Abstract

The study, titled “Reconstruction Of The Sport Institute Coaching Arragements In Legislation”  aims to analyze the No. 3 Year 2005 about the National Immune System in the second generation of adults, the political system in Indonesia and the form of breaking up in the Constitution. The method used in this study is normative legal research, the approach taken Law approach, historical approach and comparative approach, there are three sources of legal material, namely the source of primary, secondary and tertiary legal materials. The legal material collection technique analyzes the Minutes of the Indonesian National System, a study of students by collecting and analyzing the population, as well as researchers from the internet. The analysis of the law in the study with descriptive descriptive techniques of the. The results showed that the problem can be concluded as the cause of the obscurity of the norms of the National Sports Committee in 36 articles (1) and (3), based on the SKN Draft Bill, the KONI is written National Sports with the aim to protect the citizenship of KONI. KOI only has to go to the internet and it will take an internal competition. The overlapping of authority in the development of sports due to the absence of legal certainty. Giving the concept of setting up KONI and KOI after being in the mid-1980s, KONI and KOI will eventually be led by a third, Reconstruction in the SKN Law makes it appear that it has a disadvantage so it does not cause conflict.

Abstract

The prohibition or recommendation for the detention of workers 'original documents is not clearly stipulated in the labor law so that some employers detain or retain workers' original documents to be made to bind workers. This is permissible if it becomes an agreement between workers and employers, but of course there will be some risks borne by workers if the original documents are guaranteed. In this case a clear and definite rule is needed regarding the prohibition of hold or save of original documents of workers by employers as an effort to protect workers. The government has the authority to make regulations that can protect workers from arbitrary rules made by employers

Abstract

Local governments have undergone various regulatory developments since Indonesia's independence 75 years ago. Various aspects underlying the development and changes in local government policies can be analyzed using several approaches, such as historical, philosophical, and sociological. This paper will discuss how the legal politics of the development of local government implementation, especially in terms of decentralization. Furthermore, the author will explain about the opportunities for implementing decentralization based on regional capacity to promote welfare of society. This research is normative juridical research using historical approach, conceptual approach, and legal approach. It can be said that the implementation and development of local government implementation is strongly influenced by various aspects other than the legal factor itself. Furthermore, there is still the possibility of implementing decentralization based on regional capacity as an effort to promote social welfare.

Abstract

The purpose of this study is to describe and analyze the causes of land value zones as one of the variables of land price assessment to determine BPHTB and analyze and solve practical problems regarding the legal strength and validity of land value zones that are used as the basis for land price assessment. This research uses qualitative analysis, this type of research is a type of empirical research. The results of the study showed that the calculation of BPHTB Dispenda Tax using Market Value, self-assessment, and database collected as a reference in determining the price or value of a land, so that DISPENDA Sidoarjo Regency also makes ZNT as one of the comparison variables in determining the value of land and buildings attached to the land because in determining ZNT is also one of them using market value. In addition, all DISPENDA still imposes its authority to conduct assessments of land and buildings for tax payments because there has been no firm action on the assessment and there have been no regulations affirmed for the implementation of local taxation on BPHTB. Abstract

 Tujuan yang ingin dicapai dalam penelitian ini adalah Untuk Mengkaji, mengetahui dan menganalisa rasio logis dari Pasal 21 ayat (1) Undang-Undang No. 30 Tahun 2014 tentang Administrasi Pemerintahan, yang memberi wewenang kepada peradilan Tata Usaha Negara untuk menguji unsur penyalahgunaan wewenang dan implikasi wewenang PTUN dalam menguji penyalahgunaan wewenang terhadap penegakan tindak pidana korupsi. Metode yang digunakan dalam penelitian ini adalah penelitian hukum Normatif dengan Teknik penelusuran bahan hukum dilakukan dengan studi Pustaka. Hasil penelitian dengan metode diatas menunjukan bahwa Rasio logis dari Pasal 21 Undang-Undang Nomor 30 tahun 2014 Tentang Administrasi Pemerintahan adalah Pengawasan oleh Peradilan Tata Usaha Negara sebagai sarana pencegahan penyalahgunaan wewenang dalam keputusan dan/atau tindakan (diskresi) oleh pejabat administrasi pemerintahan menjalankan tugas pelayanan dan implikasi hukum yang bisa timbul dari wewenang Peradilan Tata Usaha Negara menguji ada tidaknya penyalahgunaan wewenang yang berkaitan dengan Tindak Pidana Korupsi adalah bahwa Wewenang PTUN membawa implikasi dalam proses penegakan hukum tindak pidana korupsi.  Kata-Kunci: kewenangan, Peradilan Tata Usaha negara, Korupsi The objective to be achieved in this study is to Review, know and analyze the logical ratio of Article 21 paragraph (1) of Law No. 30 of 2014 on Government Administration, which authorizes the State Administrative judiciary to test the elements of abuse of authority and implications of ptun authority in testing abuse of authority against the enforcement of corruption crimes. The method used in this study is Normative legal research with legal material tracing techniques conducted with Pustaka studies. The results of the research with the above method show that the logical ratio of Article 21 of Law No. 30 of 2014 on Government Administration is Supervision by the State Administrative Court as a means of preventing abuse of authority in decisions and /or actions (discretion) by government administration officials carrying out service duties and legal implications that can arise from the authority of the State Administrative Court to test whether or not abuse of authority related to corruption crimes is that the Authority of state administrative judiciary carries implications in the enforcement process of corruption crimes.Keywords: authority, state administrative judiciary, corruption

