Abstract

The purpose of this research is to know and understand the regulation of mineral and coal mining business implementation conducted by foreign investors before the birth of Rule Number 1 Year 2017 and to know and understand the implication of the birth of Regulation No. 1 of 2017 is hurt with the aim of the state. In this research, to reach the objective, normative research method with regulatory approach is applied by reviewing the laws and regulations related to research and case approach related to the divestment of mining business by foreign investors. The conclusion yields two conclusions. The first conclusion is the regulation of the implementation of mineral and coal business activities prior to the issuance of Government Regulation No. 1 of 2017 is regulated in several laws and regulations which have two weak points. The first concerns the regulation of inconsistent divestment shares and both mechanisms of work contracts that are detrimental to the Government of Indonesia. the second conclusion, the issuance of Government Regulation No. 1 of 2017 confirms the number of divestment shares and changes in working contract patterns to mining business permits maximizing the realization of welfare for all Indonesian people.

Abstract

LPD secara materil melaksanakan aktifitas perbankan sehingga risiko yang dihadapi lembaga perbankan juga akan dihadapi LPD, sehingga mengatur dan menerapkan prinsip-prinsip perbankan menjadi suatu keniscayaan. Prinsip mengenal nasabah merupakah salah satu prinsip perbankan yang penting dan strategis dilakukan lembaga keuangan untuk mencegah risiko usaha khususnya risiko eksternal khususnya tindak pidana pencucian uang. Namun dewasa ini dalam Peraturan daerah provinsi Bali No 3 Tahun 2017 tentang Lembaga Perkreditan Desa belum mengatur secara khusus tentang prinsip mengenal nasabah. penelitian ini menggunakan metode penelitian normatif yang secara khusus mengkaji peraturan perundang-undangan dan literatur yang berkaitan dengan urgensi pengaturan prinsip mengenal nasabah dalam LPD. Berdasarkan hasil penelitian daapat ditarik 2 (dua) kesimpulan. Pertama, pengaturan prinsip mengenal nasabah dalam LPD di Bali secara rasional dapat dilihat dari 3 (tiga) pilihan, yaitu pilihan nilai, pilihan motif, dan pilihan cara. Kedua, konstruksi pengaturan prinsip mengenal nasabah pada LPD sekurang-kurangnya terdiri dari: identifikasi dan verifikasi calon nasabah dan nasabah; pemilik manfaat; manajemen risiko; area berisiko tinggi dan pemantauan transaksi nasabah dan pengkinian data nasabah, penatausahaan dokumen, dan pelaporan. LPD materially carries out banking activities so that the risks faced by banking institutions will also be faced by the LPD, so that regulating and applying banking principles becomes a necessity. The principle of knowing customers is one of the important and strategic banking principles carried out by financial institutions to prevent business risks especially external risks, especially money laundering. But nowadays in the provincial regulation of Bali No. 3 of 2017 about Village Credit Institutions have not specifically regulated the principle of knowing customers. This study uses normative research methods that specifically examine legislation and literature relating to the urgency of setting the principle of knowing customers in the LPD. Based on the results of the research, you can draw 2 (two) conclusions. First, the rational arrangement of knowing customers in LPDs in Bali can be seen from 3 (three) choices, namely choice of values, choice of motives, and choice of methods. second, the construction of the principle of knowing customers in the LPD consists of at least: identification and verification of prospective customers and customers; benefit owner; risk management; high risk areas and monitoring customer transactions and updating customer data, administering documents, and reporting

Abstract

Tujuan penulisan adalah untuk mengetahui bentuk-bentuk perilaku monopoli dan persaingan usaha tidak sehat yang dilarang berdasarkan hukum Indonesia, serta pengaturan hukum Indonesia terhadap praktik persaingan usaha tidak sehat yang di lakukan oleh BUMN khususnya bidang transportasi. Padahal sebagai perusahaan milik negara sudah seharusnya memperhatikan keseimbangan kepentingan pelaku utama ekonomi dan kepentingan luas. Disisi lain terdapat pengecualian hukum bagi BUMN yaitu pelaksanaan praktik Monopoli yang diberikan kepada BUMN, hal ini dituangkan didalam peraturan Persaingan Usaha, sehingga aktualisasi monopoli yang diterima oleh badan usaha milik negara masih menimbulkan kebingungan hukum. Penulis menganalisis apakah dengan adanya pengecualian hukum bagi BUMN dapat membuat melanggar peraturan persaingan usaha dengan berlindung dibalik pasal tersebut. This study aims to find out that State-Owned Enterprises certainly play a very important role in the meaning of Pancasila economy as a people's economic activity. State-Owned Enterprises has many companies in the transportation sector, At the same time, there are also many state-owned transportation companies that practice monopolistic practices and unfair business competition. In fact, as a state-owned company, we should pay attention to the balance between the interests of economic actors and the public interest. On the other hand, there are legal exceptions for State-Owned Enterprises, namely the implementation of Monopoly practices given to State-Owned Enterprises, this is regulated in the Business Competition Law, so that the implementation of monopolies granted to state-owned enterprises still creates legal confusion. The author analyzes whether the existence of legal exceptions for State-Owned Enterprises can make them violate business competition regulations by taking cover behind the article.

