Abstract

The NPPN regulations in PER DIRJEN PAJAK Number 17 / PJ / 2015 state that the NPPN percentage is grouped by region. Where this grouping of regions causes a difference in the percentage between regional groups. In addition, regulations regarding regional grouping are also found in PERMENKUMHAM Number 27/2016 which divides regional categories for the position of notaries. For the purpose of this research, this type of normative legal research uses a statute approach where the legal materials in this study are analyzed using prescriptive analysis techniques. Based on the results of the author's research, it can be concluded that the NPPN grouping by region is one of the manifestations of the Equality principle where this principle provides the same treatment to people who are in the same condition. The sentence is in the same condition can be interpreted as being in the same regional characteristics which are based on considerations using several variables. Broadly speaking, there is a correlation between the regional grouping of the two regulations, which lies in the basic factor for determining regional grouping, that is regional economic growth. The regional grouping that is regulated in the two rules has also fulfilled the value of justice as proposed by Aristotle's theory of justice. Regional grouping which is regulated by the government has clear and firm reasons so that this grouping is not a discriminatory act but is a form of distributive justice. How to cite item: Rachmatullah, A., Anshari, T., Wisnuwardhani, D. Abstract

This article examines legal certainty-based law enforcement by the Regional Supervisory Council against Notaries who violate the Code of Ethics, with a study focused on the Regional Supervisory Council of Malang City. The research discusses the implementation of Article 67 paragraph (1) of Law Number 2 of 2014 concerning supervision and guidance of Notaries, the dominant factors causing ethical violations, and the obstacles and efforts of the Regional Supervisory Council in realizing legal certainty. This research uses a socio-legal method with an empirical juridical approach. Primary data were obtained through interviews with the Chairperson of the Regional Supervisory Council of Malang City, while secondary data were collected from laws and regulations, books, journals, the Notary Code of Ethics, and relevant legal sources. The findings show that supervision is carried out preventively through routine protocol inspections and guidance, and repressively through examination of public reports. However, obstacles remain, including weak integrity, incomplete protocols, limited evidence, and limited authority to impose final sanctions. Therefore, supervision must be strengthened to be clearer, more consistent, measurable, and legally certain.

Abstract

This article examines the legal certainty of limits on the use of social media by Notaries as a means of legal education, with a comparative study of Dutch notarial regulations. The issue arises because technological development has encouraged Notaries to use social media to provide legal information to the public, while the Notary Code of Ethics prohibits self-promotion and commercial activities. This creates uncertainty in distinguishing legitimate legal education from prohibited self-promotion. This research uses a normative juridical method with statutory, conceptual, theoretical, and comparative approaches. Legal materials were collected through library research by examining the Notary Position Law, the Notary Code of Ethics, legal literature, and Dutch notarial regulations. The findings show that Indonesian notarial law does not specifically regulate the use of social media, creating a regulatory gap and subjective ethical assessment. The study concludes that specific guidelines are needed to define educational, transparent, non-commercial, and ethically accountable social media use by Notaries
