Abstract

Abstract The theological debate between Jabbariyyah (pre-destination) and Qadariyyah (free will) was polarized during the Covid-19 pandemic. Some Muslims tend to be fatalists (pre-destination), and the others believe in free will on the face of this pandemic. Of course, this is not in line with the moderate principles that Islam brings. Because, in various texts of the Quran, Allah command to balance the welfare of duniawi and hereafter (ukhrawi) life. Among these texts is what Allah said in Surah Al-Qashash verse 77 regarding the command to seek the afterlife and not forgetting sustenance in the world. With the ma'na-cum-maghza approach, this paper answers the significance of the current meaning of the commandment. There are three important points to reveal. The first, al-ma'na al-ta rikhi (historical meaning) of the verse, including advice to Qarun to seek the afterlife's reward without ignorance of the world, good doing, and prohibition of destroying the earth. The second, al-maghza al-tarikhi (the significance of historical phenomena), namely the message to Quraish community to take the middle path by following the Prophet's preaching and still pay attention to the life of the world, and to help others when possible. The third, al-maghza al-mu'as}ir (dynamic significance), namely the principle of the balance of life in the world and the hereafter. Keywords: balancing life; ma'na cum-maghza; Al-Qashash verse 77. Abstrak Perdebatan teologis antar paham Jabbariyyah (pre-destination) dan Qadariyyah (free will) terpolarisasi kembali saat masa pandemi Covid-19. Sebagian umat Islam cenderung bersikap fatalis (pre-destination), dan sebagian lagi meyakini kehendak bebas (free will) dalam menghadapi pandemi. Tentu saja hal ini tak sejalan dengan prinsip moderat yang dibawa Islam. Karena, di berbagai teks Al-Quran, Allah mengajak untuk menyeimbangkan kesejahteraan kehidupan duniawi dan ukhrawi. Di antara teks tersebut ialah apa yang Allah firmankan dalam Surah Al-Qashash ayat 77 tentang perintah untuk mencari bagian akhirat dan tidak melupakan rezeki di dunia. Dengan Pendekatan ma’na cum-maghza, tulisan ini menjawab bagaimana signifikansi makna perintah tersebut saat ini. Ada tiga poin penting yang diungkap. Pertama, al-ma’na al-tarikhi (makna historis) ayat tersebut, yakni perintah terhadap Qarun untuk mencari ganjaran akhirat tanpa abai terhadap dunia, berbuat baik, dan larangan merusak bumi. Kedua, al-maghza al-tarikhiy (signifikansi fenomenal historis), yakni pesan terhadap masyarakat Quraish untuk mengambil jalan tengah dengan mengikuti dakwah Nabi dan tetap memerhatikan kehidupan dunia, dan menolong orang lain saat diberi kelapangan. Ketiga, al-maghza al-mu’as}ir (signifikansi dinamis), yakni prinsip keseimbangan kehidupan dunia dan akhirat. Abstract

The Qur'an has proven to have inspired and produced many tafseer books with various approaches, methods and interpretive tendencies. The book of Shafwah Al-Tafasir is a contemporary tafseer hwo has written by Ali Al-Shabuni which has a unique and distinctive methodology. Because of this, this article aims to examine the exegetical methodology applied by Ali Al-Shabuni in interpreting surah Al-Rahman and to find out the advantages and weaknesses of its methodology. The results of this study indicate that the uniqueness of the methodology applied by Al-Shabuni in interpreting surah Al-Rahman is combine the riwayah and dirayah approaches and the tahlili and ijmali methods. In addition, it also use the tendency of al-adabi al-ijtima’i and the systematic, and contemporary interpretive techniques with additional footnotes to make it easier for readers to refer to the original source. As well as, the Ali Al-Shabuni’s methodology in the Book’s Shafwah Al-Tafasir has the advantages and the weaknesses. Abstract

