Abstract

Abstract: This study examines the practice of lower division of inheritance for the immovable goods within the inheritance system of Minangkabau, Kanagarian. It is then analyzed with the inheritance system in Islam. Data are obtained by interview and documentation. Interview is conducted to public figures, customs, and religion in Kanagarian Kurai. The collected data are then analyzed with descriptive-deductive mindset. The research finds that the practice of lower division of inheritance for the immovable goods within the inheritance system of Minangkabau- Kanagarian is still strongly influenced by the old custom that only prioritizes the female line. This influence can be seen from the implementation of the inheritance of immovable property such as land or house that are only given to girl. The boy does not take his part because of his embarrassment to the people around who consider that he has not right to take the estate and for the reason to avoid family dispute. In addition, the inheritance system in Kanagarian Kurai, the division of the estate that often delay leads to the mixing of the estate with the other property divisions of inheritance. The practice of lower division of inheritance for the immovable goods within the inheritance system of Minangkabau-Kanagarian is not in accordance with the provision of the Islamic inheritance system which clearly specifies each heir.Abstrak:Penelitian ini mengkaji praktik pembagian harta pusaka rendah tidak bergerak dalam kewarisan Minangkabau di Kanagarian Kurai. Pelaksanaan pembagian harta pusaka rendah tidak bergerak di kanagarian Kurai ini kemudian dianalisis kesesuaiannya dengan ketentuan waris dalam Islam. Data diperoleh dengan metode wawancara dan studi dokumen. Wawancara dilakukan kepada tokoh masyarakat, adat dan agama di kanagarian Kurai. Setelah terkumpul, data tersebut dianalisis dengan metode deskriptif analisis dengan pola pikir deduktif. Penelitian ini menemukan bahwa, pelaksanaan pembagian harta pusaka rendah tidak bergerak di Kanagarian Kurai masih sangat dipengaruhi adat lama yang mewariskan harta hanya pada jalur perempuan saja. Pengaruh ini dapat dilihat dari pelaksanaan warisan harta tidak bergerak seperti tanah atau rumah yang hanya diberikan kepada anak perempuan. Anak laki-laki tidak mengambil bagian mereka karena malu kepada masyarakat sekitar yang menganggap tidak patut mengambil harta warisan dan karena untuk menghindari perselisihan keluarga. Selain itu, dalam kewarisan di Kanagarian Kurai, pembagian harta waris yang ditunda-tunda sering menyebabkan tercampurnya harta warisan dengan harta lainnya. Pelaksanaan pembagian harta pusaka rendah tidak bergerak di Kanagarian Kurai ini tidak sesuai dengan ketentuan yang ada dalam kewarisan Islam yang secara jelas menentukan bagian masing-masing ahli waris secara pasti dan bersifat ijbāri.Kata Kunci: waris, harta pusaka rendah tidak bergerak, masyarakat Minangkabau

Abstract

Marine ecosystem degradation in international border regions has evolved into a multidimensional issue that encompasses ecological, geopolitical, and diplomatic aspects. This study aims to examine how marine environmental degradation affects the foreign policy of maritime countries, particularly Indonesia, and to explore the potential of ecological diplomacy as a strategic approach. Employing a qualitative method through literature review, this research reveals that ecosystem damage in strategic areas such as the North Natuna Sea and the South China Sea not only threatens environmental sustainability but also weakens Indonesia's diplomatic standing due to fragmented maritime governance and weak environmental diplomacy. By integrating ecological considerations into foreign policy, ecological diplomacy can serve as a vital instrument for establishing inclusive and sustainable ocean governance. The study recommends strengthening inter-agency maritime coordination, modernizing marine surveillance, and expanding international cooperation based on shared ecological interests.

Abstract

This study explores how murabaha financing is applied in Islamic financial institutions after the release of DSN-MUI Fatwa No. 153/2022 and the 2023 OJK Murabaha Financing Guidelines. These new rules aim to ensure stronger Sharia compliance by providing clear procedures for early debt settlement, margin discounts, and repayment arrangements. With a more transparent and standardized framework, the regulations are expected to reduce disputes, improve efficiency, and bring greater consistency across institutions. Using a qualitative approach, this research reviews regulatory documents, institutional Standard Operating Procedures (SOPs), and actual practices in selected Islamic banks and financing companies. The findings show that the updated guidelines encourage institutions to adjust their SOPs to align with both Sharia principles and operational best practices. Standardizing settlement and discount methods improves transparency, removes uncertainties, and builds customer trust. The results also highlight how clear regulations can support financial stability in the Islamic banking sector by ensuring murabaha transactions are fair, predictable, and fully compliant with Sharia. Overall, this study offers practical insights for policymakers, Sharia boards, and practitioners on how regulatory clarity can strengthen both operational performance and religious adherence in Islamic finance.
