Abstract

Phenomenological approach to the study of religion has played such a significant role in unraveling mysteries of religious experiences. By bracketing-out (epoch?), a researcher must suspend all of his/her judgments concerning the phenomenon under investigation in order that he/she may gain the real knowledge of the religious phenomena and experience as well as the essence of a religion. However, this approach has been subjugated to many critiques which show that it is vulnerable on the following areas: the continued philosophical viability of the phenomenology of religion, the surreptitious theological assumptions or motives behind this approach, and the public role of scholar in social community under study.

Abstract

This paper deals with the development of the term madhhab in the history of Islamic law. As a vital concept in Islamic law, the meaning of madhhab has undergone several changes. At first, it was related only to a personal opinion of a mujtahid. Then it was related to a view of ulama belonging to a particular school of thought, and finally it is understood as a doctrinal opinion with distinctive legal concepts and methodologies controlled by the authority of the ulama who occupy the axis of the madhhab hierarchy. Some madhhabs have gone extinct due to their irrelevant concepts, but some others managed to survive due to their ability to make a ?great synthesis? between reason and revelation, text and context. Some of these surviving madhhabs have even become the official madhhab of a Muslim state and made obvious contribution in the formation of Islamic law in that particular country. It is to this issue that this paper is mainly concerned with.

Abstract

Abstract: This paper deals with the issue of suicide terrorism or suicidal bombing which has been used as a serious tactic by terrorist organizations or radical and puritan religious movements. The motive behind this kind of action varies greatly, ranging from religious, cultural, political, to social issues. In the literatures on jiha>d, there are various points of view regarding the legality and validity of suicidal attack. First, those who allow this act and regard it as a part of the tactic and strategy of jiha>d, such as radical islamist movements (Salafi-jiha>dists). Second, those who allow it on several conditions, such as Salafi-intellectual (salafiyyah ‘ilmiyyah) and Salafi-reformists (salafiyyah is}la>hiyyah). Third, those who prohibit this act absolutely, such as Salafi-wahha>bists (salafiyyah wahha>biyyah), who based their arguments on the assumption that this is regarded as the act that is prohibited in Islam, and there is no legal precedence in the history of Islamic law that allows the attack to civil people (women, children, and old men) and non-military targets.

Abstract

This paper deals with the controversy that occurs between Akhbârî and Ushûlî within Syî’ah Imâmiyyah’s thought. The controversy lies on the legal methodology employed in understanding the will of God after the great occultation of the twelfth Imam. Akhbâri, which is literalist in nature, tends to absolutely get rid of reason as a means of deriving Islamic laws, while insists on revelation and akhbâr of the Imams. They strictly hold that Shi’ites must absolutely follow such twelve imams, since it is only they who are able to accurately interpret the Quran. On the other hand, Ushûlî allow the use of ijtihâd (legal reasoning) into a great deal in making legal decisions, and also argue that a Shi’ite must abide by mujtahid (legal experts), as well as the Imams. Therefore, they can come up with vital concepts in a religious life of Shi’ites nowadays, such as marja‘ al-taqlîd and wilâyat al-faqîh

Abstract

Abstract. This paper deals with the role of muṣālaḥah in conflic resolution among Muslim societies using a historical approach. From a historical analysis it is concluded that the concept of ṣulḥ and muṣālaḥah have predated Islam, and played a vital role in resolving disputes and conflicts among clans in pre-Islam Arab societies. In the period of Islam, as in the case of Fatḥ Makkah (winning over Mecca) and Ṣulḥ al-Ḥudaybiyyah (peace treaty at Ḥudaybiyyah). In resolving conflicts, there are principles employed by the Prophet Muḥammad, such as tolerance, non-violence, patience, forgiveness, peace, harmony and mercy.Kata Kunci:        resolusi konflik, muṣālaḥah, ṣulḥ, toleransi, nir-kekerasan, pemaafan

Abstract

Abstract: The paper deals with the concept of multiculturalism from the Quranic perspective. It is argued that since the beginning, the Quran recognised and appreciated diversity based on race, religion, culture, and so on. Even, the Quran itself was revealed in the multicultural context. The epistemological basis for multiculturalism in the discourse of the Quran is “human dignity”, from which emerge a set of basic rights that must be respected and protected, which becomes an ethical foundation of multiculturalism. As a consequence of protecting the basic rights, the concept of justice and equality comes to surface. Since human beings are created as sacred and equal, hurting them and their rights is violation to universal humanity. Therefore, to achieve peace, toleration is necessary. To do this task, the strategy of anti-discrimination and prejudice reduction to different groups based on ethnicity, race, culture, and religion—is highly necessary to be established according to local context.Kata Kunci:      Alquran, multikulturalisme, hak asasi manusia, keadilan, toleransi, dialog

Abstract

Artikel ini  mendiskusikan gerakan feminisme Islam dalam masyarakat Indonesia kontemporer. Gerakan ini merupakan  respons terhadap ketidakadilan gender yang dialami oleh para perempuan Muslim Indonesia. Ketidaksetaraan ini tidak saja didukung oleh penelitian psikologis dan antropologis, tetapi juga oleh interpretasi tradisional terhadap Islam yang dikodifikasikan dalam “kitab-kitab kuning” dan disebarluaskan oleh pesantren-pesantren. Ini kemudian masuk ke dalam kesadaran orang Islam dan diambil sebagai ajaran Islam yang “benar”. Selanjutnya, ajaran ini  menguat melalui proses hegemoni dengan cara “kesepakatan” (consent), sehingga sulit bagi perempuan untuk menjauhinya. Bagaimanapun juga, kemunculan intelektual Muslim untuk mendekonstruksi interpretasi-interpretasi tradisional terhadap Islam yang bias gender dan merekonstruksi sebuah penafsiran yang lebih adil adalah sebuah fenomena yang tidak dapat dipisahkan dari kesadaran perempuan tentang ketertindasan mereka di dalam dunia Muslim. Mereka menasfsirkan teks-teks tersebut dengan menggunakan metodologi dan pendekatan yang berbeda termasuk, di antaranya, pendekatan lingusitik, hermeneutic, qath’î-zannî, dan metode takhrîj dan ta’lîq. Key Words: Islamic feminism, gender relation, hermeneutics, qath’î-zannî, takhrîj, ta’lîq
