Abstract

Ibnu Tufail adalah salah satu filsuf dari Andalusia. Sebagaimana rekan-rekannya, dia merupakan pemikir ensiklopedis, dia adalah seorang dokter, matematikawan, astronom,filsuf. Ia menulis roman kemudian berhak untuk memiliki titel Hay Ibn Yaqzan. Dalam hal ininanti, Ibnu Tufail membahas masalah di epistemologi dengan emagination dari dua orang,Absal dan Salman. Di salah satu pulau penulis menyatakan masyarakat manusia dengan hukumdan kebiasaan tersebut; di pulau lain hidup menyendiri. Bagaimana dapat dari merekamemberikan argumen oleh berbagai pemikiran dan dengan sudut pandang yang beragam.

Abstract

Pesantren merupakan asrama tradisional dimana siswanya tinggal bersama dan belajar di bawahbimbingan kiai secara langsung. Tidak jarang Islamolog selalu memperhatikan perkembagan pendidikanPesantren dari masa ke masa. Salah satunya Zamakhsyari Dhofier, ia melakukan penelitian cukup seriustentang pesantren, karyanya berjudul Tradisi Pesantren. Penelitian ini bertujuan untuk melakukankoreksi atas warna kajian keislaman di Nusantara. Dalam penelitian pesantren, ia menggunakanetnografi untuk memahami kebudayaan Islam di Nusantara. Objek penelitian berpusat pada duapesantren: Tebuireng dan Tegalsari. Dua pesantren ini merupakan representasi pesantren yang ada diNusantara. Penemuan Zamakhsyari Dhofier dalam pendidikan pesantren ada dua tipe: integrasi klasikdan sekolah modern. Tradisi lembaga pendidik pesantren yang berlangsung lama di bumi Nusantara inimenjadi identitas tersendiri dari masyarakat Islam di negara lain.

Abstract

In the context of fostering national law, Islamic law is now dealing with Western law and customary law. This research is a library research (Library Research), which is research that is directed and focused on the study and discussion of library materials that are related to the issues being studied, especially regarding the KHI discourse in the political and legal landscape in Indonesia. This research is descriptive-analysis in nature, that is, this research seeks to describe or explain how the KHI discourses in the political and legal landscape in Indonesia. The fiqh movement in Indonesia is a continuation of the orientation of Sufism which has been so strong and has emerged earlier. This is a logical consequence of the historical process that for the merits of the Sufilah Islam spread throughout the archipelago. The struggle to legalize Islamic law began to show its results, when finally Islamic law received constitutional juridical recognition. Various laws and regulations, most of the material taken from fiqh books which are considered representative, have been passed by the Indonesian government. Social fiqh presents itself as social ethics which is manifested in an institution called the state, an institution that kills the creativity of civil society and also the old pattern of thinking which is considered conservative.

Abstract

This article explains the reading of meaning of the Qur’an with al-Syatibi theory in the book entitled “al-muwaqat”. This article employs hermeneutical approach to understand the narrative studies of the text by Emilio Betti. He gives some hermeneutical principles, namely: 1. Reproductive interpretation which exists in performing the text. 2. Explicative interpretation supposed that we intend to attain a reproductive interpretation, which is the important one, since it makes the text present and live. Before obtaining the purpose (maqasid syariah) of islamic law, Syathibi wrote semantics to be a way to view maqasid syariah because both the text and the purpose cannot be separated from interpretation theory. Therefore, this thesis aims to explore how al-Syatibi reveals a whole meaning of the Qur’an.

Abstract

This article aims to explain about ideality state in Islamic discourse on the history muslim society. Drawing on empirical cases from Arabic kingdom and a comparative literature of medina constitution, this article reveals a dilemma within our life in nation-state system,and the other hand, Islamic state arising, appearing and developing with a revitalization doctrine back to al-Quran and Sunnah nabawiah. Firstly, Islam is a religion not determine of Islamic state during of Muhammad PBUH. life. Secondly, the concept of Islam for civil society is justice, humanity, and liberty. So, if not contradictory with this three spirit then the government or nation called by muslim society.

Abstract

Al-Qur'an is God's word, which many types various, one that discusses the previous Prophet's history is called Tarikh. Out of Quran's History, able to teach people after it. Alquran is a Prophet Muhammad's miracle and miracle to a person who thought it. The violence case in the Quran was called mukjizat or I'Jaz. One of the signs of science is in history. In Prophet Musa, who split the sea into two, this story is in SURAH Thaha: 77. So this journal will discuss 1) I'jaz al-Tarikhy in Surah Thaha: 77, 2) From history, then analysis by science to found I'Jaz al-‘Ilmy in this verse. The result will be obtained by starting at the story; this proves that Prophet Musa and his miracle of splitting the sea can own because this is evidenced by analyzable.

