ABSTRAK Di Aceh, tindak pidana zina diatur dalam Pasal 33 ayat (1) Qanun Aceh Nomor 6 Tahun 2014 tentang Hukum Jinayat. Namun dalam pelaksanaannya penegakan qanun hukum jinayat belum terlaksana dengan baik, dimana masih terjadi penyelesaian tindak pidana zina secara mediasi melalui lembaga adat. Penelitian ini bertujuan untuk mengetahui bagaimana penyelesaian tindak pidana (jarimah) zina secara mediasi ditinjau dari perspektif hukum positif dan hukum Islam, dan bagaimana pandangan aparat penegak hukum terhadap penyelesaian tindak pidana (jarimah) zina secara mediasi. Jenis penelitian ini hukum empiris, yang diteliti pada awalnya adalah data sekunder yang kemudian dilanjutkan dengan penelitian pada data primer di lapangan. Berdasarkan hasil penelitian penyelesaian tindak pidana (jarimah) zina melalui mediasi perspektif hukum positif penyelesaian perkara tindak pidana zina secara mediasi di luar pengadilan selama ini tidak ada landasan hukum formalnya, sehingga sering terjadi suatu kasus yang secara informalnya sudah terselesaikan secara damai melalui mekanisme adat namun proses di pengadilan tetap berjalan sesuai dengan hukum yang berlaku. Secara hukum Islam penyelesaian jarimah zina dengan jalan mediasi atau melalui peradilan adat tidak dibenarkan, karena termasuk jarimah hudud yang sanksinya sudah langsung ditentukan oleh Allah SWT dalam Al-Qur?an. Kata kunci: hukum islam; hukum positif; mediasi; tindak pidana zina. ABSTRACT In Aceh, follow the adultery decision in Article 33 paragraph (1) Aceh Qanun Number 6 of 2014 concerning Jinayat Law. But in its implementation, the jinayat legal qanun has not been implemented properly, where there is still a settlement of criminal acts through mediation of traditional institutions. This study aims to determine how to solve criminal acts (jarimah) of zina by mediation in terms of the perspective of positive law and Islamic law, and how the law enforcers view the settlement of criminal acts (jarimah) zina by mediation. This type of research is empirical law, which investigates initially is secondary data which is then followed by analysis on primary data in the field. Based on the results of study on the settlement of criminal acts (jarimah) zina by mediating a positive legal perspective, the arrangement of cases of zina crime by mediation outside the court so far has no formal legal basis, so there is often a case that has been resolved peacefully through customary mechanisms but the process in the court it still runs in accordance with applicable law. In Islamic law the completion of zina fingerprints by mediation or through customary justice is not justified, because including the jarimah hudud whose sanctions have been directly determined by Allah SWT in the Qur'an.Keywords: adultery crim; islamic law; mediation; positive law.

Dalam hukum adat Gayo dikenal suatu perjanjian perkawinan dengan istilah perampam dene, yaitu suatu denda yang diberikan kepada seseorang pasangan suami atau isteri yang melanggar sebuah perjanjian di dalam perkawinan, perjanjian perampam dene ini dibuat oleh kesepakatan kedua belah pihak antara suami dan isteri yang disaksikan oleh orang tua kedua pasangan suami isteri atau keluarga dan diketahui oleh reje (kepala desa) kedua belah pihak. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis empiris atau penelitian hukum sosiologis. Penelitian hukum empiris, yang deteliti pada awalnya adalah data sekunder yang kemudian dilanjutkan dengan penelitian pada data primer di lapangan. Pelaksaan perjanjian perkawinan perampam dene, para pihak yang yang datang kepada Reje sendiri tanpa ada paksaan, setelah sarak opat menemukan titik temu dalam permasalahan yang dihadapi oleh para pihak, para pihak membacakan isi dari perjanjian perkawinan perampam dene dihadapan unsur-unsur sarak opat dan saksi-saksi. Kedudukan Perjanjian perkawinan perampam dene bila ditinjau dari hukum Islam kedudukannya hukumnya sangat kuat karena perampam dene berdasarkan Al-Qur’an dan hadist, jika ditinjau dari Kitab Undang-Undang Hukum Perdata kedudukan perjanjian perkawinan perampam dene tidak kuat.