Abstract

The aim of writing this journal is to provide new knowledge regarding the provisions of force majeure in the agreement if in the future there are circumtances beyond human control that have never happened which resulted in the parties involved in the agreement being unable to carry out theit obligations. The research method in this journal uses normative law, which uses two sources of legal material, namely, primary legal material, such as laws and regulations, and secondary legal materials, such as other related journals. The result of this journal is that the Covid-19 pandemic cannot simply be entered into a force majeure, because a force majeure is a situation beyond human control which causes one or both parties to be unable to carry out their obligations, if both parties can still carry out their obligations, the Covid-19 pandemic cannot be entered into a force majeure. However, if the government declares the spread of Covid-19 pandemi which is a non-natural disaster is a national disaster, then it has the potensial to be used as an excuse for force majeure. However, the government cannot determine a situation as a force majeure, the authorities lies with the judges through their considerations after assessing the contents of the agreement and the circumstances that occurred at that time based on the exisiting law and/or norms.

Abstract

Tujuan penulisan artikel ini adalah untuk mengetahui perkembangan pengaturan dari equity crowdfunding serta mengetahui dan memahami perkembangan dan tantangan equity crowdfunding dalam penyelenggaraan urun dana baik dari segi bisnis maupun hukum. Metode yang digunakan dalam penulisan artikel ini adalah metode penelitian hukum normative dengan pendekatan peraturan perundang-undangan dan pendekatan konsep. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum menggunakan Teknik kepustakaan dan kemudian data yang dikumpulkan dan diolah dianalisis secara deskriptif-evaluatif. Dari penelitian yang dilakukan didapatkan hasil sebagai berikut, pertama pengaturan equity crowdfunding mengalami beberapa perubahan dimulai dari POJK No. 37/POJK.04/2018 yang kemudian digantikan oleh POJK Nomor 57/POJK.04/2020. Kedua, equity crowdfunding mengalami perkembangan menjadi security crowdfunding. Kemudian di masa yang akan datang berpotensi berkembang menjadi crowdsourcing namun belum memiliki dasar hukum dalam penyelenggaraannya sampai saat ini. ABSTRACT The purpose of writing this article is to find out the regulatory development of equity crowdfunding and to know and understand the development and challenges of equity crowdfunding in the implementation of crowdfunding both from a business and legal perspective. The method used in writing this article is a normative legal research method with a statutory approach and a concept approach. The legal materials used in this research are primary and secondary legal materials. The technique of collecting legal materials uses library techniques and then the data collected and processed are analyzed descriptively-evaluatively. From the research conducted, the following results were obtained, first, the equity crowdfunding regulation underwent several changes starting from POJK No. 37 / POJK.04 / 2018 which was later replaced by POJK Number 57 / POJK.04 / 2020. Second, equity crowdfunding has developed into security crowdfunding. Then in the future it has the potential to develop into crowdsourcing but does not yet have a legal basis for its implementation to date.

