Abstract

Government has right to issue rules that is viewed benefit its citizens in the future. Moreover, it is its main responsibility to guarantee benefit. Indonesia, as a nation that has various citizens from ethnic, tradition, language, religion, and belief, certainly need regulations that are able to maintain harmony relation among them, so that the difference is not a disunion factor. One of them is the issue of the Bill No. 1/PNPS/1965 that can be said as a real proof that Indonesia maintains the harmony of religious life.

Abstract

This article analyzes the fate of children resulting from unregistered marriages in a review of fiqh and the Compilation of Islamic Law (KHI). The sirr marriage polemic is closely related to the child's lineage status. Even though sirr marriages are carried out according to Islamic law, these marriages must be protected by State law in accordance with applicable laws and regulations to give them legal force, especially in relation to the child's lineage status. The aim of this research is to examine the lineage status of children from sirr marriages from the perspective of jurisprudence and the Compilation of Islamic Law. This research uses a qualitative descriptive approach to examine the lineage position of children born from sirr marriages. The results show that there are differences between fiqh and KHI regarding the fate of children born from sirr marriages. According to fiqh, all children born from marriages that fulfill the terms and conditions will be automatically assigned to their father. In jurisprudence, children born from unregistered marriages can be assigned to the father. However, in KHI, children born from unregistered marriages can be assigned to the father through a court order or istilhaq.

Abstract

This study examines the fatwas on women’s health and beauty issued by the Indonesian Ulema Council (MUI), explicitly investigating the influence of particular madhhab on these fatwas. This influence will be evaluated in MUI’s fatwas on women’s health and beauty, including fatwas on menstrual suppression pills, abortion, female circumcision, plastic surgery, and botox injections for beauty and care. The doctrinal approach of legal research is applied to analyze the use of Islamic legal sources and arguments. This study shows that although the majority of Indonesian Muslims follow the Shafi’i school, MUI does not solely adhere to the Shafi’i school in formulating its fatwas. Instead, MUI also employs approaches from other madhhab, such as Hanafi, Maliki, and Hanbali. As various MUI’s fatwas have provided broad guidelines for the community, fatwas on women significantly influence the legal basis for government policies.  Abstrak: Kajian ini mengkaji fatwa-fatwa kesehatan dan kecantikan perempuan yang dikeluarkan oleh Majelis Ulama Indonesia (MUI) serta  secara eksplisit menyelidiki pengaruh mazhab tertentu terhadap fatwa-fatwa tersebut. Fatwa MUI yang dikaji menyangkut tentang kesehatan dan kecantikan perempuan, termasuk fatwa tentang pil penekan menstruasi, aborsi, sunat perempuan, operasi plastik, dan suntik botox untuk kecantikan dan perawatan. Pendekatan penelitian hukum doktrinal diterapkan untuk menganalisis penggunaan sumber dan argumentasi hukum Islam. Kajian ini menunjukkan bahwa meskipun mayoritas umat Islam di Indonesia menganut mazhab Syafi’i, namun MUI tidak semata-mata menganut mazhab Syafi’i dalam merumuskan fatwa-fatwanya. Sebaliknya, MUI juga menggunakan pendekatan dari mazhab lain, seperti Hanafi, Maliki, dan Hanbali. Karena fatwa-fatwa MUI tersebut  memberikan pedoman yang luas bagi masyarakat, maka fatwa tentang perempuan sangat mempengaruhi dasar hukum kebijakan pemerintah.

Abstract

The utilization of the istinbath method in determining the legal framework concerning the use of carmine dye in various fatwa institutions, including the Indonesian Ulema Council and Da'irah al-Ifta' Jordan, remains a subject of ongoing discourse and deliberation. This study compares the istinbath method for determining the carmine law between the Indonesian Ulema Council and Dairah al-Ifta’ Jordan and the istihalah process in manufacturing carmine dye. The research method uses normative juridical with a conceptual approach and comparative law. The findings of this study indicate that the Indonesian Ulema Council and Da’irah al-Ifta’ both permit carmine dye, but with different istinbath methods. The Indonesian Ulema Council likens Carmine to grasshoppers because they have many similarities. On the other hand, Dairah al-Ifta’ considers that carmine dye has undergone the istihalah process. The similarities between the Fatwa of the Indonesian Ulema Council and the Fatwa of Da’irah al-Ifta’ Jordan include: 1) both state that carmine is an insect and, 2) both institutions also state that the use of carmine dye must be based on the condition that it is not harmful to humans. The process of making carmine dye undergoes the istihalah process according to the Hanafi and Maliki schools, involving changing one substance to another and changing from something bad to something good. This research contributes to the development of science related to the determination of the Fatwa on the use of carmine dye and references for the Muslim community in related matters.

Abstract

The transformation policy of state universities is not merely limited to curriculum integration within study programmes; it also seeks to eliminate the dichotomy between religious sciences and general sciences. The Comparative Mazhab Study Programme at UIN Jakarta explores scholarship based on both positive law and Islamic law. This study addresses two main research questions: (1) How is the curriculum of sharia and legal sciences formulated in the Comparative Mazhab Study Programme, Faculty of Sharia and Law, UIN Jakarta? (2) How is the integration of these disciplines implemented within the curriculum? Employing a qualitative descriptive approach and literature-based data collection techniques, the study finds that the curriculum is formulated through a combination of sharia and legal science-based courses. Integration is achieved through curriculum updates that serve as a competitive advantage for graduates. Future research may further examine the internal and external challenges faced in the process of integrating these bodies of knowledge.

Abstract

Nash Alquran dan Sunnah tidak secara tegas membicarakan hukum wakaf, dan memang kebanyakan hukum wakaf dihasilkan lewat ijtihad dan ini membuat hukum wakaf berkembang sesuai dengan perkembangan zaman. Bila pada awalnya wakaf hanya berbentuk benda-benda yang tidak bergerak, namun seiring zaman, obyek wakaf mengalami perubahan, tidak hanya terbatas pada benda tidak bergerak, melainkan lebih luas merambah ranah yang lain. Muncul istilah wakaf profesi, wakaf jasa, wakaf ilmu dan yang terbaru wakaf saham. Semuanya ini memerlukan kajian khusus untuk mencari legitimasi syariah dan ketepatan tujuan pentasyrian wakaf dalam Islam.
