Abstract

The regulations on land regulated in UUPA contain a social function, in which every land controlled by the community can be procured for the public interest but must receive balanced compensation. Land acquisition for the public interest has been regulated in Law Number 2 of 2012, the main requirement for land acquisition for the public interest is obtaining a permit. Permits are needed as development legality, but there is an aspect that is no less important, namely the human rights aspect, because land is the primary need of the community so that in granting a land acquisition permit it must reflect the values of human rights. Research approach is a method or method of conducting research. The approach method used in this research is the Socio-legal method using descriptive analytical research specifications, the result of which is to focus on the problems as they were when the research was carried out, then the results of the research were processed and analyzed with the relevant laws and regulations to draw conclusions. , in this case is the case of the construction of the Wadas Village dam which is a national strategic project.

Abstract

The existence of a land mafia can almost investment and economic growth because the crimes they commit include land cases with a broad dimension, so prevention and eradication are needed in the administrative land area. This study aims to develop efforts to prevent and eradicate future land mafia in the land administration area. This research is descriptive-analytical with a sociolegal approach. This Study obtained alternative efforts to prevent and eradicate future land mafia, namely the idea of changing land registration from a negative publication system to a positive publication system.

Abstract

Investment and economic growth can be inhibited by the existence of the land mafia. This is because the land case crime has broad dimensions, resulting in disputes, conflicts, and involves land and space objects of high economic value. For this reason, prevention is needed starting at the administrative level. This study wants to examine the legal and political reconstruction of the ideal land registration system as an effort to prevent land mafia. Thus, it is expected to find the purpose of the ius constituendum in the land registration system that is able to prevent land mafia crimes starting at the administrative level. This study is socio-legal research with analytical descriptive nature. This study produces a new alternative to legal political construction for the land registration system as an effort to prevent land mafia in the future, starting at the administrative level. The legal political reconstruction is in the form of reforming the land registration law into a positive publication system. Therefore, it is necessary to revise the Agrarian Principles Law, especially the articles related to the negative publication system. In addition, these changes need to be balanced with the application of an electronic land registration system, with legal products in the form of electronic certificates and still prioritizing the principles of good governance. This study provides recommendations to the government at the earliest opportunity to establish legislation for the settlement of land cases, especially regarding the prevention of land mafia, and to the DPR RI for the ratification of the Bill on Land.AbstrakPertumbuhan investasi dan ekonomi dapat terhambat dengan keberadaan mafia tanah. Hal ini dikarenakan kejahatan tersebut merupakan kasus pertanahan berdimensi luas, sehingga mengakibatkan sengketa, konflik, dan perkara dengan objek tanah dan ruang yang bernilai ekonomis tinggi. Untuk itu, diperlukan pencegahan yang dimulai dari tingkat administratif. Penelitian ini ingin mengkaji rekonstruksi politik hukum sistem pendaftaran tanah yang ideal sebagai upaya pencegahan mafia tanah. Dengan demikian, diharapkan dapat menemukan tujuan dari ius constituendum dalam sistem pendaftaran tanah yang mampu melakukan pencegahan kejahatan mafia tanah dari tingkat administratif. Penelitian ini merupakan penelitian socio-legal research yang bersifat deskriptif analitis. Penelitian ini menghasilkan alternatif konstruksi politik hukum baru bagi sistem pendaftaran tanah sebagai upaya pencegahan mafia tanah pada masa mendatang dari tingkat administratif. Rekonstruksi politik hukum tersebut berupa pembaharuan hukum pendaftaran tanah menjadi sistem publikasi positif. Oleh karena itu, perlu dilakukan revisi terhadap UUPA, terutama pasal-pasal yang berkaitan dengan sistem publikasi negatif. Selain itu, perubahan tersebut perlu diimbangi dengan penerapan sistem pendaftaran tanah secara elektronik, dengan produk hukum berupa sertipikat elektronik dan tetap mengedepankan prinsip good governance. Artikel ini memberi rekomendasi kepada pemerintah segera mungkin melakukan pembentukan peraturan perundang-undangan untuk penyelesaian kasus pertanahan, khususnya tentang pencegahan mafia tanah, dan DPR RI untuk pengesahan RUU Pertanahan.

Abstract

Land rights can be transferred or transferred to other parties. The transfer of land rights means that the ownership of the land rights is transferred by law or by itself. However, in practice, there are many violations of the transfer of land rights without the consent of the heirs. This study will analyze the problem of the transfer of land rights whose object is the object of a land dispute in accordance with the case that occurred in the Supreme Court Decision Number 723 PK/PDT/2017. The purpose of this study is to find out, analyze, and describe: (1) whether the transfer of land rights without the consent of the heirs can be declared valid and has legal force; and (2) what are the legal consequences of the transfer of land rights without expert approval. The results of this study indicate that: (1) The acquisition of property rights to land can occur through inheritance from the heir to his legal heirs in accordance with what is stipulated in the UUPA; and (2) legal protection for heirs whose rights have been impaired on the transfer of rights to inherited land that are controlled and used without the consent of their heirs based on Article 1365 are against the law, so that they are given the right to file a lawsuit in order to defend their inheritance rights by proving that they are legal heirs.

Abstract

Notaries play a crucial role in ensuring legal certainty and security in business transactions, especially in the creation of authentic deeds that serve as valid evidence and possess high legal force. As public officials authorized by the state, notaries are tasked with ensuring that every transaction involving the parties concerned is legally valid, fair, and transparent. Notaries are also responsible for providing legal advice and ensuring that transactions are carried out voluntarily and in accordance with applicable regulations. However, the notarial profession faces various ethical challenges, such as conflicts of interest and breaches of confidentiality, which can undermine the credibility of transactions and public trust in the profession. Ethical violations can result in financial losses for the parties involved and damage the reputation of the legal system as a whole. Therefore, it is essential for notaries to maintain independence, integrity, and professionalism in carrying out their duties to ensure the creation of legal certainty that supports smooth, valid, and trustworthy business transactions.

