Abstract

Abstract Notary as a public official appointed by the state, didn’t receive emoluments from the State, but receive honoraria for legal services provided in accordance with his authority under Article 36 paragraph (2) UUJN. The purpose of this study were 1) to analyze the meaning of Article 37 paragraph (1) and (2) UUJN to the notary who provide legal services free of charge to people incapable and related penalties are given if not met, 2) to find and analyze the constraints in the application of article 37 paragraph (1) and (2) UUJN in the provision of legal services in the field of notaries to people incapable by a notary public in Kediri. The method used juridical empirical located in Kediri. The sample in this study is a notary who is in the Kota District. The meaning of Article 37 paragraph (1) UUJN contains the value of spiritual, economic, and sociological. Article 37 paragraph (2) UUJN meaning administrative sanctions, meaning that there are certain requirements that must be met by a notary. Obstacles encountered in the provision of legal services to the public by a notary public notary, namely 1) the application of Article 37 paragraph (1) UUJN legally no problems if the clients who come to the notary's office has been qualified as a client pursuant to Article 39 UUJN and clients meet complete documents in preparation of a deed there is no reason for a notary to complicate the client; 2) the imposition of sanctions Article 37 paragraph (2) UUJN technical obstacles that notaries are public ignorance reporting procedures, supervision MPD, MPW, and MPP low, and no limits on the provision of legal services to people cannot afford. Key words: legal services free of charge, notary public, people cannot afford, sanctions Abstrak Notaris sebagai pejabat umum diangkat oleh negara, tidak menerima honorarium dari Negara, akan tetapi menerima honorarium atas jasa hukum yang diberikan sesuai dengan kewenangannya sesuai pasal 36 ayat (2) UUJN. Tujuan penelitian ini adalah 1) Untuk Menganalisis makna pasal 37 ayat (1) dan (2) UUJN terhadap notaris yang memberikan jasa hukum secara cuma-cuma kepada orang tidak mampu dan terkait sanksi yang diberikan apabila tidak dipenuhi, 2) untuk menemukan dan menganalisis kendala dalam penerapan pasal 37 ayat (1) dan (2) UUJN dalam pemberian jasa hukum di bidang kenotariatan kepada orang tidak mampu oleh notaris di Kota Kediri. Metode yang digunakan yuridis empiris berlokasi pada Kota Kediri. Sampel dalam penelitian ini yaitu notaris yang berada di Kecamatan Kota. Makna dari pasal 37 ayat (1) UUJN mengandung nilai rohani, ekonomis, dan sosiologis. Pasal 37 ayat (2) UUJN memiliki makna bahwa sanksi yang diberikan sebagai sanksi administratif, artinya ada persyaratan tertentu yang harus dipenuhi oleh notaris. Kendala yang dihadapi dalam pemberian jasa hukum kenotariatan kepada masyarakat oleh notaris, yakni 1) penerapan pasal 37 ayat (1) UUJN secara yuridis tidak ada kendala jika klien yang datang ke kantor notaris telah memenuhi syarat sebagai penghadap berdasarkan pasal 39 UUJN dan klien memenuhi dokumen-dokumen yang lengkap dalam pembuatan suatu akta maka tidak ada alasan bagi notaris untuk mempersulit klien tersebut; 2) penerapan sanksi pasal 37 ayat (2) UUJN secara teknis kendalanya yaitu notaris adalah ketidaktahuan masyarakat prosedur pelaporan, pengawasan MPD, MPW, dan MPP rendah, serta tidak adanya batasan pemberian jasa hukum kepada orang tidak mampu. Abstract

This study aims to analyze and describe the implementation of School-Based Management carried out by madrasahs in improving the quality of education at MTs Darul Aitam Jerowau. This study uses a qualitative approach with descriptive methods. Data collection techniques are carried out through observation, interviews, and documentation. The results of the study indicate that MTs Darul Aitam Jerowaru has implemented School-Based Management systematically. School-Based Management is carried out in the form of granting authority to school organizations to carry out their duties and functions properly. So that it can improve the quality of education. The implementation of School-Based Management has contributed positively to improving the quality of education. Although there are several obstacles such as facilities and infrastructure, the madrasah continues to strive to overcome these obstacles through good management. Thus, school-based management carried out in madrasahs has proven effective in supporting the quality of education at MTs Darul Aitam Jerowau.
