Abstract

Tulisan ini mengangkat isu penegakan HAM dalam perspektif Maqas}id al-Shari’ah. Jika dianalisis secara filosofis-paradigmatis, HAM tidak bersifat oposisional dengan Shari’ah, khususnya menyangkut prinsip-prinsip dasar yang diformulasikan dalam Maqas}id al-Shari’ah. Maqas}id al-Shari’ah bisa menjadi basis legitimasi filosofis-paradigmatis dalam konteks penegakan HAM di dunia muslim. Penulis menyimpulkan bahwa problem muncul ketika menyangkut kasus-kasus spesifik, seperti hukuman mati, isu gender dan perlakuan terhadap non muslim. Kasus tersebut menunjukkan, bahwa perdebatan HAM dan Shari’ah lebih bernuansa politis, sosial dan ekonomis, seperti merosotnya wibawa PBB sebagai otoritas yang netral, bias kepentingan negara-negara maju, penguasaan sumber daya alam, politik korporasi, dan sebagainya. Kata Kunci; HAM, Shari’ah dan Maqas}id al-Shari’ah

Abstract

For some time, Islam in Southeast Asia, especially in Indonesia, is considered a periphery Islam (peripheralism religion) due to the syncretism practice and accommodationists against local beliefs. Indonesian Islam is only a little tradition (small tradition) of great tradition Islam who was in the Middle East region. Great tradition is Islamic tradition that grows and develops in the center of culture, namely in the Middle East or more specifically in Mecca and Medina, while little tradition is Islamic tradition that developed outside the Middle East region, including Indonesia, and those are considered to deviate from the pure Islamic. The thesis thrive on the paradigm of modernism that spawned Islamologist like K.P. Landon, Winstedt, Van Leur and also Clifford Geertz with his Trichotomy approach which is famous for the Java community, the belief or confidence is also shared by some Muslim scholars. This paper shows some bias in the paradigm of Modernism and Postmodernism as elaborate approaches in Islamic studies. Postmodernism did de-centering to dismantle the discourse about the center and the periphery, little tradition and great tradition. This is done by presenting Islam ethnographic Wetu telu in West Lombok as an example and the object of analysis.  Keywords: decentering, litle tradition, great traditon, Islam Wetu Telu

Abstract

In Islamic study especially in Islamic law study, study on hadith has been conducted. However, it is often that the resulted works tend to one of two tendencies namely absolutism and skeptics. The absolutism paradigm is developed in traditional Islamic study; meanwhile, skeptics paradigm is grown among orientalist and Muslim scholars oriented to West. This article discusses the ideas of Fazlur Rahman, one of contemporary Muslim scholars having popular works in Indonesia since the last year of 90. Rahman tried to formulate the basis of history study and hadith methodology that use both traditional Islamic knowledge and some important findings of orientalists. It is really useful thought, enriches hadith study, and also Islamic study in general. Keywords; Sunnah, lively sunnah, absolutism, sceptism

Abstract

One important issue in state politics is how to put political Islam in the context of a multicultural Indonesian. This problem has become a fundamental problem since the republic was founded, and for some people remain a stumbling block in the nation project building up to now. With a Historical-Sociological approach, this paper rejects a number of arguments counter-Islamism. When Syarikat Islam was founded in 1912, the idea of ​​nationality extends beyond the boundaries of ethnicity and regionalism. SI (Syarekat Islam) is the first political party so that it becomes an exercise not only for trips of Political Islam, but for the development of national politics. Political Islam suffered great pressure on the era Orde Baru, but after the Orde Baru Era, political Islam re-emerged in a new articulation. A phenomenon mentioned by Asef Bayat as Post-Islamism, that is the party (group) Muslims behave realistically and pragmatically willing to follow the democratic process and ignore the purely ideological schemes. Islamic parties, such as PKB, PPP, PKS, the United Nations, and others that carries almost no issues like Islamic state, the Jakarta Charter, Islamic ideology, the application of sharia, etc., the rest were more on the more secular and pragmatic. Climate democratization runs while opening the possibility for erosion of the tendency of radicalism and extra-constitutional movement of political Islam.
