Abstract

Haryono No. 169 Malang e-mail: oppypramudya5@gmail.com  ABSTRAK Tulisan ini mengangkat permasalahan tentang perlindungan hukum kreditur atas sita jaminan harta pailit dari tindak pidana. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatis, dengan spesifikasi pendekatan perundang-undangan, pendekatan analitis, dan pendekatan kasus. Hasil penelitian ini menunjukkan bahwa upaya hukum yang dapat dilakukan kurator apabila penyidik telah terlebih dahulu meletakkan sita atas harta pailit debitor pailit, sebelum putusan pernyataan pailit diucapkan adalah dengan mengajukan praperadilan sesuai dengan aturan dalam Pasal 82 ayat (3) huruf d. KUHAP, untuk menetapkan bahwa benda yang disita tidak termasuk alat pembuktian, sehingga benda sitaan tersebut harus segera dikembalikan kepada kurator. Atau kurator juga dapat mengajukan gugatan lain-lain, yang kemudian atas putusan gugatan lain-lain tersebut dapat diajukan upaya hukum Kasasi dan Peninjauan Kembali. Dalam melindungi hak kreditur dalam kasus kepailitan ini, kurator dapat mengajukan upaya praperadilan dengan dasar hukum Pasal 31 UU KPKPU, Pasal 6 UU Perbankan, Pasal 18 UU HT, Pasal 19 UU Tipikor, Putusan Mahkamah Agung Nomor 1731K/Pdt/2011 dan Pasal 115 UU PT.Kata Kunci: kepailitan, sita, harta pailit ABSTRACTThis research studies the issue of legal protection given to a creditor regarding the confiscation of bankruptcy assets as security from criminal offences. With a normative juridical method, statutory, analytical, and case approaches, this research indicates that the trustee concerned could apply for pre-trial before bankruptcy is declared according to the provision of Article 82 paragraph (3) letter d as a legal remedy in case of the condition where an enquirer submits the seized objects of the bankruptcy assets of a bankrupt debtor. That is, the object has to be returned to the trustee. Moreover, the trustee could also file a lawsuit over other matters based on which the legal remedy of the third instance of court and judicial review could be taken into account. To protect the rights of creditors in a bankruptcy case, the trustee could apply for pre-trial according to Article 31 of Law concerning Bankruptcy and Suspension of Debt Payment Obligations, Article 6 of Law concerning Banking, Article 18 of Law concerning Mortgage Rights, Article 19 of Law concerning Corruption, Supreme Court Decision Number 1731K/Pdt/2011 and Article 115 of Law concerning Limited Liability Company. Abstract

The Non-Cash Food Assistance Program is a government initiative that aims to provide monthly food assistance to eligible families, followed by Sub-District Social Welfare Workers. The program has been implemented in 514 districts and cities in Indonesia, including one special city. The location in question is Malang City. The research methodology used in this study is descriptive qualitative. The descriptive qualitative approach is used as a means to investigate and analyze observations and findings within a particular domain or discipline. The research findings show that the Non-Cash Food Assistance Program has provided assistance to a total of 7,226 beneficiary families, as reported by the Ministry of Social Affairs. Malang City consists of 57 urban villages spread across 5 sub-districts. The outcome measures from this study have proven to be very important in helping beneficiaries effectively reduce daily expenditures, thus allowing the organization to generate higher profits that can be utilized to meet additional needs. Indirectly, this can be interpreted as an indication of their improved social welfare. Therefore, it can be said that this program has had a significant impact on poverty reduction efforts in the Malang urban area.
