Abstract

This research seeks to explain the implementation of Islamic law in Aceh, especially the institutionalization Islamic criminal law through the implementation of Jinayat Law as part of the criminal justice system in Indonesia. Positive law in Indonesia is the legal norms derived from Islamic jurisprudence as a result of normative ‘marriage’ between sharia law and local wisdom Indonesia, even though the constitution 1945 did not mention Indonesia as an Islamic state, but Islamic law in Indonesia is living amidst society. Formerly it was only limited to the field of Ahwal Al-Syakhsiyah and Muamalat, however, nowadays partake into the Islamic criminal law (Jinayah). Aceh province is given authority to implement the Islamic jurisprudence (qanun), have since recorded constitution no. 44 of 1999, constitution no. 18 of 2001, and constitution no. 11 of 2006, all of which is a product of positive law governing Indonesia about privileges and specificity of Aceh. This research method using library research and juridical normative legal research with secondary data and use approaches regulations (statute approach). This research concludes that Islamic criminal law (jinayat) that are implemented in Aceh as part of the criminal justice system, which complements the general rules that apply nationally and the law of criminal procedure has not been full of the legal community in Indonesia especially Muslims in Aceh. Abstract

ABSTRAK. Konflik yang telah berlangsung lama di Aceh harus diselesaikan. Sejumlah era belum sepenuhnya berhasil menuntaskan berbagai pelanggaran hak asasi manusia yang telah terjadi. Artikel ini ingin menawarkan langkah rekonsiliasi dalam rangka pencapaian perdamaian abadi di Aceh. Titik sentral yang harus diperjuangkan adalah misi pengusutan pelanggaran hak asasi manusia yang tidak boleh menyusut. Seluruh komponen bangsa ini memerlukan suatu proses penyembuhan. Hal ini hanya akan terjadi jika penyakit itu diketahui, didiagnosis, dan diobati. Tujuan proses ini intinya membawa pelaku mengakui kesalahan sejarahnya. Long Road to Reconciliation ABSTRACT. Long-running conflict in Aceh must be completed. Some era has not fully succeeded in completing a wide range of human rights violations that have occurred. This article would like to offer reconciliation measures in order to achieve lasting peace in Aceh. The central point that must be fought is the mission investigating human rights violations should not be shrunk. All components of this nation requires a process of healing. This will only occur if the disease is known, diagnosed, and treated. The purpose of this process is essentially bringing the perpetrators acknowledge historical wrongs.

Abstract

ABSTRACT: Convention on the Total Prohibition of Anti-Personnel Mines, was formed with a view to realizing the "Free Mine World ". Indonesia has ratified the convention, commonly known as the Ottawa Convention 1997 to the Undang-Undang Nomor 20 Tahun 2006. As a State Party, Indonesia is obliged to fulfill all the provisions of the convention and the most important is the commitment to protect every citizen from falling victim to anti-personnel mines. In armed conflict of Aceh, mines were used by both parties that the Government of the Republic of Indonesia and the Free Aceh Movement, indications are casualties is dominated by civilians after the armed conflict stopped. For these reasons, the parties are considered not to comply and execute its responsibility of each as intended conventions and International Humanitarian Law Principles. The reality is stands to reason, because the implementation of the state responsibility principle for the total prohibition anti-personnel mines are less than the maximum and seemed to slow. The problem lies in the lack of political will of both parties to keep the peace and support the development agendas in Aceh on going basis, especially with completing problems arising from the existence of anti-personnel mines. State Responsibility Towards a Total Prohibition Anti-Personnel Mines in Indonesia in Armed Conflict of Aceh

Abstract

The usage and management of the sea resources are still having classic obstacles either technical or structural. Aceh’s sovereign on the sea should be realized by the optimizing its resources wisely. For that reasons, the comprehensive understanding in terms of fulfilling Human Rights is relevant enough to be an indicator and it is part of state responsibility. This article aims to explain the reality of the sovereignty based on human right principle. Regarding to the management of the resources, the Aceh Government is taking part to manage and use it. Article 162 (1) of Aceh Governance Act states the Government and regional governments are entitled to manage the resources living in the territory. The development refers that, Aceh has great opportunity to develop its sovereignty. Thus, the state responsibility in fulfilling economic rights, social, and culture as demanded can be realized. The Sovereign of Sea Local Resources: Human Rights Perspective
