Abstract

The practice of electronic commerce or e-commerce regulated under law number 11 of 2008 concerning electronic information and transaction and government regulation number 82 of 2012 concerning implementation of electronic system and transaction. This research armed to find out the practice of e-commerce transaction according to the law and to find out dispute settlement pattern of e-commerce transaction in Indonesia. The normative empirical research method is occupied in this research yet applying statute,  conceptual and sociological approach the research result shown that implementation of electronic transactions are not fully accordance with the existing law and regulation therefore one side defaults are often occurs. Whereas dispute settlement holds the principle of lumping it,  avoidance and negotiation.Keywords : Transaction,  electronic contract

Abstract

The purpose of this research is to understand the legal protection for children who are victims of parental neglect and to identify the forms of accountability for parents who neglect their children. The type of research used in this study is normative-empirical research. The data in this research were obtained through observation, interviews, documentation, and literature studies using the legislative approach, conceptual approach, and case approach. The discussion in this research refers to the Law of the Republic of Indonesia Number 35 Year 2014 concerning child protection, which states that legal protection for children can be interpreted as efforts to legally protect various freedoms and fundamental rights of children. In Hinduism, it is also explained that protection for children must be carried out since the child is in the womb. It is not acceptable for a child in the womb to receive any mistreatment from anyone, especially after the child is born into the world and lives like other humans in general.

Abstract

This study aims to analyze the implementation of Customary Law Communities (MHA) determination in North Lombok Regency (KLU), focusing on government actions, community responses, and encountered obstacles. This research employs an empirical legal research method. It was conducted from May to September 2024 through observation, interviews, and a literature review. Informants were selected using a purposive sampling technique. The study results show that determining MHA in KLU has only been completed at the Identification stage. The KLU MHA Identification Team identifies 13 (thirteen) Customary Law Communities (MHA): Bayan, Pansor, Salut, Wet Pengorong Amor-Amor, Wet Sesait, Kuripan, Pemaru Satan, Gubuk Bebekeq, Leong, Meleko, Orong Empak Pansan, Wet Sokong, and Jeliman Ireng. The thirteen aforementioned communities follow the criteria outlined in Article 6, Paragraph (6) of the North Lombok Regency Regional Regulation (PERDA KLU)  No. 6 of 2020. The biggest obstacle in this process is the unavailability of technical guidance and the absence of definite work targets from the local government. The recommendation from the results of this study is that the KLU Regent who will be elected for the 2024-2029 period needs to include the MHA determination program in the KLU Regional Medium-Term Development Plan (RPJMD). Incorporating this program into the Regional Medium-Term Development Plan (RPJMD) document will ensure structured budgeting, develop technical guidelines, and  measurable targets for effective implementation.
