Abstract

ABSTRAKIndonesia sebagai negara hukum memiliki kewajiban memberikan pelindungan hukum bagi setiapWarga Negaranya, termasuk diantaranya yaitu pelindungan terhadap keluarga PMI. Konvensi ILO1990 yang diratifikasi Pemerintah Indonesia melalui UU No. 6 Tahun 2012 Tentang pengesahanInternational Convention On The Protection Of The Rights Of All Migrant Workers And Members OfTheir Families 1990, dan UU No. 18 Tahun 2017 tentang Pelindungan PMI merupakan dasar hukumpelindungan keluarga PMI. Diaturnya pelindungan terhadap keluarga PMI dalam UU No. 18 Tahun2017 merupakan paradigma baru dalam sistem pelindungan PMI. Terbitnya Undang-Undang No 18Tahun 2017 memberikan harapan yang lebih baik kepada PMI dan keluarganya. Namun yangmenjadi pertanyaan adalah bagaimana bentuk pelindungan keluarga PMI, serta bagaimana standarpelindungan Keluarga Pekerja Migran yang dicanangkan Konvensi ILO 1990. Penelitian inimenggunakan metode penelitian Hukum Normatif yang menggunakan pendekatan tinjauan yuridis,dan bersifat analitis deskriptif, yang bertujuan untuk mengkaji bentuk pelindungan keluarga PMI sertaimplementasi Konvensi ILO 1990 dalam UU No. 18 Tahun 2017. Berdasarkan hasil penelitian secarayuridis, bentuk pelindungan keluarga PMI meliputi pelindungan dalam aspek hukum, ekonomi, dansosial. Namun UU PPMI belum mengakomodir secara maksimal pelindungan terhadap keluarga PMI.Secara keseluruhan subjek pelindungan yang diatur hanya terbatas pada CPMI/PMI. Adapunmengenai standar pelindungan keluarga PMI dalam Konvensi ILO 1990 meliputi, pelindungan haksipil, politik, ekonomi, sosial, dan budaya. Standar tersebut belum diadopsi secara komperhensifdalam UU PPMI.Kata Kunci : Pelindungan, Keluarga, Pekerja Migran Indonesia

Abstract

This article is comprehensive look of waging in Indonesian law. Waging in employment still pose a problem. No details of the principle of fair and decent with the policies or the application of the rules of waging, always give rise to new issues and discourse. For the Government, to apply fair and decent wage does not merely make the norm on paper but should be able to guarantee the implementation of the norms in society. This paper uses the literature method with the concept approach. This article discover that the wage disputes can be avoided whereas industrial society interpret the wages in return for the sacrifice that has been given and is able to meet the needs of food, clothing and housing. Then it is not worth it if one party for their maximum benefit utilizing weakness of workers by making the waging system that ignores the principle of fair and decent.

Abstract

AbstractDurian skin which is known to be just waste can actually be processed into something very useful, such as turning it into a substitute for cotton or dacron. Researchers see creative innovations regarding the use of durian skin on the environment, especially for young people to take this opportunity. Self-empowerment of children is absolutely necessary to educate and prepare the nation's next generation so that they can live an entrepreneurial spirit. This community service uses the Participatory Action Research (PAR) method. The training in this activity is the procedure for processing durian skin waste into cotton or pillow stuffing. The results of community service activities, namely children or adolescents in the Garu VI environment still need information, assistance and care from the surrounding community. The role of academics becomes important as a bridge to cut the information gap.

Abstract

Perjanjian kemitraan yang dijalin oleh Mitra pengemudi dengan platform Grab dan Gojek melahirkan jenis hubungan hukum yang tidak dapat diklasifikasi sebagai hubungan kerja, karena disinyalir tidak memenuhi unsur-unsur hubungan kerja namun tidak pula memenuhi ketentuan hubungan kemitraan sehingga diduga sebagai hubungan kerja non-standar Ketergantungan diri -pekerjaan. Sementara itu, Mahkamah Agung Inggris menyatakan bahwa pengemudi Uber merupakan Worker atau pekerja. Penelitian ini dimaksud untuk dapat menjawab mengenai konstruksi hukum, aspek hukum serta perlindungan hukum pada hubungan kerja non-standar Dependent self-employmentpada Hukum Ketenagakerjaan Indonesia dan Hukum Inggris di era Gig economy . Metode yang dipakai dalam penelitian ini adalah metode penelitian Hukum Normatif dengan menggunakan data primer dan data sekunder sebagai data utama. Belum ada pengaturan yang secara jelas dan spesifik mengenai model bisnis perantara layanan digital serta hubungan kerja berbasis kemitraan seperti model Gojek dan Grab, sedangkan bisnis hukum di Inggris sendiri berlandaskan pada keputusan pengadilan mulai dari Employment Tribunal hingga UK Supreme Court. Dalam kontrak antara perusahaan aplikasi Gojek dan grab dan pengemudi tergambar hubungan yang bersifat subordinatif karenaadanya kontrol serta ketidaksetaraan. Bandingkan dengan Inggris, pasca putusan pengadilan UK Uber telah melakukan dan menyesuaikan kontraknya dengan putusan pengadilan. Upaya pemerintah Indonesia untuk melindungi pekerja mandiri adalah dengan mengeluarkan Permenhub Nomor 12 Tahun 2019. Namun, dalam melindungi pekerja mandiri di Indonesia terdapat beberapa hambatan antara lain perantara teknologi, kendala, posisi tawar pengemudi ojek online di Indonesia yang begitu rendah dan ketidakhadirannya instrument hukum yang mengatur mengenai makna tidak perintah.

Abstract

At the very minimum, every worker's rights include a decent salary, reasonable working hours, and access to social security. All workers, including domestic workers, are included in the worker in consideration (PRT). In general, metropolitan regions, including Medan, are areas that within the "family circle" use the services of domestic workers. As a result, the findings of this study will shed light on the protection of domestic workers' rights in the city of Medan. Islamic education can provide a framework for understanding the human rights of domestic workers and their need for protection. It can also serve to raise awareness of the challenges domestic workers face and how to best protect their rights. Islamic law stresses the importance of justice and fairness, and this can be used to inform the way in which domestic workers are treated. This article analyzes the problem using the Legal Protection and Hifz al-Mal evaluations. This is empirical legal research (sociological); data was collected in the field through interviews and observations. The findings of the study demonstrate that the protection of domestic workers' rights in Medan City is not being implemented, and this problem is caused by a variety of factors, the most significant of which is domestic workers' "ignorance" of their rights at work. As a result, from the standpoint of hifz al-mal, the working relationship between domestic workers and their employers is not in conformity with maqashid al-shariah, because domestic workers do not receive al-daruriah-level salaries. As a result, proactive legal protection is required so that domestic employees can exercise their rights. Proactive legal protection entails involving domestic workers in self-determination; at the very least, domestic workers must be consulted (deliberated) in developing a legal framework that will protect them, so that domestic workers are automatically informed of their legal rights while working.
