Abstract

There are divisions, friction and disagreements in the household that reach the divorce line. Usually, these things are caused by incompatibility between the husband and wife; one of the causes is forced marriage or mujbir guardian. Ulama also has different opinions regarding the marriage guardian and the mujbir guardian. This research examines Yusuf Qardhawi's fatwa and its relevance to KHI. There are three formulations for this research, namely: What is Yusuf Qardhawi's view of mujbir guardian and marriage guardian? and what is their relevance to KHI? the method researchers chose here is library research with a qualitative approach. Data sources include primary data from Yusuf Qardhawi's fatwa and KHI. Meanwhile, secondary data is in fiqh books, journals and others. From the analysis that the author has carried out, Yusuf Qardhawi rejects the opinion that allows guardians forced on girls because several hadiths require consultation with girls when they want to get married, so the sign is that they are not allowed to marry without their consent, and also have to look at the historical framework in Imam Syafi'i's era where women did not have the ability to choose a partner, is different from this era where women's education is equal to that of men. Yusuf Qardhawi's opinion is relevant to KHI article 16, paragraph 1. Yusuf Qardhawi also allows marriage without a guardian, as is Hanafi opinion; this is not relevant to KHI in article 14, which makes the guardian one of the pillars.

Abstract

Article 31 of the Compilation of Islamic Law clearly regulates that the woman may lighten the mahr burden for the man in accordance with Islamic teachings. However, the reality in some ethnic groups in Indonesia, such as the Bugis, sets high mahr requirements that do not take into account the financial ability of the prospective husbands. In the Bugis culture, the mahr is adjusted based on the level of education of the prospective wife, with higher educational levels resulting in a higher mahr. As a result, the concept of mahr in the form of teaching worldly knowledge has become an alternative for marriage mahr. The purpose of this study is to understand the legal perspective on mahr in the form of teaching worldly knowledge and how maslahah mursalah views this type of mahr. This research uses a descriptive qualitative method with library research techniques, where the author gathers information from classical fiqh books, theses, and websites. After systematically analyzing the data, the author draws conclusions. The conclusion is that Imam Shafi'i and Imam Hanbali permit mahr in the form of a beneficial task whose benefits are clear, such as teaching the Qur'an, permissible poetry, literature, writing, handicrafts, and other beneficial and permissible activities. From the perspective of maslahah mursalah, mahr in the form of teaching worldly knowledge brings maslahah for the wife in her life. Moreover, if the knowledge taught involves skills needed in the present day, such as programming, editing, filming, and so on, it will result in financial income that can support the wife’s financial needs in her daily life.

Abstract

The utilization of the istinbath method in determining the legal framework concerning the use of carmine dye in various fatwa institutions, including the Indonesian Ulema Council and Da'irah al-Ifta' Jordan, remains a subject of ongoing discourse and deliberation. This study compares the istinbath method for determining the carmine law between the Indonesian Ulema Council and Dairah al-Ifta’ Jordan and the istihalah process in manufacturing carmine dye. The research method uses normative juridical with a conceptual approach and comparative law. The findings of this study indicate that the Indonesian Ulema Council and Da’irah al-Ifta’ both permit carmine dye, but with different istinbath methods. The Indonesian Ulema Council likens Carmine to grasshoppers because they have many similarities. On the other hand, Dairah al-Ifta’ considers that carmine dye has undergone the istihalah process. The similarities between the Fatwa of the Indonesian Ulema Council and the Fatwa of Da’irah al-Ifta’ Jordan include: 1) both state that carmine is an insect and, 2) both institutions also state that the use of carmine dye must be based on the condition that it is not harmful to humans. The process of making carmine dye undergoes the istihalah process according to the Hanafi and Maliki schools, involving changing one substance to another and changing from something bad to something good. This research contributes to the development of science related to the determination of the Fatwa on the use of carmine dye and references for the Muslim community in related matters.

Abstract

This study examines whether Constitutional Court Decision No. 62/PUU-XXII/2024, which abolishes the presidential threshold for presidential and vice-presidential candidates, aligns with concepts in fiqh siyasah. Using qualitative library research and a descriptive-analytical method, the analysis applies the fiqh siyasah framework to assess the decision. The findings reveal that the abolition reflects the principle of al-Musawah—equality of rights for all citizens—an essential element in Islamic political thought. This concept includes both civil and constitutional rights, supporting inclusive political participation. The study also highlights scholarly views that the hadith restricting leadership to the Bani Quraish is no longer applicable. Therefore, the Court’s ruling aligns with Islamic jurisprudence, aiming to guarantee equal access to constitutional rights for all, without lineage-based restrictions. In conclusion, the decision mirrors the goals of fiqh siyasah by promoting equality and inclusivity within the democratic process in accordance with Islamic political values.

Abstract

The transformation policy of state universities is not merely limited to curriculum integration within study programmes; it also seeks to eliminate the dichotomy between religious sciences and general sciences. The Comparative Mazhab Study Programme at UIN Jakarta explores scholarship based on both positive law and Islamic law. This study addresses two main research questions: (1) How is the curriculum of sharia and legal sciences formulated in the Comparative Mazhab Study Programme, Faculty of Sharia and Law, UIN Jakarta? (2) How is the integration of these disciplines implemented within the curriculum? Employing a qualitative descriptive approach and literature-based data collection techniques, the study finds that the curriculum is formulated through a combination of sharia and legal science-based courses. Integration is achieved through curriculum updates that serve as a competitive advantage for graduates. Future research may further examine the internal and external challenges faced in the process of integrating these bodies of knowledge.

Abstract

Typing training on the computer is intended to determine the average WPS (Word Per Minute) of students, to encourage students to type quickly and accurately, and also to introduce the importance of typing today. Typing training for students of MTs Darul Muslim is carried out using the SL (Service Learning) method. This activity is carried out with one meeting and is carried out with two sessions in August 2024. This activity includes material and practice sessions. The material session is filled with an introduction to ICT, the importance of typing, ten-finger typing tricks, and questions and answers. Followed by a typing practice session with the 10Fast Fingers website. The results of this training activity were successful. This success aims to increase students' knowledge, namely that technology is not just mobile games, cellphones, and also knowing the importance of fast and accurate typing skills. In addition, the average WPS (Word Per Minute) of each 7th grade student of Mts. Darul Muslim is around 5-10, which means that there needs to be an evaluation and emphasis on typing training for students.
