Abstract

Artikel ini menguraikan tentang perkembangan hukum keluarga Islam di Ghanameliputi persoalan aturan pernikahan, batasan umur, pencatatan perkawinan, leefe, aturan perceraian, poligami, kekerasan dalam rumah tangga, dan warisan yaitu dalam lingkup aturan undang-undang, aturan adat dan aturan Mohamadian ordinance. Hukum keluarga telah diatur dalam syari’at Islam. Namun implementasinya dalam kehidupan masih membutuhkan pengembangan selaras dengan perubahan zaman, tempat, kultur dan kondisi. Adapun rumusan masalahnya adalah: Bagaimana pemberlakuan hukum keluarga di Ghana? Apa tantangan dalam mewujudkan hukum keluarga di Ghana?.Hasil penelitian artikel ini ialah bahwa keberadaan hukum keluarga di negara Ghana dipengaruhi oleh adat dan kebiasaan masyarakat setempat dan ini menjadi tantangan tersendiri bagi kaum laki-laki untuk melangsungkan pernikahan. Sedangkan keberadaanhukum keluarga mengacu pada hukum adat, aturan undang-undang dan aturanMohammadian ordinance.This article describes the development of Islamic family law in Ghana which covers issues of marriage rules, age restrictions, registration of marriages, leefes, divorce rules, polygamy, domestic violence, and inheritance which are within the scope of the rule of law, customary rules and Mohamadian ordinance rules. Family law is regulated in Islamic law. But its implementation in life still requires development in harmony with changing times, places, and conditions. The problem of this article is: How is the enforcement of Islamic family law in Ghana? What are the challenges in realizing family law in Ghana? The results of this article are that the existence of family law in the country of Ghana is influenced by the customs and habits of the local community and this is a challenge for men to get married. Whereas the existence of family law refers to customary law, the rule of law and the rules of the Mohammadian ordinance.

Abstract

The phenomenon of the emergence of PMA No. 38 Year 2017, makes a big challenge for the academic community of the Faculty of Shari'ah UIN Salatiga in order to realize the quality of alumni who not only master the science of Islamic Law, but also master general law. This study examines the impact of the implementation of PMA No. 38/2017 on the curriculum and teaching methods at the Faculty of Shari'ah UIN Salatiga, and how this harmonization affects the social and academic dynamics within the faculty. Using a sociological approach, this study assesses how the curriculum changes affect the relationship between lecturers, students and educational institutions, and the implications for the quality and relevance of legal education in Indonesia. The findings show that despite significant efforts to harmonize the two disciplines, fundamental differences in methodologies and perspectives remain a major obstacle. The research also reveals the social impact of this integration on students, lecturers, and the academic community as a whole, and offers recommendations to improve the effectiveness and acceptability of scholarly harmonization in the future. The efforts made by the Faculty of Shari'ah in harmonizing science are to conduct a curriculum review by involving alumni and stakeholders. The impact of the change in degree after the issuance of PMA No. 38 of 2017 is the acceptance of alumni of the Islamic Family Law Study Program at the Faculty of Sharia UIN Salatiga with the initials FS in the M.Kn Master of Notarial Program at Sebelas Maret University Surakarta, this is proof that sharia graduates are eligible to become notary. This is because a number of degrees in the field of sharia studies related to law (such as Islamic Family Law (Ahwal Syakhshiyya), Sharia Economic Law and Constitutional Law (Siyasah Shar'iyyah) have now been uniformed with a law degree. This is as illustrated in the attachment of PMA 33/2016 and its amendments.

Abstract

Tulisan ini mengkaji beberapa peraturan yang tercermin dalam kebijakan negara dan upaya masyarakat Muslim untuk mempertahankan nilai-nilai agama mereka dalam konteks kehidupan keluarga. Meskipun Thailand mayoritas penduduknya beragama Buddha, masyarakat Muslim, khususnya di wilayah selatan, memiliki tradisi hukum keluarga yang berlandaskan pada ajaran Islam. Negara Thailand memberikan ruang terbatas bagi penerapan hukum Islam dalam urusan keluarga melalui pengadilan agama (Shari'ah Court), namun tetap mempertahankan kontrol terhadap sistem peradilan yang lebih luas berbasis hukum sipil. Penelitian ini menggunakan pendekatan kualitatif dengan menerapkan analisis studi kasus, analisis konten, observasi partisipatif, dan analisis silang. Hasil penelitian ini menunjukkan bahwasanya politik hukum keluarga di Thailand, Pertama, terdapat dualisme aturan yakni aturan negara dan agama yang berpengaruh pada hak sipil dan pelayanan publik umat muslim. Kedua, budaya penduduk mayoritas tetap mempengaruhi sistem tradisi perkawinan umat muslim. Ketiga, Implikasi dualisme aturan ini berdampak pada banyak ketentuan dalam hukum keluarga, misalnya dalam masalah usia perkawinan, tata cara dan prosedur perkawinan, pertunangan, pencatatan perkawinan, syarat perkawinan, wali, saksi nikah, kursus pra-perkawinan, perkawinan beda agama, perkawinan sejenis. Bahkan dalam aturan mengenai perkawinan sejenis aturan negara belum bisa mengakui dan belum mengkategorikannya sebagai perbuatan yang menyimpang atau bahkan kriminal. (This paper examines some of the regulations reflected in state policies and the efforts of muslim communities to maintain their religious values in the context of family life. Although Thailand is predominantly Buddhist, the muslim community, particularly in the south has a tradition of family based on Islamic teachings. The Thailand state provides limited scope for the application of Islamic law in family matters through religious courts (Shari’ah Courts),but still maintains control over the broader civil law-based justice system. This study uses a qualitative approach by applying case study analysis, content analysis, participant observation, and cross analysis. The results of this study indicate that family law politics in Thailand, First, there is a dualism of rules, namely state and religious rules that affect civil rights and public services for muslims. Second, the culture of the majority population still influences the muslim marriage tradition system. Third, the implications of this dualism of rules have an aimpact on many provisons in family law, for example in marriage age, marriage procedures, engagement, marriage registration, marriage requirements, guardians, marriage witnesses, pre-marriage courses, interfaith marriages, Even in the rules regarding same-sex marriages, state regulations have not been able to recognize and have not categorized it as a deviant or even criminal act).
