Abstract

Haryono No. 169 Malang email : aisyahnur139@gmail.com Abstrak Tulisan ini bertujuan untuk menganalisis terkait kesesuaian konsep restorative justice antara pertimbangan dan putusan hakim No. 1/Pid.Sus-Anak/2020/PN.Kpn dan juga kesesuaian terhadap ketentuan pemnberian divrsi mengacu pada pasal 7 UU SPPA .  Untuk menjawab tujuan tulisan tersebut, digunakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undang. Hasil penelitian tersebut menujuukan bahwa pertimbangan putusan hakim No. 1/Pid.Sus-Anak/2020/PN.KPN telah sesuai dengan ketentuan diversi Pasal 7 ayat 2 UU SPPA tetapi hakim tidak menggunakan independensinya untuk menafsirkan frasa “paling lama” sebagai dasar untuk memandang bahwa anak dapat dijatuhi hukuman pidana penjara kurang dari 7 tahun. Jika hal tersebut dilakukan, maka diversi dapat diupayakan. Pertimbangan hakim dalam memutus perkara pidana dengan putusan No. 1/Pid.Sus-Anak/2020/PN/Kpn masih belum selaras dengan konsep restorative justice. Kata kunci: Diversi, Restorative Jurtice, Peradilan Pidana Anak Abstract This paper aims to analyze the appropriateness of restorative justice concept between the considerations and judge's decision No.1/Pid.Sus-Anak/2020/PN.Kpn and also conformity to the provisions of diversion granted referring to Article 7 of Law on Criminal Justice System of Children (UU SPPA). In order to answer the aim of this paper, normative legal research is used with statutory approach. The results of this study indicate that the consideration of judge's decision No. 1 / Pid.Sus-Anak / 2020 / PN.KPN has complied with the provision of diversion on Article 7 paragraph 2 of UU SPPA, but the judge did not use his independency to interpret the phrase “the longest” as a basis for seeing that a child could be sentenced to less than 7 years imprisonment. If this is implemented, then diversion can be attempted. Judge’s considerations in deciding criminal cases with Decision No. 1 /Pid.Sus-Anak/2020/PN/Kpn are still not in line with the concept of restorative justice. Abstract

There is a Decision Number 3519 K/Pdt/2017 which is an appeal against the Decision of the Banda Aceh High Court numbered 43/PDT/2017/PT. The BNA, which in essence the panel of judges in the high court ruled that the Notary as defendant II was also decided by the Panel of Judges to be responsible and to be compensated along with the other defendants for the making of a Deed of Power of Attorney to Sell based on the testimony of the pretended Person. The person pretending to be someone authorized to be an obstacle in the deed, by carrying a fake Identity Card. The purpose of this study is to analyze the Legal Implications for the Parties Based on the Deed of Power of Attorney to Sell Where There Are People who pretend, through a normative juridical approach, namely regulations based on applicable laws and regulations. The results of the study provide an explanation of the decision of Cassation Number 3519 K / Pdt / 2017 which corroborates that this Deed of Power of Attorney to Sell is null and void. Thus, the aforesaid deed of power of attorney is no longer binding on the parties therein, all the powers and rights and obligations born out of the aforementioned grant of power are considered to have never existed and are binding on the parties (the person who claimed to be Z. Ahmad Nyak Cut and defendant I). in addition, there are other legal implications for the creation of a deed of power of attorney for sale in which there is a person who pretends, then according to one of the parties to the agreement, may apply for cancellation if it is found that the incompetence of the parties to the agreement.
