Abstract

Pelaksanaan pesta pernikahan di Kabupaten Padang Lawas Utara Kecamatan Dolok, Dolok Singompulon, Halongonan, Halongonan Timur, Simangambat  dilaksanakan dengan tradisi Endeng-Endeng, kegiatan adat ini merupakan tarian untuk menghibur para tamu undangan yang telah di undang dan sebagai penghormatan kepada seluruh tamu undangan yang telah berhadir. Permasalahan pelaksanaan pesta pernikahan di Kecamatan Dolok, Dolok Singompulon, Halongonan, Halongonan Timur, Simangambat telah menyimpang dari ketentuan yang diajarkan oleh agama Islam dalam melaksanakan walimatul ‘urs.  Jenis penelitian adalah penelitian empiris dengan pendekatan kultural (budaya). Metode pengumpulan data dengan cara observasi, wawancara dan dokumentasi. Sumber data yang menjadi informan penelitian ini adalah tokoh adat Kabupaten Padang Lawas Utara, Ketua KUA Kabupaten Padang Lawas Utara, dan Ketua MUI Kabupaten Padang Lawas Utara. Teknik Analisis data dengan cara pengumpulan data, reduksi data, penyajian data, dan verifikasi data atau proses pengambilan kesimpulan. Hasil penelitian bahwa pelaksanaan tradisi Endeng-Endeng dalam acara walimatul ‘urs hukumnya boleh, karena merupakan acara untuk menghibur para tamu undangan yang telah diundang. Sedangkan menurut MUI Kabupaten Padang Lawas Utara tentang hukum melaksanakan Endeng-Endeng dalam tradisi walimatul ‘urs adalah haram. Karena banyak mengandung kemaksiatan didalamnya serta sudah tidak sesuai dengan ketentuan-ketentuan ajaran agama Islam

Abstract

Religious moderation plays a very important role in social life to control human life and guide it to be good in the world. The purpose of this study is to achieve knowledge and outline of spiritual moderation and religious harmony in Kuala Beringin Village. This research method is in the form of field observations which are carried out directly through a word forum in Kuala Beringin Village and also a seminar conducted by KKN Group 144, North Labuhanbatu Regency. The results showed that religious moderation in the Kuala Beringin Village area has developed, this can be seen from the people who are still surviving by living their daily lives as usual. Viewed from the perspective of harmony between religious people, the people of Kuala Beringin Village strongly support harmony where mutual respect and respect for differences. Through KKN Activities we can realize a dignified society with work programs, especially in rural Kuala Beringin. The community tells the existing problems and then finds a way out with the participation of KKN participants, cooperation is established to achieve this success. As for the expected goals and targets of the work program. The people in Kuala Beringin village are arguably pluralism because they include many tribes, cultures, and religions. There are Javanese, Malay and Batak tribes that occupy the Kuala Beringin Village area. With the existence of religious pluralism in Kuala Beringin village, it makes values such as religious values, and cultures that can certainly form religious moderation such as, establishing religious teachings in interacting in the community so as to realize harmony between communities.

Abstract

This study aims to analyze government regulations and Islamic law regarding the salary status of state civil servants and patents as joint property after divorce. The government regulation in question is Government Regulation Number 45 of 1990 concerning Amendments to Government Regulation Number 10 of 1983 concerning Marriage and Divorce Permits for Civil Servants. This research uses a qualitative method based on normative juridical. In addition to government regulations which are the source of data, this study also uses the maqahid syar'iyah view. The two data sources are then compared and then formulated into one concept. The results of the study explain that divorce based on Article 3 of Government Regulation Number 45 of 1990 concerning Amendments to Government Regulation Number 10 of 1983 concerning Marriage and Divorce Permits for Civil Servants, it is said that an state civil apparatus divorce must go through the permission of a superior. And according to article 37 and article 49 of Law Number 1 of 1974 it is said that joint assets in the event of a divorce are divided according to existing legal regulations, and article 49 says that the Religious Courts have the duty and authority to examine, decide and resolve cases at the national level. The first is between people who are Muslim in the field of settlement of joint assets.

