Abstract

Efficiency and effectiveness are two principle applied by moslem and non moslem businessmen. Certainly it will be apllied in many way, included to solve the problem; dispute relation. The most effective way to solve economic dispute is by mediation. Mediation is a form of alternative dispute resolution (ADR), a way of resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator, assists the parties to negotiate a settlement. Mediation as Islamic economic dispute resolution has a superiority, that is be able to solve economic dispute fast and has inexpensive cost. The other superiority of mediation is be able to pay attention and observe both interest party. Mediation as law effort and form of Islamic economic dispute resolution has effectiveness, justice and transparency. Thus judge and moslem businessmen select mediation as law effort to solve Islamic economic dispute.Efisiensi dan efektifitas merupakan dua prinsip yang diterapkan oleh para praktisi ekonomi baik syari’ah maupun konvensional dalam menjalankan bisnisnya. Apabila terjadi persengketaan pun mereka tentunya memilih cara yang efektif dan efisien. Salah satu cara yang paling efektif dalam penyelesaian sengketa ekonomi adalah mediasi. Penyelesaian sengketa ekonomi syari’ah melalui mediasi memiliki beberapa keunggulan, yaitu dapat menyelesaikan sengketa dengan cepat dan murah serta mempunyai tujuan untuk mengakomodir kepentingan dari kedua belah pihak. Hal itu dapat dilihat dari pemberian kesempatan oleh mediator kepada para pihak untuk berpartisipasi secara langsung dalam proses penyelesaian sengketa. Partisipasi para pihak sangat berpengaruh terhadap kesepakatan yang dihasilkan, suatu proses yang tidak didapatkan melalui jalur litigasi. Selain itu dari segi kekuatannya hasil keputusan mediasi bersifat tetap dan mengikat. Lembaga mediasi sebagai upaya hukum dalam penyelesaian sengketa ekonomi syari’ah mempunyai efektifitas, keadilan dan transparansi. Sehingga para hakim dan masyarakat pelaku ekonomi syari’ah memilih lembaga mediasi sebagai upaya hukum untuk menyelesaikan sengketa ekonomi syari’ah.Keywords: Mediation, Judge Of Religious Court, Islamic Economic Dispute.

Abstract

Western media coverage on Islam and especially on terror attacks by Muslims has been exaggerated and pejorative. This stereotyping has portrayed Islam as problems. First, Islam is seen as sluggish in responding modernity and the advance of science and knowledge so it always lacks behind the West. Second, Islam is associated with extremism and terrorism which are incompatible with the West. Therefore, the emergence of rational thinking and cosmopolitan approach to Islam promoted by Muslim reformists, such as Abdullah Saeed, are very urgent to encounter such stereotype and discourse on Islam in the West. This article examines Saeed’s method called “progressive Islam”. By taking one example of conversion (murtād), this article elucidates how the method of ijtihād progressive is applied in one of the most controversial topics in Islamic law. This study shows that the law on murtād, as it was introduced by classical Muslim jurists, is now adopted by Muslim countries. However, such adoption does not have a sound ground on the Qur’anic texts and the Sunnah. DOI: http://dx.doi.org/10.20414/ujis.v19i1.1251

Abstract

This research is based on the economic context that occurs in the people of Bangkalan City in the development of Branding with Islamic terms. This study aims to analyze the opinions of religious leaders in the city of Bangkalan regarding Islamic branding, which still has a question mark regarding its urgency and existence among the people of the city of Bangkalan, especially. The researcher uses qualitative methods, namely research methods that focus on collecting data through observations of around Bangkalan City regarding several local brands that use Islamic Branding and on the other hand also focuses on conducting interviews and documentation to collect data about the views of Bangkalan religious leaders regarding Islamic Branding and Islamic Branding. existence in Bangkalan city to several religious figures in Bangkalan city. From the results of the study, the researcher stated and concluded that the views of religious leaders in Bangkalan city were divided into three groups. There are those who are aware of and acknowledge the existence of Islamic Branding in Bangkalan city, secondly there are those who are aware of but acknowledge the existence of Islamic Branding in Bangkalan city, third are not aware of and do not acknowledge the existence of Islamic Branding in Bangkalan city.

Abstract

The difficulties in preparing accountable financial reports, planning business development strategies, and managing business operations effectively remain major challenges faced by the managers of the Village-Owned Enterprise (BUMDes) in Poter Village, Tanah Merah District, Bangkalan Regency. These limitations have hindered the optimal growth of several business units, with some experiencing stagnation and limited contribution to local economic development. The condition indicates that strengthening managerial and financial management capacities is essential to improve the performance and sustainability of BUMDes. This community service activity aims to enhance the capacity of BUMDes managers through a structured training program. The implementation methods include preliminary observation, training sessions, mentoring, and evaluation through interviews and documentation. The training materials focus on business management, basic accounting, and financial reporting preparation. This activity is also aligned with the Sustainable Development Goals initiated by the United Nations, particularly Goal 1 (No Poverty), Goal 8 (Decent Work and Economic Growth), and Goal 9 (Industry, Innovation, and Infrastructure). By strengthening managerial and financial capacities, this program contributes to improving income-generating activities, fostering local entrepreneurship, and supporting sustainable rural economic development. The results show an improvement in participants’ understanding and skills in business management, as well as increased awareness of the importance of proper administration and financial reporting. Participants also demonstrated positive responses to the program. Furthermore, the outcomes of this program indicate its contribution to achieving SDGs targets at the village level, especially in enhancing economic resilience and institutional capacity of community-based enterprises. Therefore, this training and mentoring activity is effective in strengthening the capacity of BUMDes managers and contributes to improving performance and sustainability of village enterprises. Similar programs should be conducted continuously to ensure optimal development of BUMDes and to enhance rural community welfare.