Abstract

Perbuatan hukum jual beli tanah perlu akta otentik (AJB) sebagai bukti hukum yang sah menurut aturan yang berlaku. Praktiknya, banyak masyarakat melakukan perbuatan hukum jual beli di bawah tangan tanpa akta PPAT, nantinya akan menimbulkan permasalahan bagi pembeli. Tujuan penelitian ini untuk mengetahui dan menganalisis mengenai peralihan hak atas tanah melalui jual beli di bawah tangan dan konsekuensi hukum yang ditimbulkan. Penelitian ini sifatnya deskriptif dengan pendekatan yuridis normatif. Sumber data yang digunakan yaitu sumber data sekunder berupa bahan hukum primer, sekunder, dan tersier. Dilihat dari hasil dan pembahasan, diketahui untuk peralihan hak melalui jual beli yang dibuat di bawah tangan, apabila menurut adat, maka perbuatan hukum jual beli tanah didefinisikan sebagai kegiatan yang dilakukan dengan bersifat terang dan tunai. Jika telah dilakukan secara terang dan tunai maka perbuatan jual beli dianggap sah. Untuk bukti telah terjadi perbuatan hukum jual beli berupa kuitansi maupun surat keterangan telah dilakukan jual beli. Pendaftaran peralihan hak tidak dapat dilakukan apabila tanpa AJB sesuai aturan yang berlaku. Konsekuensi hukumnya berupa perbuatan hukum tetap sah dan mengikat, tidak dapat balik nama sertipikat tanah dan tidak mempunyai kekutan hukum yang kuat serta sempurna terkait alat pembuktian hak kepemilikan apabila timbul sengketa.

Abstract

The idea of a special agrarian court is really needed considering that up to now, various agrarian disputes or conflicts have not yet had a definite resolution. Agrarian is a field of science that has specificities, so it is not uncommon for problems regarding agrarian to be complex, because in one object the agrarian conflict may be related to several aspects simultaneously, for example criminal and civil aspects, not just administrative aspects. So we need a court institution with specialization in the agrarian field, consisting of competent experts in the agrarian field with the hope of being able to resolve agrarian conflicts and disputes that have not found a solution to date. Hoping that a special court in the agrarian sector exists, it will be able to function in providing justice, benefits and legal certainty for the community and The goal is to establish a fair and successful community that aligns with the ideals and goals.

Abstract

This study analyzes the digital transformation of Indonesia’s land administration through the implementation of the Electronic Mortgage (HT-el) system, which replaces conventional mortgage registration with a fully online process. Using a normative legal research method supported by deductive qualitative analysis, this research examines the regulatory, technical, and institutional challenges faced by Land Deed Officials (PPAT) in adapting to the digital environment. Findings reveal that the transition to electronic land certificates encounters multiple obstacles, including insufficient infrastructure, inconsistent data integration, limited digital literacy, and ambiguities in legal accountability between PPAT and other stakeholders. Despite these challenges, the HT-el system enhances transparency, reduces document falsification risks, and accelerates service delivery. However, its long-term success depends on strengthening legal frameworks, improving human resource capacity, ensuring cybersecurity, and fostering public digital inclusion. This study contributes to the discourse on e-governance and legal modernization by highlighting how technological adaptation reshapes legal certainty and administrative justice within Indonesia’s agrarian reform.

Abstract

This study examines the division and management of heirs' rights based on Salatiga District Court Decision No. 67/Pdt.G/2018/PN Slt, focusing on joint property in a marriage after one of the spouses dies. Half of the joint property became part of the inheritance which was divided among the husband and five children as heirs. The dispute arose because one of the heirs refused to sign the inheritance certificate, thus hampering the land sale process. The court deemed the action as unlawful because it obstructed the rights of the other heirs. However, the sale and purchase process could still proceed by entrusting the refusing heir's share to the court. In this case, the notary has an important role as a public official who ensures the legal process runs according to the provisions. The refusal of one heir's signature prevented the sale and purchase deed from being made, so the notary could not continue the process without the agreement of all parties. This research emphasizes the importance of the role of notaries and legal protection for all heirs in the division of joint property.

Abstract

This research aims to analyze and compare the roles of notaries and land deed officials in making sale and purchase deeds, as well as identify problems and challenges faced in practice. This research uses a normative juridical approach method that seeks to synchronize legal provisions against norms, and other legal regulations that have a relationship with the application of legal regulations in the field with literature study data collection techniques. The results show that there is an overlap of authority between notaries and PPATs that can cause confusion in the community in choosing the appropriate service. Differences in procedures and operational standards between these two professions also affect the efficiency and legal certainty in making sale and purchase deeds. In addition, limited public understanding of the role of each profession results in inappropriate service selection and potential legal disputes in the future. Bureaucratic constraints, regulatory changes, and technical land issues are significant challenges faced by notaries and PPATs in carrying out their duties. This research emphasizes the importance of education and socialization regarding the roles and authorities of notaries and PPATs, as well as regulatory reforms to reduce overlapping authorities and improve the efficiency of the sale and purchase deed process. With better understanding and better coordination between notaries, PPATs, and related institutions, it is expected that legal certainty and rights protection in property sale and purchase transactions can be improved.
