The two maslahahs that are not addressed by the syara' argument that can be justified or not and the maslahah is in line with an action, this is often called maslahah mursalah. This is in the settlement of sharia economic disputes, including the maslahah mursalah.Keywords: Al-Syaitibi; Mashlahah; Sharia economic disputes

Abstract

The development of an increasingly advanced industry has an impact on the development of transactions in an increasingly complex economy so that many transaction activities require ijtihad to find solutions to problems that may arise. The hope is that the transaction can run smoothly and in accordance with Islamic law. This study aims to discuss matters relating to how 'urf becomes a method and source of Islamic law in economic activities by using a qualitative research methodology with a library research approach. The results showed that 'urf' is a thing that is known and has become a habit of the community, either in the form of words or actions. So that 'urf can be used as a method and legal basis in economic transaction activities.