Abstract: Until now, Indonesia still adheres to the death penalty, the most severe punishment because it involves a very precious life. Because of the value of life, then the death penalty becomes a polemic that raises pros and cons, both in Indonesia itself, internationally and even within the Islamic religion. This research is qualitative in nature which focuses on literature review in the form of books, scientific journals and laws. It can be concluded that the death penalty is not at all contrary to human rights, both from the Western and Eastern versions, because the death penalty is used to maintain the existence of human rights itself. Keywords: Death Penalty, Human Rights, Positive Law, Islamic Criminal Law   Abstrak: Sampai sekarang, Indonesia masih menganut hukuman mati, hukuman yang paling berat karena menyangkut kehidupan yang sangat berharga. Oleh karena berharganya kehidupan ini, maka kemudian hukuman mati menjadi sebuah polemik yang menimbulkan pro dan kontra, baik di Indonesia sendiri, internasional bahkan dalam agama Islam. Penelitian ini bersifat kualitatif yang berfokus pada kajian pustaka berupa buku, jurnal-jurnal ilmiah dan undang-undang. Dapat disimpulkan bahwa hukuman mati sama sekali tidak bertentangan dengan Hak Asasi Manusia, baik dari versi Barat maupun Timur, disebabkan hukuman mati digunakan untuk mempertahankan eksistensi dari HAM itu sendiri. Abstract

This study examines the relationship between the Qur’anic concept of ḥirābah and violent theft under Article 479 of Indonesia’s Law Number 1 of 2023 concerning the Criminal Code. While previous studies have discussed ḥirābah from doctrinal, comparative, and contextual perspectives, they have not sufficiently clarified the limits of equivalence between ḥirābah and violent theft within Indonesian positive law. This article addresses that gap by employing a qualitative normative method and a functional-comparative framework. The analysis focuses on legal foundations, protected interests, elements of offense, public-security implications, structure of sanctions, and procedural safeguards. The findings show that ḥirābah and Article 479 KUHP overlap in their concern with violence, intimidation, protection of property, and disruption of public security. However, they differ significantly in legal ontology, scope, penal logic, and normative justification. Ḥirābah is framed as a grave offense against public order and social security, whereas Article 479 KUHP remains doctrinally anchored in the offense of theft aggravated by violence. Within maqāṣid al-sharī‘ah, the punishment for ḥirābah is understood as a means of protecting life, property, and public security. Drawing on contemporary deterrence theory, the study argues that the effectiveness of punishment depends not merely on severity but also on certainty, consistency, proportionality, and procedural legitimacy. The article also addresses contemporary human rights concerns surrounding ḥudūd punishments, emphasizing due process, evidentiary safeguards, and protection against arbitrary enforcement. The study contributes an integrative model for reading Islamic criminal law and modern criminal law as distinct yet dialogical legal traditions.

Abstract

Tindak pidana suap sebagai bagian dari korupsi masih menjadi permasalahan serius di Indonesia, dalam perspektif Al-Qur’an, praktik suap dikenal sebagai risywah yang dilarang secara tegas karena bertentangan pada prinsip keadilan, amanah, dan kejujuran. Penelitian ini bertujuan untuk menganalisis konsep risywah dalam Al-Qur’an dan hukum positif Indonesia melalui pendekatan analisis normatif. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan tafsir tematik (maudhu’i) dan yuridis normatif melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa risywah dalam Al-Qur’an memiliki cakupan yang lebih luas dibandingkan dengan konsep suap dalam hukum positif, karena tidak hanya menitikberatkan pada perbuatan, tetapi juga mencakup dimensi niat dan moralitas pelaku. Sebaliknya, hukum positif lebih berorientasi pada pembuktian formal terhadap unsur-unsur tindak pidana, sehingga memiliki keterbatasan dalam menjangkau praktik suap yang bersifat terselubung. Oleh karena itu, penelitian ini menegaskan bahwa integrasi antara nilai-nilai Qur’ani dan hukum positif merupakan pendekatan yang relevan dan komprehensif dalam pemberantasan tindak pidana suap, baik melalui mekanisme preventif maupun represif, guna memperkuat kesadaran hukum dan moral dalam masyarakat.
