Abstract

Di dunia Arab-Islam, misalnya sejak abad ke-19 kaum muslimin telah mengalami berbagai persoalan serius sebagai akibat dari hegemoni politik, ekonomi, dan budaya yang ditancapkan bangsa Eropa. Hal itu memaksa kaum muslimin untuk bersandar pada agamadi dalam mengembangkan suatu ideologi perjuangan. Pengalaman sejarah di masa lalu masih saja meninggalkan trauma yang mendalam terhadap umat Islam di berbagaikawasan, bahkan setelah mereka mencapai kemerdekaan. Sebagai akibatnya, merekasering memahami dan menggunakan agama (Islam) sebagai tujuan politik dan ideologi,terutama dalam menolak dan mengembangkan sikap eksklusif mereka terhadap dunia Barat. Selain itu, umat muslim juga masih banyak yang menggunakan Islam sekedar sebagai kekuatan mitologis, sosial, dan historis untuk mencapai tujuan politik tertentu. Jika demikian, dapat dikatakan masih ada umat Islam yang memiliki pandangan bahwa tidaklah penting untuk memikirkan dan menjadikan Islam sebagai agama yang mampu menghadapi tantangan dari masyarakat muslim sendiri.

Abstract

The theoretical study of the contradictions that exist in the hadiths of the Prophet s.a.w. has begun since the 2nd century Hijri. The existence of mukhtalif (contradictory) hadiths regarding a particular problem, practically can cause confusion in taking certainty of the teachings (legal provisions) that regulate the problem, which of them must be followed and practiced. In order not to be trapped in understanding hadiths that appear to be contradictory, it is necessary to discuss a study of hadith, namely the Mukhtalif al-Hadīth and its resolution. Mukhtalif al-Hadīth is a science that seeks to bring together (talfīq al-hadīth) several hadiths that contradict their meaning. Included in the definition of mukhtalif hadith are hadiths that are difficult to understand because of the existence of difficult-to-understand words. This article attempts to explore matters relating to the Mukhtalif al-Hadīth as well as its approach and method of solution so that readers can draw conclusions not to rush to reject hadiths that are considered contradictory before actually conducting in-depth verification.

Abstract

Various opinions or atheist ideals are displayed, which assume that the world already exists by itself. As the world is a tirelessly moving machine that has no beginning and no end. That is what has given an assumption that the universe does not have a creator or maintainer so that the term God does not apply in his thoughts and beliefs. This research is library research (Library Research), so that the type of qualitative research. The data source was obtained from Ibn Rusyd’s primary data source, Al-Kasyf’ Manāhij al-Adillat fi ʻAqaid al Millat Tahafut at Tahafut and fash al Maqal, the data collection methods used in this study were the deductive, comparative and hermeneutic methods. This research concludes, Ibnu Rusyd proved the existence of God by proposing no propositions, namely the Dalil al Inayah (providence of God), Dalil al-Ikhtira (the proposition of creation), and Dalil al Harakah (the proposition of motion). We witness that everything that has no sense, like for example, natural body, towards the end. The analysis obtained in proving the existence of God by Ibnu Rusyd is acknowledging the existence of God. Their intellect and revelation become the source of knowledge and tools to achieve truth, especially in proving the existence of God. Then his philosophical thought patterns indirectly influenced more by the philosophy of Aristotle. He succeeded in reconciling the world of philosophy with the world of Theology and through his cosmological arguments, has proven the existence of God.

Abstract

New issues and phenomena that require legal certainty also develop along with the development of the times and the social context. The Qur'an and Sunnah, which only contain legal issues implicitly, require mujtahids to dig up the law with several methods, one of which is maslahah mursalah or istislah. This research tries to explore matters related to istislahi reasoning, starting from the concept, and limitations, to its implementation in the application of Islamic family law in Indonesia. This research uses a descriptive method with a critical review. The research results show that maslahah mursalah is basically based on preserving the purpose of syariah by taking benefits and rejecting harm (mafsadah). The limitations of this maslahah are: it is not merely conjectural so that it must produce benefits and reject harm (mafsadah), it is general, and it does not conflict with the principal rules of syara'. Thus, the application of the istislahi method in the formation of law is very necessary to face new problems and phenomena that require legal certainty.
