Abstract

Tarjîh  is a method tool of istinbâth in Islamic law. The method is formulated by ulama’ ushul to find a bright spot to set Islamic law among the opposite theorems. The existence of the method is very important in choosing strong/pure al-Qur’an texts and Hadits from some of the other Hadits related to the law problems. Therefore, the ulama’ ushul fiqh al-Hanafiyyah, al-Mâlikiyyah, al-Syâfi’iyyah, al-Hanâbilah dan al-Zhâhiriyyah construct steps to take to solve the dead end in ijtihad when they face some contradictory theorems. Al-Hanafiyyah takes four ways to deal with two or more contradictory al-Qur’an texts and Hadits. First, al-naskh (to clear, to cancel), second, al-tarjîh (to strengthen, to favor), third, al-jam’ wa al-tawfiq (to combine, to compromise) and the last is tasâquth al-dalilayn (to break and move to another theorems). While, methods used to deal with the contradictory theorems by al-Mâlikiyyah, al-Syâfî’iyyah, al-Hanâbilah dan al-Zhâhiriyyah is first, al-jam’ wa al-tawfiq bayn al muta’aridlayn bi wajh maqbul (collect and compromise the contradictory theorems from one side), second, al-tarjîh, the third, al-naskh and the last is tasâquth al-dalilayn. Tarjîh can be done by considering some sides, those are, a. Sanad side (The chain of Hadits reader), b. Matan side (Hadits text), c. Law contained in the law side (text or Hadits) and d. translation from other theorems.

Abstract

al-Qur’an adalah kitab sastra paling indah sepanjang masa. Sejak diturunkanhingga saat ini tidak ada seorang pun yang mampu membuat karya seindahtata bahasa sastra al-Qur’an. Kata demi kata teruntai indah mempesona.Kalimat demi kalimat tersusun anggun bagaikan intan permata. Ayat demiayat tersambung indah bagaikan butir-butir tasbih yang terbuat dari mutiara. Tata bahasanya menakjubkan sesuai dengan obyek bahasan, sehinggamenyentuh dan menggelorakan relung-relung hati bagi pembaca dan pendengarnya. Sungguh, al-Qur’an begitu indah bernilai sastra tinggi yangtiada bandingannya. Keteraturan, kesesuaian dan keanggunan antara satu ayat dengan ayat lainnya membuktikan ia bukanlah gubahan sastraMuhammad saw, melainkan wahyu ilahi yang diturunkan pada baginda Nabi untuk diinformasikan pada umat manusia sebagai petunjuk dan pedomanhidup di dunia. Kitab suci ini memang bukanlah kitab induk semua ilmu pengetahuan, tetapi benih-benih ide dasar semua ilmu pengetahuan terangkumdi dalamnya. Karenanya, setiapkali para ilmuwan ketika menghadapkan idedasar yang terdapat dalam al-qur’an mesti sesuai dengan hasil teori dan konsepyang mereka temukan. Statemen ini menyiratkan pada penulis untuk berusahamengetahui dan memahami konsep ulul albab yang termaktub di dalamnya.Tulisan ini bersifat tafsir tematik, dimana penulis berupaya mengumpulkan ayat-ayat yang setema, yaitu ayat-ayat ulul albab, kemudian melacak padakitab-kitab tafsir klasik dan kontemporer. Telaah tafsir tematik ini dilakukanuntuk mengetahui konsep ulul albâb secara utuh dalam pandangan al-Qur’an.

Abstract

Tulisan ini menelaah konsep metodologi istinbath fiqh minoritas yang diformulasikan oleh yûsuf al-Qardhâwi. Sebagai pemikir islam kontemporer, ia merekontruksi pola istinbath hukum islam (fiqh) untuk direlevansikan dan dikontekstualkan dengan tuntutan situasi dan kondisi kekinian yang melingkupinya. Konsep dasar maqâshid al-syari’ah ulama’ klasik dan yang telah dikembangkan ulama’ kontemporer sebagai pendekatan studi ini. Menurutnya, keberadaan minoritas muslim sangat membutuhkan fiqh khas yang bisa mencover kebutuhan mereka, baik yang bersifat dharûriyât (primer), hâjiyât (sekunder) dan tahsiniyyât (tersier). Karena itu, yûsuf al-Qardhâwi menetapkan Sembilan prinsip metodologi istinbath fiqh minoritas dengan tetap berpijak pada dasar-dasar syari’at islam. Fiqh minoritas adalah fiqh yang berbasis pada terwujudnya kemashlahatan yang menjadi tujuan utama maqâshid al-syari’ah dengan metode yang fleksibel dan elastis. Sehingga, produk hukum islam yang dilahirkan dari metode ini memuat kemashlahatan dan mendatangkan kemudahan untuk diimplementasikan masyarakat minoritas muslim dalam menjalaninya.

