Abstract

Apakah Pegawai Negeri Sipil yang sudah menjalani hukuman administrasi berat dapat dijatuhi hukuman administrasi yang sama sebanyak dua kali? Bagaimana keabsahan keputusan Gubernur Kalimantan Tengah Nomor 188.44/436/2018 tentang Pemberhentian Pegawai Negeri Sipil karena melakukan tindak pidana kejahatan jabatan atau tindak pidana yang ada hubungannya dengan jabatan? Gubernur Provinsi Kalimantan Tengah sebagai pejabat atau pemimpin daerah provinsi kembali memberikan sanksi administrasi berat kedua kalinya kepada Pegawai Negeri Sipil dengan mengeluarkan surat keputusan pemberhentian tidak dengan hormat (PTDH), padahal sebelumnya Pegawai Negeri Sipil tersebut juga telah mendapatkan sanksi administrasi berat sebagai hukuman tambahan dari Bupati Kabupaten Lamandau sebagai pejabat atau pemimpin daerah kabupaten berupa penurunan pangkat setingkat lebih rendah selama tiga tahun sesuai Pasal 7 Ayat (4) huruf  (a) Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil. Untuk mengetahui dan memahami tentang hukuman administrasi terhadap Pegawai Negeri Sipil yang melakukan tindak pidana kejahatan jabatan atau tindak pidana kejahatan yang ada hubungannya dengan jabatan. Untuk keabsahan keputusan Gubernur dalam pemberhentian terhadap Pegawai Negeri Sipil yang sudah pernah dijatuhi hukuman administrasi berat sebelumya. Bahwa metode penelitian yang digunakan penelitian normative, pendekatan perundang-undangan dan asas untuk meneliti apakah keputusan tersebut tidak saling bertentangan dengan peraturan perundang-undangan dan asas yang berlaku, sedangkan pendekatan kasus untuk lebih mengetahui jalan keluar terhadap permasalahan tersebut sebagai upaya penyelesaian menurut hukum. Dengan mengunakan asas nebis in idem dan asas berlaku surut, serta landasan teori the rule of law, teori Negara hukum, teori keadilan hukum dan teori system hukum. Bahwa hasil penelitian didapatkan Pegawai Negeri sipil Yang Sudah Menjalani Hukuman Administrasi berat Tidak Dapat Dijatuhi Hukuman Administrasi Yang Sama Sebanyak Dua Kali. Melanggar Pasal 30 Ayat (3) Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Disiplin Pegawai Negeri Sipil, yang menyebutkan “PNS tidak dapat dijatuhi hukuman disiplin 2 (dua) kali atau lebih untuk satu pelanggaran disiplin”. Dan dikuatkan dengan dibatalkannya Keputusan Gubernur Kalimantan Tengah tersebut dengan Putusan Pengadilan Tinggi Tata Usaha Negara Jakarta Nomor 261/B/2019/PT.TUN.JKT tanggal 13 November 2019 Jo. Putusan Mahkamah Agung Nomor 157 K/TUN/2020 tanggal 05 Mei 2020.

Abstract

In Central Kalimantan a total of 73 regional regulations (perda) issued by all Local Governments were canceled by the Ministry of Home Affairs (Kemendagri). The study was conducted with an empirical legal research method with observation and interview steps. Based on the results of the study found several factors that influence the Regional Regulatory Formation Board in the implementation of the legislative function of the Central Kalimantan DPRD, namely the absence of working time standards for the Establishment of the Central Kalimantan Regional Legislative Council and the absence of work guidelines set internally to carry out the duties and functions of the Central Kalimantan Regional Legislative Council formation body.

Abstract

Sexual violence against persons with mental disorders (ODGJ) raises serious legal issues related to the fulfillment of victims' rights and access to justice, particularly due to the victims’ limited capacity to provide testimony and defend themselves in criminal proceedings. This study aims to analyze the forms of legal protection and the effectiveness of regulatory implementation in handling ODGJ as victims of sexual violence in Palangka Raya City. This research employs an empirical legal research method through field data collection and analysis of relevant legal frameworks. The findings indicate that although Law No. 12 of 2022 concerning Sexual Violence Crimes and Law No. 17 of 2023 concerning Health provide a normative basis for victim protection, their implementation remains limited in practice. In Palangka Raya, several specific obstacles were identified, including the absence of specialized psychological assessment mechanisms to support victim testimony, limited availability of mental health experts during the investigation process, and the lack of standardized procedures for adapting examination techniques to victims with mental disabilities. In addition, the absence of integrated service facilities and limited training for law enforcement officers regarding disability-sensitive approaches further complicate the handling of such cases. This study emphasizes that legal protection for ODGJ victims of sexual violence requires a more comprehensive approach through capacity building for law enforcement officials, adaptive evidentiary mechanisms, and stronger institutional coordination to ensure the effective fulfillment of victims’ rights.

Abstract

Marriage customs in public Dayak Ngaju in Kalimantan Middle is an important part of the social and cultural life system regulated by customary law Which inherited in a way hereditary. In process going to marriage Customary law has several important stages, including Pangumbang Auh (Pisek) and Mamanggul. Pangumbang Auh is the initial stage of the proposal, marked by the groom's giving of money or objects to the bride's family as a symbol of their seriousness towards marriage. Next, Mamanggul is a traditional deliberation process between the two families to discuss the matter. various agreement related implementation marriage like Determining the timing of marriage and fulfilling customary requirements. This study aims to analyze the process, social meaning, and function of customary law from Pangumbang Auh and Mamanggul in the Dayak Ngaju customary marriage system. The research method used is normative juridical with a qualitative approach through literature study. The results show that these two stages play an important role in building family agreements and maintaining the continuity of customary legal values in the Dayak Ngaju community.
