Abstract

Haryono No. 169 Malang e-mail: sdeviambarwati@gmail.com Abstrak Pasca perubahan UUD NRI 1945 yang ketiga, kekuasaan kehakiman di Indonesia mengalami perkembangan yang telah mengubah sistem penyelenggaraan negara di bidang yudikatif. Adapun perubahan yang dimaksud berkaitan dengan pengaturan kewenangan judicial review atau hak menguji yang dijalankan oleh dua lembaga negara yakni MA dan MK. Berdasarkan kewenangannya tersebut, maka diaturlah hubungan dua lembaga negara itu secara operasional melalui Pasal 55 UU MK Juncto Putusan MK Nomor 93/PUU-XV/2017. Namun dalam praktiknya ketentuan tersebut justru tidak dijalankan oleh MA dalam proses uji materiil Peraturan Komisi Pemilihan Umum (PKPU), sebab terdapat adanya ketentuan limitasi waktu pengujian PKPU yang telah ditetapkan dalam Pasal 76 Ayat (4) UU Pemilu. Ketentuan tersebut mengharuskan MA untuk melakukan tindakan Constitution  Disobidience terhadap Putusan MK Nomor 93/PUU-XV/2017 dalam proses uji materiil PKPU. Namun tindakan tersebut mengacu pada asas Ius Curia Novit yang menjelaskan bahwa hakim dianggap mengetahui hukum, sehingga pengadilan tidak boleh menolak memeriksa dan mengadili perkara. Jenis penelitian ini merupakan penelitian Yuridis Normatif. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis bagaimana MA menjalankan Putusan MK Nomor 93/PUU-XV/ 2017 dalam proses uji materiil PKPU pada periode tahun 2018, serta untuk mengetahui dan menganalisis bagaimana konsekuensi hukum dari adanya tindakan yang dilakukan MA dalam proses uji materiil PKPU pada periode tahun 2018. Kata Kunci: Judicial Review, Mahkamah Agung, Mahkamah Konstitusi   Abstract Following the third amendment of the 1945 Indonesian Constitution, judicial power in Indonesia has undergone a change in the governance system in judicative scope. This change is related to the regulation of authority to hold judicial review or the right to review performed by Supreme Court and Constitutional Court. Regarding this authority, the relationship between these two state bodies is regulated in Article 55 of Law of Constitutional Court in conjunction with Constitutional Court Decision Number 93/PUU-XV/2017. However, Supreme Court does not seem to comply with the provision in the process of the judicial review since there is a time limit of reviewing, as enacted in Article 76 Paragraph (4) of Law concerning General Elections. This provision requires Supreme Court to perform Constitution Disobedience against Constitutional Court Decision Number 93/PUU-XV/2017 in the process of judicial review. This conduct refers to the principle of Ius Curia Novit implying that judges are fully aware of law and courts are not allowed to refuse to investigate and to judge cases. This research is based on normative juridical method that is aimed to find out and analyse how Supreme Court executes Constitutional Court Decision Number 93/PUU-XV/2017 in the process of judicial review of General Election Commission in the period of 2018, and to find out and analyse what legal consequence may exist due to the conduct performed by Supreme Court in the process required in the judicial review in 2018. Abstract

Marriage serves as a means to establish a legitimate relationship, both religiously and legally, aiming to achieve domestic harmony and offspring. It also intends to preserve the purity of lineage, preventing adultery and its potential impact on descendants and their rights. Constitutional Court Decision No. 46/PUU-VIII/2010 stipulates that children born outside of a legal marriage possess the same rights as those born within one. However, according to the Imam Shafi'i school of thought, children born outside of a legal marriage do not receive the same rights as children born within a legal marriage. This research aims to examine and compare the positive legal policy of the Constitutional Court's decision with the policies proposed by the Imam Shafi'i school of thought. This study employs a normative legal research method, utilizing a library research approach to gather data from various primary and secondary sources. The data analysis method used is descriptive analysis with deductive conclusions. The findings of this research reveal data in the form of the verdict of Constitutional Court Decision No. 46/PUU-VIII/2010, the perspective of the Imam Shafi'i school of thought, findings regarding the recognition of a child's status, and findings concerning the protection of the rights of children born out of wedlock. The data analysis yields results in the form of the concept of child protection according to Constitutional Court Decision No. 46/PUU-VIII/2010 and the Imam Shafi'i school of thought. Furthermore, the research presents findings regarding the legal consequences of the discrepancy between the concept of protecting the rights of children born out of wedlock in Constitutional Court Decision No. 46/PUU-VIII/2010 and the viewpoint of the Imam Shafi'i school of thought.
