Abstract

Lahirnya Keputusаn Menteri Аgrаriа dаn Tаtа Ruаng/Kepаlа Bаdаn Pertаnаhаn Nаsionаl Nomor 276/KEP-19.2/X/2017 tentаng Penunjukаn Desа Pаkrаmаn di Provinsi Bаli Sebаgаi Subyek Hаk Pemilikаn Bersаmа (Komunаl) Аtаs Tanah tidak sesuai dengan ketentuan Pasal II Ayat 1 Konversi Undang-undang nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria yang sudah jelas salah satunya menegaskan mengenai tanah druwe desa. Sehingga hal ini menyebabkan suatu multitafsir. Oleh karena itu, menarik untuk diteliti terhadap dаsаr munculnyа Keputusаn Menteri Аgrаriа dаn Tаtа Ruаng/Kepаlа Bаdаn Pertаnаhаn Nаsionаl Nomor 276/KEP-19.2/X/2017 tentаng Penunjukаn Desа Pаkrаmаn di Provinsi Bаli Sebаgаi Subyek Hаk Pemilikаn Bersаmа (Komunаl) Аtаs Tanah dаn kuаt аtаu tidаk dаyа mengikаt dаri keputusаn tersebut. Metode penelitian ini adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa Penunjukkаn Desа Pаkrаmаn di Provinsi Bаli sebаgаi Subjek Hаk Pemilikаn Bersаmа (Komunаl) Atаs Tаnаh tidak konsisten dengan aturan yang ada diatasnya. Bahkan dari ketidakpastian hukum tersebut menyebabkan suatu kekosongan hukum terhadap status dan kedudukan hak atas tanah druwe desa di Bali. Ideal pengaturan tanah adat di Bali sesuai dengan Pasal II Ayat 1 Konversi UUPA yang salah satunya menegaskan hak atas druwe desa. Hak atas druwe desa subjeknya pasti desa adat dan Desa Adat sudah mengatur hak-hak atas tanah druwe desa di Bali. Sehingga diharapkan pembuat undang-undang segera membuat peraturan perundang-undangan yang sinkron dan berkepastian hukum serta mampu mengakomodir semua jenis tanah druwe desa yang ada di Bali.

Abstract

Interaksi antara aliran fluida dengan suatu benda sering ditemui di alam. Aliran laminar maupun turbulen yang melewati suatu permukaan benda, maka partikel-partikel di sekitar permukaan bergerak lambat akibat gaya viskos, sehingga kecepatan partikel tersebut relatif nol. Pada paper ini akan mengkaji solusi numerik untuk menyelesaikan persamaan Navier-Stokes yang diterapkan pada persegi sirkuler yang dialiri fluida.

Abstract

This abstract is entitled "Implementation of Government Regulation Number 20 of 2021 concerning Control of Study Abandoned Areas and Lands on HGB Land Indicated as Abandoned as Land in Madiun City". This research is a type of legal research with empirical research methods. Besides, this research uses a juridical-sociological research approach. The results of this abstract study Abandoned Land is land that is not used, not cultivated, not used according to its designation. In fact, land in Indonesia must function socially and benefit many people around it. The implementation of the control of Abandoned Land in Madiun City has been carried out with reference to Government Regulation Number 20 of 2021, namely concerning Control of Abandoned Areas and Lands. There are 108 lands indicated to be abandoned and 4 of them are certified with Hak Guna Bangunan. In the implementation it has been carried out properly and maximally, namely by socializing in advance regarding Government Regulation Number 20 of 2021, namely concerning Control of Abandoned Areas and Lands and continuing to be investigated regarding abandoned land, only in this implementation there is still an update of new regulations related to object exceptions. abandoned land, namely the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 20 of 2021 concerning.

Abstract

This study examines the legal implications of land ownership rights in Dago Elos following Bandung District Court Decision No. 601/Pid.B/2024/PN Bdg, which annulled the inheritance claim by the Muller Family over land formerly titled as Eigendom Verponding Nos. 3740, 3741, and 3742. Previously, the Supreme Court Decision No. 109 PK/Pdt/2022 had ruled in favor of the Muller Family and ordered Dago Elos residents to vacate the land they had occupied for decades. However, in 2024, new legal evidence (novum) emerged proving the Muller Family committed inheritance fraud, as confirmed by a criminal verdict. This research adopts a normative juridical method with a case and statutory approach. The findings reveal that falsified heirship documents invalidate the Muller Family’s legal standing over the disputed land. Under Supreme Court Circular No. 10 of 2009, the affected residents have the right to submit a second judicial review to restore their land rights. This study highlights the importance of substantive justice in agrarian disputes and the necessity of legal protection for communities with long-standing physical control over their land.