Abstract

إن الإشكال المركزي من هذا البحث يتمحور حول غياب الحقائق بأندونيسيا في شتى مجالاتها وخاصة في تطور مجال الوسائل الإعلامية والاتصالية التي تقوم بها حياة المجتمع حاليا. فالمجتمع الحاضر ينظر بعضهم بعضا عن طريق النظر إلى الصورة الظاهرة المتجلية في فيسبوك ويوتوب وغيرهما من وسائل التواصل الاجتماعي الإنترنيتي. ومن ثَمَّ فلا شيء في الواقع العياني إلا ما ظهر من الصور التي استبدلت مكانة اللقاء المباشر بين أفراد المجتمع، وهذه الظاهرة تؤدي إلى أن تصير الصورة تجزيئيةً وسطحيةً حتى لا تقتصر الصورة من الشيء المصوَّر إلا ويكون بعضا من الواقع نفسه، ولكن مع ذلك فإن الصورة الضئيلة لاتصل إلى الهياكل التكاملية التي تحيط بجميع العناصر الواقعية بحيث يتفاوت ناظر الصور في ذهنه بين الصواب والخطأ. ولا جرم أن هذه القضية تلتمس تماما بالثورة الصناعية في الإعلامية والإتصالية اللاتين تجريان مجرى التعايش اليومي. ويستفيد السياسيون من الإعلامية والاتصالية بوصفها قوةً جاذبية في طلب الجاه والمحافظة عليه فيتلاعبون بها بتسييس الدين عن طريق وضع بعض نصوصه المقدسة في مثل الصور التجزيئية في الشبكات الإنترنيتية التي حملوها في حركتهم السياسية لنيل السلطة السياسية. وأخذ بعض النُّظار إلى الصورة التجزيئية بالمشاعر العاطفية من دون تحقيق الأخبار المشكوكة. وانطلاقا من هذه الظاهرة، استخدم الباحث نظرية طه عبد الرحمن لتدقيق بحثه، بحيث أن هناك عاملين داعيين إلى شهوة النظر في الإعلامية والاتصالية: أحدهما، شهوة الجنس التي تجعل الناظر يستمتع بنظره إلى الصور استمتاع المتلصص بالنظر إلى المصورات، بل الاستمتاع الذي به ينال شهوته ويقضي وطره منه؛ وثانيهما، شهوة البطش التي تجعل الناظر ينقل العنف الذي تمارسه شاشات الإنترنيت، شكلا ومضمونا، فيتعامل به مع الآخرين، فيؤذيهم كما يؤذيه عن طريق هجوم الصور، وينزع عنهم إنسانيتهم كما ينزعون عنه إنسانيته من أجل قسوة المضامين التي تحملها هذه الصور. وعلى الجملة، فهذا الأمر كله يدل على بعض خواطر المظاهر في عصر ما بعد الحقيقة (post-truth era) من أهل الأرض الذين يعيشون في السياسة الزائفة.

Abstract

This research broadly wants to answer three problem formulations. First, the minimum age requirement for marriage. Second, the minimum age requirement for marriage in law number 19 of 2019. Third, the perspective of Maqasid al-Shari'ah Abdul Majid al-Najjar is the minimum age limit for marriage. By using the theory of Maqasid al-Shari'ah Abdul Majid al-Najjarr so that the right solution will be found regarding the problem within the minimum age limit of marriage. The results of this study indicate that the minimum age limit for marriage, which is 19 years for both men and women, is an appropriate and effective step in achieving universal benefit in the form of becoming an ideal individual. The ideal individual will produce an ideal family, where the ideal family can form an ideal society in the future. [Penelitian ini berangkat dari perubahan ketentuan batas minimal usia perkawinan dan realitas yang terjadi dalam masyarakat. Pada dasarnya, usia perkawinan bukan merupakah syarat dan rukun dalam perkawinan. Hanya saja, usia perkawinan membuktikan bahwa terdapat kemaslahatan yang akan tercapai dimasa depan apabila dilaksanakan dengan tepat. Adapun tujuan perkawinan sendiri, dimana seharusnya membawa kemaslahatan rupanya tidak dapat tercapai apabila ketentuan pembatasan tersebut tidak dilaksanakan dengan baik. Oleh karena itu, perlu diadakan penelitian supaya didapatkan solusi mengenai permasalahanpermasalahan tersebut. Penelitian ini secara garis besar hendak menjawab tiga rumusan masalah. Pertama, ketentuan usia minimal perkawinan. Kedua, ketentuan usia minimal perkawinan dalam undang-undang no.19 tahun 2019. Ketiga, perspektif Maqasid al-Shari’ah Abdul Majid al-Najjar dalam batas minimal usia perkawinan. Dengan menggunakan metodologi kualitatif dan dengan pendekatan Library Research, maka akan didapatkan datadata verbal mengenai ketentuan batas minimal usia perkawinan. Data yang dikumpulkan kemudian dianalisis menggunakan teori Maqasid al-Shari’ah Abdul Majid al-Najjar sehingga akan ditemukan solusi yang tepat mengenai permasalahan dalam batas minimal usia perkawinan. Hasil penelitian ini menunjukkan bahwa pembatasan usia minimal perkawinan yaitu 19 tahun bagi laki-laki dan perempuan, merupakan langkah yang tepat dan jitu dalam upaya mencapai kemaslahatan universal berupa menjadikan individu yang ideal. Individu yang ideal, akan menghasilkan keluarga yang ideal, dimana keluarga ideal, dapat membentu masyarakat yang ideal pada masa mendatang.]

