Abstract

The term Prosecutor as a state lawyer is not clearly stated in the Prosecutor's Law. Implementation of the functions of the Prosecutor as state attorney in the civil and administrative sphere of the state follows the flow and procedures for settlement of civil disputes and state administration in general. To optimize the implementation of the Prosecutor's function as a state lawyer, the Prosecutor must be provided with education and training regarding civil law and constitutional law/state administrative law. Therefore, the institutionalization of the State Attorney Attorney is also needed so that if a lawsuit involving the interests of the state occurs, there will be no difficulty in appointing and determining the Prosecutor acting as the State Attorney.

Abstract

A testamentary grant on ex-customary land as an object of the dispute by looking at the Court's Decision which decided on a civil dispute case Number: 21/Pdt.G/2015/PN/BLK which in its decision rejected the plaintiff's claim that the ex-customary land belonged to him, because the defendant has proof of ownership, namely a will grant deed carried out by the Camat as PPATS. This study aims to analyze the strength of the proof of the will as the basis for land tenure and ownership, as well as to analyze the validity of ownership and control of ex-customary land rights based on the testament grant deed made by the sub-district head as PPATS. This study uses empirical research methods, by analyzing the data collected through interviews and literature study, then the collected data is analyzed using descriptive analysis techniques. The results of this study indicate that the testament grant deed in the case of the Civil dispute Number 21/Pdt.G/2015/PN/BLK does not have a basis of manufacture where the will grant deed does not have a certificate and is only made in front of the sub-district head as PPATS, further should have been canceled by the Bulukumba District Court because it was not following the procedure for making a will and the beneficiary did not get his rights. So that it does not have the validity of ownership and control of rights if it is based on a will grant deed made by the sub-district head as PPATS

Abstract

The Land Registration System according to Government Regulation Number 24 of 1997 does not include Customary/Ulayat Land as the subject of registration, but the Southeast Maluku Land Office registers customary lands sporadically through the First Registration mechanism, then the Tual City Government recognizes Larvul Ngabal as a customary law system by issuing a City Regulation Tual Number 04 of 2020 concerning Ratschap, Ohoi/Finua which was submitted to the Land Office of Southeast Maluku Regency is currently only owned by individuals/individual clans, with the stipulation that the conversion/proof of old rights is processed through the Recognition of Rights and the legal status changes from former land Customary rights become property rights that have legal force in accordance with the provisions of the legislation of the Unitary State of the Republic of Indonesia.

Abstract

Penerapan prinsip mengenali pengguna jasa oleh pejabat pembuat akta tanah (PPAT). Penelitian ini bertujuan untuk menganalisis efektifitas penerapan prinsip mengenali pengguna jasa oleh pejabat pembuat akta tanah (PPAT) di kota makassar. Penelitian ini menggunakan metode penelitian empiris, dengan menganalisis data yang terkumpul melalui wawancara dan studi kepustakaan, yang disajikan secara kualitatif. Hasil penelitian ini menunjukkan bahwa PPAT di Kota Makassar telah menerapkan prinsip mengenali pengguna jasa dalam pembuatan aktanya, namun penerapannya belum dapat diwujudkan dikarenakan masih adanya ketakutan dan keraguan dari PPAT untuk melaporkan adanya dugaan tindak pidana pencucian uang yang dilakukan oleh penghadapnya, kemudian sampai saat ini pembinaan, pengawasan, koordinasi dan kerja sama antara pihak PPATK, Badan Pertanahan Nasional (BPN) maupun organisasi IPPAT di Kota Makassar terkait kewajiban PPAT untuk menerapkan prinsip mengenali pengguna jasa dalam rangka pencegahan dan pemberantasan tindak pidana pencucian uang belum efektif.

Abstract

This research aims to know the dynamics of the development of people’s lives are getting more advanced and the government's burden as the government administrator is increasing. This research is legal research using the statutory and conceptual approaches. This paper provides information on the latest trend in research. The results show that all State or regional property is used to maximize public services. Even some State/regional properties should be able to be enjoyed by the public. The existence of the Government and Private Entity Cooperation as one of the legal figures, which is a model of cooperation financing for the provision of infrastructure for State/regional property, in the end, actually raises legal problems related to its management. The conclusion show that the most important problem is the Government and Private Entity Cooperation, the potential for merging of public and private affairs that may participate in the provision of commercial facilities. Ideally, the Government and Private Entity Cooperation are intended to provide social and economic infrastructure in the context of public services.
