Abstract

Haryono No. 169 Malang e-mail: rinalvinachmad@gmail.com , rinalvinachmad@ub.ac.id Abstrak Penelitian ini bertujuan untuk mengetahui, bagaimana implementasi Peraturan Menteri Dalam Negeri Pasal 33 huruf a Nomor 138 Tahun 2017 tentang penyelenggaraan Pelayanan Terpadu Satu Pintu Daerah. Penelitian yang difokuskan pada penyederhanaan Pelayanan Perizinan dan Non Perizinan Terpadu antar sektor pemerintahan yang ditujukan pada Sistem Pelayanan Terpadu Satu Pintu Daerah Kediri yang disebut Kediri Single Window for Investment (KSWI). Sistem KSWI dikelola oleh Pemerintah Kota Kediri dan delegasikan kepada Dinas Penanaman Modal -Pelayanan Terpadu Satu Pintu Kota Kediri. Penelitian ini menggunakan metodologi penelitian yuridis empiris, dengan fokus pada penelitian tentang bagaimana Pemerintah Kota Kediri melaksanakan implementasi Peraturan Menteri Dalam Negeri Pasal 33 huruf a Nomor 138 Tahun 2017, terhadap sistem KSWI. Dalam penerapannya terdapat permasalahan seperti ego sektoral serta permasalahan harmonisasi dan sinkronisasi antar sektor pemerintahan yang membuat regulasi ini sulit untuk diterapkan.   Kata kunci: Implementasi, Penyederhanaan Prosedur, Integrasi, Pelayanan Publik, Kediri Single Window for Investment.   Abstract Bureaucracy in public services like the procedure required in permit issuance and non-permit-related matters still remains a problem for most people. Public services in Indonesia have been in a spotlight but not in a good way since the services tend to be lengthy and complicated. Moreover, sectorial ego and the absence of synchronisation of permit issuance services among government sectors also contribute some problems, leading further to another issue in the simplification of public service procedure. This research is aimed at finding out how the local government of Kediri implements the Regulation of Minister of Home Affairs Article 33 Letter a Number 138 of 2017 concerning One-stop Services through Capital Investment and One-stop Service Agency in a Region (DPM-PTSP) in Kediri city. This research is focused more on the simplification of procedure required in permit issuance and non-permit-related matter among government sectors performed in the system of Kediri Single Window for Investment.   Keywords: implementation, simplification of procedure, permit and non-permit, integration, public services, Kediri Single Window for Investment.

Abstract

The decision of the Panel of Judges in the State Administrative Court Decision at the Jakarta State Administrative Court Number 424/G/TF/2022/PTUN.JKT, contradicts with many human rights law, especially related to the right to communicate and obtain information and economic rights. The right to communicate and to access and obtain information is a right guaranteed and recognized by the Indonesian Constitution as stipulated in Article 28F of the 1945 Constitution, and regulated in Articles 14 of the Human Rights Act. In addition, the right to communicate and obtain information is also regulated internationally in the provisions of Article 19 of the Universal Declaration of Human Rights, and Article 19 of the International Covenant on Civil and Political Rights (ICCPR) which has been ratified in the provisions of the Law Number 12 of 2005 concerning the Ratification of the ICCPR (KIHSP Law). The right to economy and employment is a human right guaranteed in the Indonesian constitution, as stipulated in Article Article 27 paragraph (2) UUD NRI Tahun 1945, and regulated internationally in the provisions of Article 1 Number 2, Article 5 paragraph (2), and Article 6 of International Covenant on Economic, Social, and Cultural Rights (ICESCR) that has been ratified in the provisions of Law Number 11 of 2005 concerning the Ratification of the International Covenant on Economic, Social, and Cultural Rights (KIHESB Law).
