Abstract

ABSTRAK: Tanggung jawab untuk melindungi merupakan norma yang muncul dari hukum internasional yang bertujuan untuk menyediakan sarana bagi masyarakat internasional untuk mencegah kejahatan kekejaman massal yang terjadi dalam batas-batas negara yang berdaulat. Meskipun memiliki asal-usul langsung dalam upaya untuk mereklasifikasi gagasan kedaulatan, dan pergeseran itu semata-mata sebagai hak untuk termasuk tanggung jawab, sumber sebenarnya adalah Konvensi Den Haag 1899 dan Marten Clause. Ada optimisme yang luar biasa di tahun-tahun setelah adopsi oleh Komisi Internasional tentang intervensi dan kedaulatan negara pada tahun 2001 dan ketika itu diadopsi dengan suara bulat sebagai bagian dari dokumen Hasil World Summit tahun 2005. Artikel ini mencoba untuk mengeksplorasi pengembangan tanggung jawab untuk melindungi, bahasa yang bereda digunakan untuk menggambarkan tanggung jawab untuk melindungi dan implikasinya. Responsibility to Protect as A Doctrine or Emerging Norm in International Law ABSTRACT: Responsibility to protect is an emerging norm of international law that seeks to provide a means for the international community to prevent mass atrocity crimes occurring within the boundaries of a sovereign state. While it has its direct origins in attempts to reclassify the notion of sovereignty, and shift it away solely as right to include responsibilities, its real source is the Hague Convention 1899 and its Marten Clause. There was tremendous optimism in the years after its adoption by the International Commission on Intervention and State Sovereignty (ICISS) in 2001 and when it was adopted unanimously as part of the World Summit Outcome document in 2005. This article attempts to explore the development of responsibility to protect, the different language is used to describe responsibility to protect and its implications for responsibility to protect and the implementation of responsibility to protect.

Abstract

ABSTRACT: The Association of South East Asian Nations was established as a political and economic entity through Bangkok Declaration in 1967. Among its seven objectives are: to accelerate growth, social progress and cultural development, to promote regional peace and stability through abiding respect for justice and the rule of law in the relationship between countries in the region and adherence to the principle to the United Nations Charter. Although the term ‘human rights’ is not explicitly used in the Declaration, by affirming adherence to the principle of the United Nations Charter, the founding members of ASEAN accepted its purposes and principles. The Association of South East Asian Human rights issues and the establishment of Association South East Asian Nations (ASEAN) human rights mechanism are still very challenging matters for ASEAN. Generally speaking, ASEAN has been making a slow progress in the field of human rights. ASEAN has long empashized that the promotion and the protection of human rights by the international community must recognize national sovereignty, national border and non-interference in another state’s affairs. ASEAN views human rights as an internal affairs. The establishment of human rights mechanism was provided for by the Charter but what kind of human rights body ASEAN would be comfortable with was a crucial question for ASEAN and its people. Through the setting up of ASEAN Human Rights Body, this paper aims to examine the effectiveness of the ASEAN Human Rights Body in dealing with human rights issues in ASEAN region. The Effectiveness of Asean Human Rights Body in Dealing With Human Rights Issues in Asean Region
