Abstract

Penelitian ini hendak mendeskripsikan tentang: (1) bentuk-bentuk perlindungan konsumen dalam pemanfaatan Fintech, (2) berbagai upaya pencegahan penyalahgunaan finteh, dan (3) peran BI, OJK, dan Kemeninfokom dalam memberikan pembelajaran kepada masyarakat agar tidak terlilit utang kepada penyelenggara fintech. Metode yang digunakan untuk menjawab rumusan masalah yaitu dengan pendekatan normatif dengan mempelajari berbagai dasar hukum dan literatur yang relevan. Berdasarkan hasil analisis mendalam disimpulkan bahwa: pertama, bentuk perlindungan konsumen dalam pemanfaatan fintech adalah melalui dua cara yaitu prefentif dan kuratif. Kedua, berbagai upaya mencegahan yang dapat dilakukan agar para penyelenggaran Fintech tidak menyalahgunakan aplikasinya, adalah dengan cara memberikan kewajiban untuk melakukan pelaporan kepada OJK. Ketiga, peran BI, OJK, dan Kemeninfokom dalam memberikan pembelajran kepada masayakat agar tidak terlilit utang yaitu dengan cara memberikan penyuluhan melalui pemberian iklan layanan masyarakat melaui TV, koran, radio, dan situs resmi, memperkuat literasi dan wawasan masyarakat. Kata Kunci : Financial Technology, Perlindungan Konsumen. Abstract: This study is about to describe: (1) risk analysis and other forms of Fintech consumer protection, (2) various efforts to prevent misuse of fintech, and (3) settlement of fintech business disputes. The method used to answer the problem formulation is a normative approach by studying various legal bases and relevant literature. Based on the results of the in-depth analysis it was concluded that: first, the form of consumer protection in the use of fintech is in two ways, namely prevention and curative. Second, various preventive measures that can be taken so that the organizers of Fintech do not abuse their applications, are by giving them the obligation to report to the OJK. Third, the role of Bank of Indonesia (BI), financial servises Outority (OJK), and the Ministry of Communication and Information in providing learning to people not to become debt-ridden by providing counseling through the provision of public service advertisements through television, newspapers, radio and official sites, strengthening literacy and public insight. Abstract

The purpose of this study is to provide a literature review of the problems currently faced by Islamic Capital Markets, given that Islamic capital market products have not been used significantly as a source of financing outside of Islamic Banks. Whereas the opportunity as an alternative source of funding is quite large, especially because of the potential of the majority of Indonesian Muslims. The method used in this study is the literature method based on the most up-to-date reading sources from books and journals. Data analysis methods used are SWOT analysis so that it is expected to find the right strategic solution for using the Islamic capital market as a source of financing outside the bank. The results of the analysis indicate that the use of Islamic capital market products has a positive force by continuously maintaining its existence. Its superiority is influenced by its activities which avoid Maghrib (Maysir, haram, usury and gharar). The impact is very significant on environmental empowerment or 'green economy' because it indirectly prohibits the practice of destroying natural resources for stakeholder actors. The disadvantage is the large number of human resources in the Islamic Capital Market who are unable to use sophisticated technology appropriately and optimally. Opportunities come from technological developments and increasing public financial literacy on the Islamic capital market. The obstacle is that there is a high risk due to external factors, namely political, economic, socio-cultural changes that must be watched because there is always no certainty about it.