Abstract

Jaminan merupakan salah satu faktor penting untuk pemberian kredit dari krediturkepada debitur. Salah satu jaminan kebendaan yang pada umumnya menjadijaminan kredit adalah tanah dan bangunan dalam bentuk rumah tinggal, ruko,pabrik atau gudang. Berdasarkan Undang-Undang No. 4 Tahun 1996. Pengikatanatas jaminan tanah dan bangunan dilakukan dengan pengikatan hak tanggungan.Akta Pemberian Hak Tanggungan ini haruslah didaftarkan ke Kantor Pertanahanuntuk diterbitkan Sertipikat Hak Tanggungan yang menjadi bukti kuat hakkreditur sebagai pemegang Hak Tanggungan. Tetapi terkadang Sertipikat Hak atastanah yang menjadi obyek dari Hak Tanggungan tersebut palsu sehinggaSertipikat Hak Tanggungan dibatalkan oleh Kantor Pertanahan. Ketika SertipikatHak Tanggungan dibatalkan menjadi pertanyaan bagaimana perlindungan hukumterhadap kreditur yang harus menderita kerugian dikarenakan kehilangan hakprefern atas Hak Tanggungan.

Abstract

Undang-Undang No. 11 tertanggal 1 Juli 2016 tentang Pengampunan Pajak (Undang-Undang Pengampunan Pajak) mensyaratkan pengalihan harta tidak bergerak berupa tanah dan/atau bangunan milik Wajib Pajak selambat-lambatnya pada tanggal 31 Desember 2017, untuk memperoleh pembebasan Pajak Penghasilan. Namun, dalam faktanya tidak semua produk hukum Pejabat Pembuat Akta Tanah terkait pengalihan tanah dan bangunan tepat diaplikasikan untuk formalisasi transaksi wajib pajak dimaksud.  Melalui pendekatan yuridis normatif dengan metode penemuan hukum (rechtsvinding), Penulis menganalisis bentuk dokumen hukum Pejabat Pembuat Akta Tanah yang dapat mengakomodasi kebutuhan Wajib Pajak untuk memperoleh pembebasan pajak penghasilan berdasarkan Undang-Undang Pengampunan Pajak.

Abstract

The NPPN regulations in PER DIRJEN PAJAK Number 17 / PJ / 2015 state that the NPPN percentage is grouped by region. Where this grouping of regions causes a difference in the percentage between regional groups. In addition, regulations regarding regional grouping are also found in PERMENKUMHAM Number 27/2016 which divides regional categories for the position of notaries. For the purpose of this research, this type of normative legal research uses a statute approach where the legal materials in this study are analyzed using prescriptive analysis techniques. Based on the results of the author's research, it can be concluded that the NPPN grouping by region is one of the manifestations of the Equality principle where this principle provides the same treatment to people who are in the same condition. The sentence is in the same condition can be interpreted as being in the same regional characteristics which are based on considerations using several variables. Broadly speaking, there is a correlation between the regional grouping of the two regulations, which lies in the basic factor for determining regional grouping, that is regional economic growth. The regional grouping that is regulated in the two rules has also fulfilled the value of justice as proposed by Aristotle's theory of justice. Regional grouping which is regulated by the government has clear and firm reasons so that this grouping is not a discriminatory act but is a form of distributive justice.How to cite item: Rachmatullah, A., Anshari, T., Wisnuwardhani, D.
