Abstract

Status anak di luar perkawinan tidak hanya berimplikasi yuridis terhadap hubungan hukum anak dengan ibunya tetapi berkaitan juga terhadap masalah perwalian dan waris mewaris. Adapun implikasi yang ditimbulkan dari kedudukan anak di luar perkawinan khususnya mengenai nasab.Jenis penelitian yang digunakan yaitu Jenis Penelitian Normatifif yaitu merupakan suatu bentuk penelitian yang pada dasarnya mengambil sumber-sumber data dari bahan kepustakaan, system pengumpulan data disusun berdasarkan pokok permasalahan. Untuk mendapatkan Landasan Teoritis berupa pendapat -pendapat, atau tulisan-tulisan para ahli atau pihak lain yang berwenang, juga untuk memperoleh informasi baik dalam bentuk-bentuk ketentuan formal maupun data melalui naskah resmi yang ada.Berdasarkan uraian yang telah dikemukakan, maka dapat ditarik kesimpulan sebagai berikut: Status  Anak di Luar perkawinan di Wilayah Hukum Pengadilan Agama Samarinda mengenai nasabnya berdasarkan dari perkara yang dijumpai adalah bernasah kepada ibunya telah sesuai dengan Kompilasi Hukum Islam Bab XIV Pasal 100. Kompilasi Hukum Islam memiliki kecondongan terhadap pemikiran Imam Syafi’i. Penelusuran terhadap KHI Pasal 100 ternyata mutlak untuk di jadikan sebagai Undang – Undang dan Dasar Hukum bagi anak di Luar perkawinan

Abstract

The aim of this research is to know the corruption in Balikpapan City onthe building of the Rumah Potong Unggas (Chicken Cutting Place). Theresearch method is library one. The data and analysis are taken from thelocal daily news paper. The location of the research is in Balikpapanduring 6 (six) months in 2018/2019. The results of it are (1) Thecorruption strongly happened on the building of RPU Rumah PotongUnggas (Chicken Cutting Place) in Balikpapan; (2) The corruption actionis held by many people; (3) The people involved are from executive andlegislative as well as non-state officers or some member of societyincluding the corporations; (4) The corruption deed is concerning “markup”of the budget. The suggestions are : (1) This action crime has to besolved stricktly; (2) The money corrupted has to be repayed; (3) The lawenforcement has to be executed.

Abstract

The problem in this study is the position of children born from marriageunder the hands and how the rights of children to inheritance frommarriage under the hands based on Law Number 1 of 1974 concerningMarriage. Underhand marriage is still happening in Indonesian society.Submarine marriage is a marriage that does not register the marriage tothe authorized institution, namely the Office of Religious Affairs forMuslims and the Civil Registry for non-Muslims. In Article 2 paragraph(2) of Law Num ber 1 of 1974 it is stated that a new marriage is valid if itis carried out according to the laws of each religion and its beliefs.However, the validity of marriage in the eyes of religion and public trustneeds to be ratified by the state in order to have legal force.The consequences of marriage under the hands are very bad forthe wife and for children born both legally, socially and psychologically.Other problems that can be caused from marriage under the hands are therights and obligations of husband and wife who are not guaranteed in fullfrom the State. The provisions in Article 42 paragraph (1) of Law Number1 Year 1974 concerning Marriage state that a legitimate child is a childborn from or as a result of a legal marriage. So it can be concluded thatchildren born from underage marriages are illegitimate children or out ofwedlock children. From the results of the research discussion it is knownthat Based on the Decision of the Constitutional Court Number 46 / PUUVIII/ 2010 Testing of Law Number 1 of 1974 concerning Marriage to theState Constitution of the Republic of Indonesia Year 194. It is said thatchildren born outside marriage have a civil relationship with his motherand his mother's family and with his man as his father that can be provenbased on science and technology and / or other evidence so according tothe law he has a blood relationship, including a civil relationship with hisfather's family

Abstract

This study alims to alnswer the ecologicall impalcts due to the expalnsion of oil pallm plalntaltions alnd how the distribution of benefits alnd risks from the existence of oil pallm plalntaltions from aln environmentall justice perspective. Als the malinstaly commodity of the Indonesialn stalte, oil pallm certalinly brings malny benefits, especiallly for people who alre involved in oil pallm plalntaltion alctivities. The high demalnd for Crude Pallm Oil exports hals calused the expalnsion of plalntaltion lalnd to increalse, so thalt environmentall dalmalge continues to occur. Environmentall dalmalge caluses ecosystems become unballalnced alnd oil pallm plalntaltions thalt alre monoculture, so thalt it caln caluse al loss of diversity in aln ecosystem. The benefits of al heallthy alnd decent life will be difficult for the present alnd future generaltions to feel.

Abstract

This study examines the legal issues arising from the unregistered customary marriage, a fundamental issue in the balance between local wisdom and state regulations. On the one hand, customary marriage is an institution that contains socio-cultural values ​​and community identity that have long existed, while on the other hand the informality of the marriage registration raises various legal issues, including unclear legal status, protection of inheritance rights, and access to socio-bureaucratic facilities. The absence of official registration triggers a conflict between positive legal norms and religious and customary values ​​that are still upheld, thus creating a gap in the enforcement of rights and obligations at the local and national levels. In addition, the phenomenon of marriage without official registration also has an impact on vulnerable groups, such as adolescents, who are at risk of experiencing abuse of rights and minimal legal protection. The research method used is normative legal research with a literature approach, considering that the data processed are in the form of laws and regulations and scientific literature. The results of the study indicate that the integration of customary law and positive law through the active role of institutions such as the Office of Religious Affairs and the Population and Civil Registration Service is a strategic step to synergize the two systems, so that it can provide comprehensive legal certainty for the recognition of rights, clarity of marital status, protection of inheritance, and guarantee of access to administrative facilities. Inclusive legal reform and increasing socialization and human resource competence are the keys to reconciling local traditions with modern legal requirements in order to realize social justice and protection of citizen rights).

Abstract

This study examines the philosophical and legal basis of the sale and purchase agreement of bankrupt objects involving the assets of the debtor who has been declared bankrupt. The transaction is not merely an economic exchange, but must also integrate ethical values ​​of muamalah, such as good faith (husn al-niyyah), distributive justice, and transparency of information in order to minimize the level of uncertainty (gharar) inherent in bankrupt assets Faustina & Hoesin (2022). From an Islamic perspective, the basic sharia principles that guide the validity of the sale and purchase agreement are an important foundation so that the rights of buyers with good faith are maintained and protection of creditor interests is still accommodated through mechanisms such as actio pauliana (Haryanto & Calvin, 2021). Furthermore, this study highlights the problems that arise in legal practice, such as the validity of the sale and purchase agreement (PPJB) that has not been formally certified, which has the potential to complicate legal certainty for buyers and threaten the balance between private and public interests (Amini & Wardani, 2023). By applying a normative legal methodology that relies on secondary data from legal literature and court decisions, this study formulates a transaction mechanism that not only ensures fairness and transparency, but also strengthens the integrity of the legal and economic systems in bankruptcy situations. On the other hand, the integration of ethical values ​​​​and principles of justice is expected to create harmonious cooperation between bankrupt actors, creditors, and good-faith buyers, thereby creating sustainable legal stability and certainty.
