Haryono No. 169Malang e-mail: RHutama68@gmail.comABSTRAK Tujuan Penelitian ini adalah untuk memberikan saran terkait pengaturan sanksi administratif atas keterlambatan penyerahan Laporan Keuangan Pemerintah Daerah kepada Badan Pemeriksa Keuangan (BPK) Khususnya Perwakilan Provinsi Jawa Timur. Adapun Metode Penelitian yang digunakan oleh penulis yakni penelitian hukum empiris. Dengan cara menganalisis permasalahan yang ada di lapangan serta tidak lupa juga menggunakan pendekatan perundang-undangan yang dilakukan dengan cara menelaah semua peraturan perundang-undangan berkaitan dengan permasalahan (isu hukum) yang sedang dihadapi serta menggunakan pendekаtаn yuridis sosiologis merupаkаn pendekаtаn yаng dilаkukаn dаlаm suаtu penelitiаn gunа mengаnаlisis dаn memberikаn jаwаbаn аtаs efektifitаs bekerjаnyа seluruh strukturаl hukum yаng secаrа lаngsung dilаksаnаkаn dalam masyarakat. Hal ini dipengaruhi oleh adanya kekosongan hukum atas sanksi administratif bagi pemerintah daerah yang terlambat dalam menyerahkan laporan keuangan. DPRD dapat membuat regulasi terkait Penundaan Transfer Dana APBN ke Daerah, Penundaan Pencairan Dana dari APBD Provinsi ke Kabupaten/Kota yang terlambat menyerahkan LKPD serta Kepala Daerah diharapkan dapat membentuk Perda Kabupaten/Kota yang memberikan sanksi tegas pada organisasi perangkat daerah serta stakeholder lain, agar menyerahkan laporan tepat waktu ke daerah sehingga Kabupaten/Kota tidak terlambat dalam menyerahkan LKPD kepada Badan Pemeriksa Keuangan (BPK).Kata Kunci: Pengaturan Sanksi Atas Keterlambatan Penyerahan LKPD Kepada BPK. AbstractThis research is aimed to contribute recommendation regarding administrative sanction over delayed financial statements submitted by local governments to State Audit Agency especially in the Province of East Java. Empirical method was employed, in which the issue was analysed by conducting field observation supported by statute approach that involved the study of all laws and regulations. Analytical approach was also used to understand and find out the meaning and definitions in the laws and regulations based on conception. Legal loopholes seem to be contributing factor to the delayed statements. Regional House of Representatives could make a regulation regarding the suspension of State Budget fund transfer to regional areas, suspension of fund disbursement from local budget of the province to the Regency/City submitting its delayed regional financial statements. It is expected that local governments form local regulation of the regency/municipality that imposes strict sanctions on organisations, other local apparatuses, and other stakeholders to urge on time financial statement submission to State Audit Agency.Keywords: regulation of sanction, delayed financial statement submission, submission of financial statements to State Audit Agency.

Abstract

The purpose of this research is to understand and analyze the ratio legis setting the minimum education requirements for senior high school or its equivalent for a presidential candidate from the study of treatises on discussing educational needs as well as to find out the conditions that can be used in determining the ability of a presidential candidate. The research method used by the author is a normative legal research method, by researching principles, synchronization, systematics, and legal comparisons. The author uses this type of normative legal research because, in formulating the problem, the author emphasizes the legal ratio to the educational requirements of a presidential candidate in Law No. 7 of 2017 concerning General Elections. This is influenced by the emergence of the author's curiosity about reasoning (ratio legis) from the minimum requirements for senior high school school or the equivalent for presidential candidates in Law No. 7 of 2017 concerning General Elections. The Indonesian House of Representatives is expected to be able to reformulate the development of regulations on educational requirements for presidential and vice-presidential candidates in Indonesia. The burden of duties carried out by a president certainly requires more ability to carry out the mandate that the people have entrusted to him in leading the running of the government. In this case, education is one of the components to assess a president's competence and ability.