Thisstudy aims firstly to observe the effectiveness of minor criminal acts settlement through Sarak Opat in Central Aceh District. Second, it is to find out what constraints being faced by Sarak Opat are in settling the minor criminal acts in Central Aceh District. The method used in this study was empirical legal research or sociological legal research. The types and sources of data used in this study included library research and field research. The data analysis technique was conducted through a descriptivequalitative method by analysing the data obtained from the primary and secondary data sources. This was then continued with a thorough discussion and a conclusion, based on the discussion, was drawn in response to the problems studied. The results of the research showed first that it was still ineffective now that the people becoming the victims of criminal acts more believed in the police as the law enforcement officials rather than the settlement through the traditional institution of Sarak Opat. Second,the constraints faced by Sarak Opat in the settlement of minor crimes in Central Aceh Regency, included 1). The lack of understanding of the traditional institution of Sarak Opat; 2). Customary sanctions not giving any deterrent effects on the perpetrator; 3). No documented dispute settlement by traditional institution Sarak Opat; 4). Lack of coordination between traditional institution Sarak Opat and Police Department.

AbstrakDi Indonesia sendiri perkembangan ekonomi Islam ditandai dengan beroperasinya Bank Muamalat pada tahun 1992, dan mengalami perkembangan yang cukup pesat sejak perubahan Undang-Undang Nomor 7 Tahun 1992 menjadi Undang-Undang Nomor 10 Tahun 1998 tentang Perbankan. Diprakarsai oleh Majelis Ulama Indonesia (MUI), Pemerintah Indonesia, serta mendapat dukungan nyata dari eksponen Ikatan Cendekiawan Muslim se-Indonsia (ICMI) dan beberapa pengusaha muslim. Tujuan dilakukan penelitian ini adalah untuk mengetahui bagaimana perkembangan akad pembiayaan murabahah di bank syariah mandiri serta kesesuaiannya dengan prinsip fiqih Islam. Hasil penelitian menunjukkan pembiayaan Murabahah telah mengalami perkembangan sampai pada tingkat yang cukup kompleks. Pembiayaan Murabahah masa ini telah melibatkan 3 (tiga) pihak yaitu pembeli (nasabah), penjual (bank) dan supplier. Untuk implementasi pembiayaan Murabahah di Bank Mandiri Syariah Takengon, setidaknya ada 3 pola pengembangan yang diterapkan. Akad pembiayaan murabahah pada Bank Syariah Mandiri Takengon masih terdapat beberapa aspek yang kurang relevan dengan prinsip-prinsip dasar murabahah dalam fikih Islam.AbstracIn Indonesia itself, the development of the Islamic economy was marked by the operation of Bank Muamalat in 1992, and experienced a fairly rapid development since the amendment of Law Number 7 of 1992 to Law Number 10 of 1998 concerning Banking. Initiated by the Indonesian Ulema Council (MUI), the Government of Indonesia, and received real support from exponents of the Indonesian Muslim Intellectuals Association (ICMI) and several Muslim entrepreneurs. The purpose of this research is to determine how the development of the murabahah financing contract in an independent Islamic bank and its compliance with the principles of Islamic fiqh. The results showed that Murabahah financing has developed to a quite complex level. Murabahah financing at this time has involved 3 (three) parties, namely the buyer (customer), seller (bank) and supplier. For the implementation of Murabahah financing at Bank Mandiri Syariah Takengon, there are at least 3 development patterns that are applied. Murabahah financing agreements at Bank Syariah Mandiri Takengon still have several aspects that are less relevant to the basic principles of murabahah in Islamic jurisprudence.

Aceh adalah salah satu daerah yang memiliki hak otonomi khusus, sehingga keberadaan hukum adatnya diakui. Sebagaimana diatur dalam Pasal 18 Undang-undang Dasar 1945. Dalam Surat Keputusan Bersama Gubernur Aceh, Kepala Kepolisian, Daerah Aceh dan Majelis Adat Aceh Nomor 189/667/20011, 1054/MAA/XII/2011, B/121/I/2012 tentang penyelenggaraan peradilan Adat Gampong dan Mukim atau nama lain di Aceh menyatakan ada beberapa perselisihan atau beberapa tindak pidana yang sebelumnya sudah diatur di dalam KUHP dan Undang-undang khusus diselesaikan melalui lembaga adat. Jenis penelitian ini adalah penelitian yuridis empiris. Penelitian yuridis empiris adalah penelitian yang dilakukan di lapangan secara langsung guna mendapatkan data primer. Data yang diperoleh baik dari studi kepustakaan maupun dari penelitian lapangan akan dianalisis secara deskriptif kualitatif.

