Hana Anisa Dian Pertiwi, Prof. Dr. Mochammad Bakri, S.H., M.S., Setiawan Wicaksono, S.H., M.Kn.Fakultas Hukum Universitas BrawijayaEmail: hanaanisa83@gmail.com ABSTRAKSkripsi ini dilatarbelakangi oleh pelaksanaan pembangunan jalur bawahtanah MRT Jakarta yang bertujuan untuk mengetahui dan menganalisis tentangsudah tepat atau tidaknya Pergub DKI Jakarta Nomor 167 Tahun 2012 TentangRuang Bawah Tanah dan Hak Pengelolaan yang diberikan oleh Pemprov DKIJakarta kepada PT MRT Jakarta menurut peraturan perundang-undangan diIndonesia. Jenis Penelitian ini merupakan penelitian yuridis normatif denganmenggunakan pendekatan perundang-undangan, pendekatan analitis, danpendekatan konsep.Hasil dari penelitian ini adalah Pemprov DKI Jakarta belum tepatmemberikan HPL kepada PT MRT yang diatur pada pasal 38 ayat (1) Pergub DKIJakarta Nomor 53 Tahun 2017 Tentang Penugasan Kepada Perseroan TerbatasMRT Jakarta Untuk Menyelenggarakan Prasarana dan Sarana Mass Rappid Transitkarena secara yuridis serta praktisnya digunakan untuk permukaan tanah. PergubDKI Jakarta Nomor 167 Tahun 2012 kekuatan hukumnya lemah karena belumadanya peraturan dalam skala UU yang mengatur ruang bawah tanah, hanyabeberapa pasal yang mengatur ruang bawah tanah di PP Nomor 16 Tahun 2004Tentang Penatagunaan Lahan. Sebaiknya perlu adanya pembaharuan dan perluasanmateri muatan UUPA tentang pemanfaatan ruang bawah tanah.Kata Kunci: Ruang Bawah Tanah, Hak Pengelolaan, Mass Rapid Transit ABSTRACTThis research is aimed to find out and analyse the appropriateness of GovernorRegulation of Jakarta Number 167 of 2012 concerning Underground Space andRights to Management given by Provincial Government of Jakarta to MRT Developerin Jakarta based on existing laws in Indonesia. This is a normative juridical researchwith statute, analytical, and conceptual approaches.The research reveals that giving HPL to MRT developer by the ProvincialGovernment of Jakarta is deemed inappropriate, where it is stipulated in Article 38Paragraph (1) of Governor Regulation of DKI Jakarta Number 53 of 2017 concerningAssignment to Limited Company responsible for MRT Development including itsfacilities and infrastructure, since it is seen that it is more appropriate for MRT to takeplace above ground. The legal force of Governor Regulation of Jakarta Number 167of 2012 is weak since there is no Act regulating underground utilisation, and such aregulation is only stipulated as Government Regulation Number 16 of 2004concerning Spatial Management. It is essential that the area of substance andimprovement be added to Basic Agrarian Law concerning underground utilisation.Keywords: underground, right to development, mass rapid transit

Abstract

The regulations on land regulated in UUPA contain a social function, in which every land controlled by the community can be procured for the public interest but must receive balanced compensation. Land acquisition for the public interest has been regulated in Law Number 2 of 2012, the main requirement for land acquisition for the public interest is obtaining a permit. Permits are needed as development legality, but there is an aspect that is no less important, namely the human rights aspect, because land is the primary need of the community so that in granting a land acquisition permit it must reflect the values of human rights. Research approach is a method or method of conducting research. The approach method used in this research is the Socio-legal method using descriptive analytical research specifications, the result of which is to focus on the problems as they were when the research was carried out, then the results of the research were processed and analyzed with the relevant laws and regulations to draw conclusions. , in this case is the case of the construction of the Wadas Village dam which is a national strategic project.
