Abstract

Andika Pradana Putra, Budi Santoso, Reka Dewantara Fakultas Hukum Universitas Brawijaya Malang e-mail: andika181198@gmail.com   ABSTRAK Dalam penelitian ini penulis membahas mengenai kekaburan norma yang mengatur mengenai status hukum pada Badan Usaha Milik Desa (BUMDes) yakni penjelasan Pasal 87 ayat (1) Undang-Undang Nomor 6 Tahun 2014 tentang Desa yang mengakibatkan status hukum dari BUMDes menjadi tidak jelas yakni apakah BUMDes dapat dikatakan sebagai badan usaha berbadan hukum atau bukan merupakan badan usaha berbadan hukum. Tujuan dari penelitian ini adalah untuk mendeskripsikan dan menganalisis tentang status hukum BUMDes yang didirikan oleh Pemerintah Desa dan untuk mengetahui implikasi yuridis dari kekaburan norma terhadap status hukum BUMDes yang didirikan oleh pemerintah Desa. Metode penelitian dalam penelitian ini menggunakan jenis penelitian yuridis normatif dengan menggunakan pendekatan penelitian antara lain pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan analitis (analytical approach). Hasil dari penelitian ini adalah mengetahui status hukum dari BUMDes sebagai badan usaha berbadan hukum dan juga mengetahui beberapa implikasi yuridis yang diakibatkan oleh tidak jelasnya status hukum dari BUMDes.Kata Kunci: Status Hukum, Badan Usaha Milik Desa (BUMDes) ABSTRACTThis study discusses the vagueness of norm governing the legal status of Village-owned Enterprises (henceforth BUMDes) regarding what is implied in Article 87 paragraph (1) of Law Number 6 of 2014 concerning Village, leading to the murky legal status of the BUMDes in terms of whether the BUMDes could be considered as a legal entity. This research aims to describe and analyze the legal status of BUMDes established by the village government and to find out the juridical implication of unclear norms regarding the status of BUMDes. This research employed normative-juridical methods, statutory, conceptual, and analytical approaches. The results of the research are to reveal if the BUMDes are a legal entity and to find out the juridical implication caused by the questionable status of the BUMDes. Abstract

This research aims to describe the implementation of the Pangku Paliare tradition in Muara Dua Village, Bengkulu Province, as well as to identify the religious values contained within and their role in internalizing values for early childhood. Pangku Paliare is an annual tradition held every 1st of Muharram as a form of gratitude to God for safety and sustenance. This tradition involves the entire community, including children, who participate in various customary activities as a means of teaching life and spiritual values. The researcher employed a qualitative approach with a case study method. Data were collected through observation, in-depth interviews, and documentation, then analyzed using the interactive model by Miles and Huberman through the stages of data reduction, presentation, and conclusion drawing. The results indicate that this tradition has three main stages: preparation, the main event, and closing, all of which are rich in religious and social values. Values such as honesty are reflected in elders' advice; gratitude is expressed through communal prayers on the 10th of Muharram; and mutual cooperation and togetherness are evident in activities preparing for the Mlemang procession. The involvement of children in all series of activities makes this tradition an effective medium for character education based on local wisdom.