Abstract

At the very minimum, every worker's rights include a decent salary, reasonable working hours, and access to social security. All workers, including domestic workers, are included in the worker in consideration (PRT). In general, metropolitan regions, including Medan, are areas that within the "family circle" use the services of domestic workers. As a result, the findings of this study will shed light on the protection of domestic workers' rights in the city of Medan. Islamic education can provide a framework for understanding the human rights of domestic workers and their need for protection. It can also serve to raise awareness of the challenges domestic workers face and how to best protect their rights. Islamic law stresses the importance of justice and fairness, and this can be used to inform the way in which domestic workers are treated. This article analyzes the problem using the Legal Protection and Hifz al-Mal evaluations. This is empirical legal research (sociological); data was collected in the field through interviews and observations. The findings of the study demonstrate that the protection of domestic workers' rights in Medan City is not being implemented, and this problem is caused by a variety of factors, the most significant of which is domestic workers' "ignorance" of their rights at work. As a result, from the standpoint of hifz al-mal, the working relationship between domestic workers and their employers is not in conformity with maqashid al-shariah, because domestic workers do not receive al-daruriah-level salaries. As a result, proactive legal protection is required so that domestic employees can exercise their rights. Proactive legal protection entails involving domestic workers in self-determination; at the very least, domestic workers must be consulted (deliberated) in developing a legal framework that will protect them, so that domestic workers are automatically informed of their legal rights while working.

Abstract

Hasil penelitian ini menyimpulkan bahwa,  pertama, kesadaran hukum pejabat PT. Pegadaian Syariah CPS Alaman Bolak terkait Pembiayaan Arrum Haji termasuk pada kategori kesadaran hukum yang rendah. Sebab, mereka tidak memiliki kualifikasi pengetahuan dan pemahaman tentang akad yang tidak boleh mencantumkan ta’widh.  Pengetahuan mereka juga tidak memenuhi kualifikasi pengetahuan tentang mafsadah yang dapat timbul pada pembiyaan Arrum Haji, yaitu kemungkinan jamaah masih harus melunasi hutangnya padahal keberangkatan haji sudah dibatalkan. Kedua, kesadaran hukum nasabah PT. Pegadaian Syariah CPS Alaman Bolak terkait Pembiayaan Arrum Haji juga termasuk kategori kesadaran hukum yang rendah. Sebab mereka mengetahui tentang fatwa MUI tentang akad rahn, qardh, termasuk soal adanya pengaturan tentang ta’widh. Namun, para nasabah hanya sekedar mengetahui, tapi tidak memahami.  Dengan pengtahuan hukum semacam itu, mereka melakukan akad yang dapat menimbulkan mafsadah dari segi harta, bahwa mereka masih memiliki kemungkinan untuk melunasi cicilannya padahal keberangkatan haji sudah dibatalkan. Ditambah lagi mereka menyetujui pencamtunan ta’widh  dalam akad. Ketiga, adapun perspektif maqashid al-syariah tentang kesadaran hukum nasabah dan pihak PT. Pegadaian Syariah CPS Alaman Bolak terkait Pembiayaan Arrum Haji tidak memenuhi unsur hifz al-mal. Pencantuman ta’widh pada saat akad, yang tentunya menyebabkan kerugian bagi nasabah, dan kemungkinan jamaah harus mencicil hutang sekalipun porsi haji sudah dibatalkan, tidak relevan dengan tugas seorang mukmin untuk menjaga harta atau hifz al-mal, jelas sekali mafsadahnya. Sekalipun produk Arrum Haji ini diklaim mempermudah untuk mendapatkan porsi haji dan meminimalisir antrean panjang masa tunggu haji. Hal in sesuai dengan kaidah menolak mafsadah (kerusakan) didahulukan daripada mengambil kemaslahatan. Berdasarkan kaidah ini dapat dipahami bahwa, kesadaran hukum nasabah dan tawaran pihak pegadaian terkait kemasalahatan untuk mempermudah keberangkatan haji, tentu harus dihindari apabila ada kemafsadatan yang menanti dibalik kemudahan itu, yakni kerugian harta yang akan dialami nasabah.
