Abstract

The operational implementation of Public Order and Order (Trantibum) carried out by the Regency/Municipal Civil Service Police Unit (Satpol PP) in Blangkejeren must be based on a humane and authoritative attitude. To improve the image, Satpol PP must have a sense of humanity and authority in carrying out their duties. "So with this attitude, the image of Satpol PP can improve and be better. It's not like what people say that Satpol is the enemy of the small people, has a bad image, and is a tool for ruling over the little people. Thus, the community will be able to understand by creating a high sense of awareness regarding the attitudes and actions they take. From their observations regarding the actions taken by the district/city Satpol PP when carrying out control in their area, it has referred to the regulations that have been set by the Minister of Home Affairs No. 26/2005 concerning Procedural Guidelines. Still Operational Satpol PP.” Where in the regulation has been stipulated related to the implementation of the Trantibum, raids. Before the Satpol PP carries out the operation, socialization will be carried out first, so that when the operation is carried out there is no anarchic attitude.

Abstract

The aims of this study is to find out Mandailing Customary Marriage Law in terms of Law 16 of 2019. This study used qualitative research. The result of this study shows that That the dowry is part of the marriage custom of the Mandailing tribe, but in practice it has experienced a shift in value. Both from the substantive meaning and in its application. This is indicated by the practice that distinguishes between the marriage dowry to fulfill the provisions of the marriage and the tuor to fulfill the customary provisions. 2. Dowry is a gift from a prospective husband to a prospective wife based on simplicity and convenience. Although the delivery is carried out in cash, there is still an opportunity for the prospective husband to postpone part of the agreed dowry amount. 3. In the marriage agreement, it is very possible that the dowry is included in the category of gifts that can be paid not only in cash. Thus, disputes regarding dowry can become the authority of the Religious Courts.

Abstract

Konstitusi Negara Republik Indonesia menyatakan bahwa cita-cita bangsa Indonesia yakni melindungi segenap bangsa Indonesia dan seluruh tumpah darah Indonesia, memajukan kesejahteraan umum, mencerdaskan kehidupan bangsa dan ikut serta melaksanakan ketertiban dunia yang berdasarkan kemerdekaan, perdamaian abadi serta keadilan sosial. Penelitian ini menggunakan metode deskriptif analitis yaitu menggambarkan dan menganalisis permasalahan yang dikemukakan yang bertujuan untuk mendeskripsikan secara konkrit tentang Peranan Penyidik Dalam Penerapan Diversi Pada Tahap Penyidikan terhadap Anak yang Melakukan Tindak Pidana Narkotika (Studi Kasus pada Polrestabes Medan). Hasil dan kesimpulan penelitian ini adalah Aturan hukum dalam penerapan diversi terhadap anak diatur pada UU SPPA No 11 Tahun 2012, yaitu pada pasal 6 – pasal 15. Ketentuan yang diatur adalah adanya kewajiban penyidik kepolisian untuk mengupayakan diversi terhadap tindak pidana yang dilakukan oleh anak dengan persyaratan ancaman pidana penjara tidak melebihi 7 tahun dan bukan merupakan pengulangan tindak pidana. Pengaturan lain dalam undang-undang tersebut adalah kesepakatan diversi harus benar-benar dilaksanakan sebelum penyidikan terhadap perkara anak benar-benar diberhentikan. Abstract

Discussions about children and their protection will never stop throughout the history of life, because children are the next generation of the nation and the successors of development, namely the generation that is prepared as the subject of implementing sustainable development and the future controllers of a country, not least in Indonesia. Child protection in Indonesia means protecting the potential of human resources and building Indonesian human beings as a whole, towards a just and prosperous society, materially and spiritually based on Pancasila and the 1945 Constitution.In positive law in Indonesia, the issue of minors regarding when they commit illegal acts, is not so firmly regulated; what should be treated for them, and how the detention system and the investigation system given to them are also not yet regulated in law.