Abstract

Tujuan studi ini adalah untuk mengkaji peran pemerintah melalui Dinas Pemberdayaan Masyarakat dan Desa dalam penguatan Badan Usaha Milik Desa sebagai badan hukum sejak diundangkannya Undang-Undang No 11 tahun 2020 tentang Cipta Kerja. Metode penelitian yang digunakan adalah metode hukum empiris dengan jenis pendekatan fakta dan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa dasar hukum penguatan status badan hukum Badan Usaha Milik Desa diatur dalam ketentuan Pasal 117 pada Undang-Undang Undang-Undang No 11 tahun 2020 tentang Cipta Kerja serta adanya peran pemerintah melalui Dinas Pemberdayaan Masyarakat dan Desa Kabupaten Badung dalam penguatan Badan Usaha Milik Desa sebagai badan hukum diwujudkan dalam 3 peran utama yakni Pembinaan, Fasilitasi dan Evaluasi. The purpose of this study is to examine the role of the government through the Community and Village Empowerment Service in strengthening Village-Owned Enterprises as legal entities since the promulgation of Law No. 11 of 2020 concerning Job Creation. The research method used is an empirical legal method with a factual approach and a statutory approach. The results of the study show that the legal basis for strengthening the legal status of Village-Owned Enterprises is regulated in the provisions of Article 117 of Law No. 11 of 2020 concerning Job Creation and the government's role through the Badung District Community and Village Empowerment Office in strengthening Owned Enterprises The village as a legal entity is realized in 3 main roles namely Guidance, Facilitation and Evaluation.

Abstract

Tujuan dilakukannya penulisan jurnal ilmiah ini antara lain untuk memahamii bentuk-bentuk pelanggaran yang terjadi terhadap kawasan sempadan pantai di Bali serta urgensi pengenaan sanksi administratif dan sanksi pidana terhadap pelanggaran yang terjadi pada kawasan sempadan pantai di Bali. Sempadan pantai ialah daratan di sepanjang tepi pantai, yang mempunyai lebar sepadan dengan bentuk maupun keadaan fisik wilayah pantai, berjarak minimal 100 (seratus) meter dari titik pasang paling tinggi ke arah daratan. Metode penelitian yang digunakan dalam studi ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif. Hasil dari studi ini mengungkapkan bahwa kawasan sempadan pantai adalah kawasan yang rentan akan adanya perubahan sehingga perlu dijaga dan melalui suatu kebijakan pengelolaan berkelanjutan yaitu dengan pengenaan sanksi administratif yang tegas. Pengenaan sanksi administratif ini ditujukan untuk menjaga zona yang berbatasan dengan air dan sebagai tindakan pencegahan untuk meminimalisir kerusakan lingkungan jangka pendek dan jangka panjang. Pelanggaran di kawasan sempadan pantai menyebabkan perubahan terhadap fungsi ruang. Dengan demikian, pengendalian pemanfaatan ruang yang sangat berperan dalam hal ini adalah pengenaan sanksi administrarif yang telah diatur dalam undang-undang. Pengenaan sanksi dalam hukum administrasi merupakan alat kekuasaan yang digunakan pemerintah sebagai reaksi atas ketidaktaatan dalam melaksanakan kewajiban terhadap hukum administrasi negara. ABSTRACT The purpose of writing this scientific journal, among others, is to understand the forms of violations that occur in the coastal border area in Bali and the urgency of imposing administrative sanctions and criminal sanctions on violations that occur in the coastal border area in Bali. The coastal border is the land along the coast, which has a width commensurate with the shape and physical condition of the coastal area, at a minimum distance of 100 (one hundred) meters from the highest tide point towards the mainland. The research method used in this study is normative legal research with a statutory and comparative approach. The results of this study reveal that the coastal border area is an area that is vulnerable to changes so that it needs to be maintained and through a sustainable management policy, namely the imposition of strict administrative sanctions. The imposition of administrative sanctions is intended to protect the zone bordering water and as a preventive measure to minimize short-term and long-term environmental damage. Violations in the coastal border area cause changes to the function of space. Thus, controlling the use of space that plays a very important role in this matter is the imposition of administrative sanctions that have been regulated by law. The imposition of sanctions in administrative law is a tool of power used by the government as a reaction to disobedience in carrying out obligations under state administrative law.