Abstract

Tradition is a habit that people continuously carry out in a specific area. Carrying out traditions can be interpreted as realizing the process of socialization between each generation in a civilization. Each region has different traditions and cultures. One tradition still preserved from generation to generation by the people of Suka Maju Village is the Tepung Tawar ceremony. The purpose of this research is to critically examine the thinking of Imam al-Shāṭibī in Maqāṣid al-Sharī‘ah as an effort to measure the value of relevance between shariah and tradition; in this case, it is used to analyze the tradition of tepung tawar in traditional Melayu marriages in Suka Maju village. The results in this study indicate that the tradition of tepung tawar in the marriage of the Melayu community in Suka Maju Village, which was analyzed using Maqāṣid al-Sharī‘ah from the perspective of Imam Imam al-Shāṭibī is considered relevant, which is described on the validity and purpose of the procession. Furthermore, if based on the classification of Al-'awāid Imam al-Shāṭibī's idea to sharpen the analysis, then it strengthens that the tepung tawar tradition is the embodiment of Al-'awāid al-Jāriyyah’s conception of Al-shāṭibī. Tradisi merupakan kebiasaan yang secara kontinuitas dilakukan oleh masyarakat disuatu daerah tertentu. Melaksanakan tradisi dapat diartikan merealisasikan proses sosialisasi antar setiap generasi dalam sebuah peradaban. Setiap daerah mempunyai tradisi dan kebudayaan yang berbeda-beda. Salah satu tradisi yang masih terpelihara secara turun temurun oleh masyarakat Desa Suka Maju adalah upacara Tepung Tawar. Adapun tujuan dalam penelitiaan ini yaitu menelaah secara kritis pemikiran Imam al-Shāṭibī dalam Maqāṣid al-Sharī‘ah, sebagai upaya menakar nilai relevansi antara shariah dan tradisi, dalam hal ini digunakan untuk menganalisa tradisi tepung tawar pada perkawinan adat Melayu di Desa Suka Maju. Hasil dalam penelitian ini menunjukan bahwa tradisi tepung tawar pada perkawinan masyarakat Melayu di Desa Suka Maju yang dianalisa menggunakan Maqāṣid al-Sharī‘ah perspektif Imam al-Shāṭibī dianggap telah relevan, yang terdeskripsi pada keabsahan maupun tujuan prosesinya. Lebih lanjut, jika berdasarkan klasifikasi Al-‘awāid gagasan Imam al-Shāṭibī untuk mempertanjam analisa, maka memperkuat bahwa tradisi tepung tawar merupakan perwujudan Al-‘awāid al-Jāriyyah konsepsi Al-shāṭibī.

Abstract

This study tries to describe the important position of maqhasid shari'ahas an alternative method in the scientific research design. Especially in the field of ijtihad maqhasidi, both using qualitative, quantitative, and mixed approaches. Based on the text analysis method, the results of the study show that the sharia maqhasidno longer only deals with the realm of the Qur'an and Sunnah texts, but can be used as a basis for contextual research in general. The work system of Islamic maqhasidresearch design is measured by the maintenance of the benefit of humans and their environment without the limit of space and time. So that, science can be directly proportional to the interests of humanity and the universe. As the universal vision of Islam, as a religion rahmatan lil 'alamiin. The research methods that usually well-known are only qualitative, quantitative, and mixed method, then the maqhasid shariamethod can be used as an alternative method, so that Islamic law can be always contextual. In other words, this method can be as s 'new' scientific research design model.
