Abstract

AbstrakPernikahan merupakan peristiwa yang sangat sakral yang  berlaku untuk semua agama. Karena dengan pernikahan masing-masing melakukan perjanjian atas nama Tuhan. Namun, realita yang terjadi adalah degradasi (penurunan) makna dan ketidakpahaman bahkan ketidaktahuan pasangan suami istri terhadap hikmah yang sangat besar dari pernikahan tersebut. Penelitian ini bertujuan untuk mengetahui hikmat al-tasyrī’ dalam hukum Islam, hikmat al-tasyrī’ hukum perkawinan yang dikemukakan oleh Sayyid Sabiq dalam buku Fiqh al-Sunnah, dan analisa pemikiran Sayyid Sabiq mengenai hikmat al-tasyrī’ hukum perkawinan dalam buku Fiqh al-Sunnah. Sayyid Sabiq memiliki fokus dan kajian-kajian yang mendalam dalam hikmat al-tasyrī’ dalam syariat-syariat Islam khususnya dalam kitab Fiqh al-Sunnah. Beliau juga menjelaskan hikmat al-tasyrī’ bersumberkan Al-Qur’an dan Hadis sebagai dalil naqli. Namun, jika beliau tidak menemukannya dari sumber-sumber tersebut maka akan diungkapkannya dengan dalil aqli, hal ini bisa dilihat pada hikmat al-tasyrī’ yang telah dicantumkan dalam kitab Fiqh al-Sunnah-nya. Kata kunci: hikmat al-tasyrī’; perkawinan; Sayyid Sabiq; Fiqh al-Sunnah

Abstract

Abstract This article is motivated by the rejection by the Wates Religious Court of the application for marriage dispensation based on the Judge's view of the conditions of the applicant and the bride and groom to be married. The purpose of this article is to find out the reasons for the Judge's refusal and analyze it with child protection theory. This research is qualitative by using a case study approach in court case number 39/Pdt.P/2018/PA. Wts. The result of this analysis is that granting and rejecting applications for marriage dispensation is not an easy thing for the Judges. The panel of judges makes full efforts to ijtihad to find the best result for the child. The judge considers the long-term benefits of marriage. They emphasize that the implementation of marriage is not difficult but requires effort to maintain it. By considering the long-term benefits and understanding that running a marriage is hard, couples need to prove that each has an understanding and readiness both mentally, economically, and psychologically. Abstract

This study aims to analyze a place of thought from Sayyid Sabiq's shop about thalak as contained in a poplar work of Fiqh As-Sunnah. This study focuses on his views on the facts, conditions, forms, and wisdom of a thalak from the perspective of Islamic fiqh. Thus, this larya imiah uses a qualitative approach, namely, library research on primary sources of Fiqh As-Sunnah by Sayyid Sabiq, as well as secondary sources from classical fiqh books and contemporary Islamic law literature. The results of the study show that Sayyid Sabiq understood thalak not as a means to oppress women, but as the last way out (the shari'i emergency way) when the goal of marriage can no longer be achieved. He emphasized that thalak must be pursued with full responsibility, based on the principle of justice. In his view, the law of thalak is mubah, but it becomes makruh if it is done without a good reason. Sayyid Sabiq's thinking shows a strong relevance to the context of Islamic family law in moderation, as it provides a balance between the right of men and women to impose thalak and women's right to self-justice. This research contributes to the development of more rational Islamic family law, to the benefits of sharia.