Abstract

Tujuan dari penulisan artikel ini adalah untuk mengetahui problematika apa saja yang muncul dalam pelaksanaan reforma agraria di indonesia dan juga untuk menemukan solusi yang dapat diterapkan oleh pemerintah dalam mengatasi problematika yang muncul dalam pelaksanaan reforma agraria ini. Penulisan artikel ini menggunakan metode penelitian yuridis normatif yang artinya penelitian dilakukan dengan cara melakukan studi kepustakaan. Pembahasan didasarkan pada berbagai literatur berupa; buku-buku, dokumen dan peraturan perundang-undangan serta referensi lainnya yang berkaitan dengan persoalan problematika pelaksanaan reforma agraria. Hasil studi ini menunjukkan bahwa problematika yang paling sering muncul disebabkan oleh kurang memadainya kualitas sumber daya manusia yang bekerja di pemerintahan, serta sistem administrasi yang kurang mumpuni yang hingga saat ini masih digunakan oleh pemerintah pusat maupun daerah. Selain daripada itu kurang siapnya petani penerima lahan dari segi pendidikan dan kemampuan juga merupakan salah satu permasalahan yang kerap terjadi dan menghambat berjalannya reforma agraria ini. Untuk menghadapi problematika tersebut maka hal yang dapat dilakukan oleh pemerintah tidak lain adalah meningkatkan dan meratakan pendidikan masyarakat indonesia agar dapat menghasilkan sumber daya manusia yang berkualitas, dan juga menciptakan sistem administrasi yang lebih mumpuni dan lebih update dengan cara menggandeng dan memanfaatkan perusahaan-perusahaan yang bergelut dibidang teknologi informasi di Indonesia. ABSTRACT The purpose of writing this article is to find out what problems arise in the implementation of agrarian reform in Indonesia and also to find solutions that can be applied by the government in overcoming the problems that arise in the implementation of this agrarian reform. The writing of this article uses a normative juridical research method, which means that the research is carried out by conducting a literature study. The discussion is based on various literatures in the form of; books, documents and laws and regulations as well as other references related to the problems of implementing agrarian reform. The results of this study indicate that the problems that most often arise are caused by the inadequate quality of human resources working in the government, as well as an inadequate administrative system which is still used by the central and local governments. Apart from that, the unpreparedness of land recipients in terms of education and ability is also one of the problems that often occurs and hinders the implementation of this agrarian reform. To deal with these problems, the things that the government can do are none other than improving and leveling the education of the Indonesian people so that they can produce quality human resources, and also create a more qualified and more updated administrative system by cooperating with and utilizing companies that are struggling. in the field of information technology in Indonesia.

Abstract

Tujuan dilakukan penelitian ini untuk mengetahui faktor-faktor penyebab terjadinya pelanggaran hukum (rangkap jabatan) dan untuk mengetahui proses penyelesaian perakara rangkap jabatan. Studi ini menggunakan metode penelitian empiris dengan menggunakan jenis pendekatan perundang-undangan (The Statute Approach) dan pendekatan fakta (The Fact Approach). Hasil studi menunjukkan bahwa faktor-faktor yang menyebabkan terjadinya pelanggaran yaitu ekonomi, moral, kepentingan dan kesempatan, dengan faktor ekonomi menjadi faktor utama seseorang melanggar hukum. Penyelesaian pelanggaran rangkap jabatan dapat dilakukan dengan dua mekanisme yaitu: 1. Pengunduran diri atau 2. Pemberhentian. Kata Kunci: BPD, Rangkap Jabatan, Penyelesaian Perkara Rangkap Jabatan ABSTRACT The purpose of this research is to determine the factors that cause legal violations (dual positions) and to determine the process of resolving cases of multiple positions.This study uses empirical research methods using a statutory approach (The Statute Approach) and a fact approach (The Fact Approach). The results of the study show that the factors that cause violations are economic, moral, interests and opportunities, with economic factors being the main factor in someone breaking the law. Abstract

Kecakapan ialah salah satu hal penting dalam hukum, khususnya hukum perdata. Hal ini menunjukkan kemampuan seseoramg dalam melakukan tindakan hukum tertentu ataupun perbuatan hukum tertentu. Dalam kaitannya dengan kecakapan hukum, maka dasar hukum yang digunakan masih Kitab Undang-Undang Hukum Perdata yang memberikan pengaturan perihal kecakapan hukum. Meskipun peraturan tersebut tidak secara jelas dan tegas mengatur terkait kecakapan hukum, namun dengan mengacu pada ketentuan terebut bisa ditarik kesimpulan yang berkaitan pada kecakapan seseorang. Disini, aspek penting berkaitan dengan kecakapan yag perlu dipahami dan diteliti adalah berhubungan dengan dasar hukum beserta klasifikasinya sesuai dengan hukum positif yang berlaku. ABSTRACT Skill is one of the most important things in law, especially civil law. This shows a person's ability to carry out certain legal actions or certain legal actions. In relation to legal skills, the legal basis used is still the Civil Code which provides regulations regarding legal skills. Although the regulation does not clearly and unequivocally regulate legal skills, by referring to these provisions, conclusions can be drawn relating to a person's skills. In this case, an important aspect related to skills that need to be understood and researched is related to the legal basis and its classification according to the applicable positive law.