Abstract

The essence of human rights is to protect and ensure the glory and dignity of people. So it becomes important human rights principles stipulated in the legislation in order to guarantee the state of human rights can be implemented optimally. However, there are some parties who deliberately rammed by the Islamic Human Rights as a product of the Liberals are opposed to the Sharia. In fact, both Islam and human rights, aimed at ensuring the glory and dignity of man as the principles “maqhasidu al-syari’ah” are the main objectives the implementation of Islamic law. This paper aims to prove that human rights are not contrary to Islam because it has been expressly stipulated that one-on-one purpose in religion is upholding human dignity. This paper uses legal research methods that reveal the fact that Islam protects personal rights of his people so that the necessary regulatory and enforcement of human rights in the Indonesia. Tulisan ini terfokus mengkaji pemikiran Ibnu âsyûr tentang maqâṣid al-syarî’ah. Sebagai pemikir islam kontemporer ibnu âsyûr berupaya merumuskan maqâṣid al-syarî’ah menjadi disiplin ilmu yang mandiri dan pertimbangan utama dalam pegistinbathan hukum islam.Konsep independensi maqâṣid al-syarî’ah sebelumnya memang sudah digagas oleh al-syâthibî, namun Ibnu ‘âsyûr memperkokoh dan mempertegas kembali urgensi maqâṣid al-syarî’ah sebagai suatu disiplin ilmu.Menurutnya, ada empat unsur yang paling mendasar dalam pondasi bangunan maqâṣid al-syarî’ah, yaitu al-fithrah, al-musâwah, al-samâhah dan al-hurriyah.Keempat unsur ini mesti mendapat perhatian dan pertimbangan dalam proses pergumulan teks dan konteks realitas kekinian untuk melahirkan diktum-diktum hukum yang berkemashlahatan. Bagi ibnu ‘âsyûr, secara umum berdasarkan pengkajian atas dalil-dalil al-qur’an dan kasus-kasus parsial menunjukkanbahwa tujuan pensyari’atan hukum islam adalah memelihara sistem/tatanan kehidupan umat manusia dan kelestarian kemashlahatan itu dengan cara menjaga kemashlahatan manusia itu sendiri yang meliputi mashlahah akal, perbuatan dan alam dimana ia hidup. Dengan demikian maka bisa dikatakan kaidah umum dalam syari’at islam adalah untuk mewujudkanmashlahah dan menolak mafsadah.

Abstract

Imam ash-Syafi’i is the founder of ash-Syafi’i school (Shafi'iyah) as well as the first jewel layer of the science of ushul fiqh, as Aristotle laid the foundation of logic. Because he had contributed in composing a ushul fiqh logically, critically and systematically in his monumental work, ar-Risalah. This article focuses on reviewing the construction of ijtihad imam asy-Syafi’i with a concept analysis approach. According to him, the arguments and sources of Islamic law are based on; a) al-qur’an, as-sunnah, ijma`, and qiyas. While in al-Umm, he included qawl shahabah as one of the basis of Islamic law. The construction of ijtihad which he initiated has its own characteristics by combining manhaj ijtihad patterns ahlu al-ra'yi and ahlu al-hadith. The emergence of Imam al-Shafi’i ended a fierce polemic from followers of both faction. However, the legal products he designed do not contain absolute truth, because the results of ijtihad can be true and can also be wrong. He stated my opinion was correct but it could be wrong and the opinions of others were wrong but it could be true.

Abstract

The purpose of this study is to analyze the role of cooperatives in promoting the economic independence of Islamic boarding schools through the concept of edupreneurship. This study aims to explore how cooperatives can serve as a means to enhance the financial viability of Islamic boarding schools, as well as a platform for students to develop entrepreneurial skills. The research method employed is a qualitative approach, utilizing case studies of several Islamic boarding schools with active cooperatives. Data collection was conducted through interviews, observations, and document reviews. The results of the survey indicate that Islamic boarding school cooperatives play a crucial role in supporting economic independence by providing the financial services and resources necessary for Islamic boarding schools. Additionally, cooperatives offer students opportunities to learn about business management, financial planning, and entrepreneurship. The implications of this study suggest that strengthening Islamic boarding school cooperatives, combined with the concept of edupreneurship, can create a sustainable economic empowerment model and enhance the quality of education in Islamic boarding schools by developing practical skills relevant to market needs.