ABSTRAKDalam hukum Islam wakaf dikategorikan sebagai ibadah kemasyarakatan berbentuk shodaqoh yaitu penyerahan suatu benda untuk kepentingan masyarakat yang pahalanya akan tetap mengalir terus menerus kepada yang bersedekah. Jenis penelitian ini merupakan pendekatan yuridis-empiris. Pendekatan yuridis digunakan untuk menganalisis berbagai peraturan perundang-undangan terkait dengan tanah wakaf, sedangkan pendekatan empiris digunakan untuk menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakatan. Hasil penelitian peralihan tanah wakaf Dalam Hukum Islam pada dasarnya perubahan status wakaf tidak diperbolehkan, kecuali wakaf tersebut tidak dapat kembali dimanfaatkan sesuai dengan tujuan wakaf, dalam perundang-undangan tentang wakaf di Indonesia terhadap benda yang telah diwakafkan tidak dapat dilakukan peralihan, terhadap perbuatan peralihan benda wakaf dapat diberikan sanksi pidana hukuman kurungan selama-lamanya 3 (tiga) bulan dan denda sebanyak-banyaknya Rp. 10.000 (sepuluh ribu rupiah).Kata Kunci : Tanah Wakaf, Hukum Islam, Hukum PositifABSTRACTIn Islamic law wakaf is categorized as community shodaqoh form of worship is penyarapanikasi objects for the benefit of society that will continue for the sadaqah. The result of the research of the transition of wakaf land In Islamic Law on the status of waqf can not be used, unless the wakaf can not be reused with the purpose of wakaf, in the context of wakaf in Indonesia to the object that has been represented can not be made transition, to the act of transition of waqf goods can be given sanction imprisonment for a maximum of 3 (three) months and a fine of Rp. 10,000 (several thousand rupiah).Keywords : Wakaf Land, Islamic Law, Positive Law

In criminal law, owners who allow their livestock to damage other people's land or gardens can be held legally responsible, as regulated in Article 549, paragraph 1 of the Criminal Code. However, in practice in the field, there are still people who keep their livestock in other people's gardens. This study aims to examine criminal sanctions against livestock owners who damage other people's gardens and criminal liability for those who damage other people's gardens. This type of research is juridical empirical by using primary data and secondary data. The results show that Criminal sanctions against livestock owners who enter other people's gardens may be subject to fines or compensation for parks damaged by livestock. If the penalties are not implemented, they can be replaced with imprisonment for 14 (fourteen) days. At the same time, criminal liability to livestock owners who enter other people's gardens can only be resolved amicably or peacefully at the village level through the traditional sarak opat institution.

Nowadays, there are many criminal acts of counterfeiting in various forms which point to the growing modus operandi of the perpetrators of crime. One of them is the act of falsifying the Marriage Book. The purpose of this study is to determine the application of criminal sanctions against perpetrators of identity falsification in the manufacture of marriage books and to determine the efforts of the Kebayakan Religious Affairs Office in overcoming falsification of marital identity in the manufacture of marriage books. This type of research is an empirical juridical research. The data sources used are primary data and secondary data obtained from primary legal materials, secondary legal materials and tertiary legal materials. The method of collecting data is through interviews and document studies. Data analysis techniques will be analyzed qualitatively. The results of the study explain that the application of criminal sanctions against perpetrators of falsification of marriage identities on marriage books is not resolved through criminal law, only resolved through the Sharia Court by requesting the cancellation of marriages by the Office of Religious Affairs (KUA). The efforts of the religious affairs office are mostly against the crime of falsifying marital identity, namely: First, socialization efforts and second, repressive efforts (actions) against perpetrators of the crime of falsifying marital identity.

The Sarak Opat as one of the customary institutions in Aceh have been authorized to settle disputes of minor cases at the village level in Central Aceh, Aceh, Indonesia. This is guaranteed by the applicable laws and regulations. However, the practice of resolving minor cases is currently delegated to the judiciary. Therefore, this study was a legal empirical or sociological research to analyze primary and secondary data in Central Aceh Regency. Data collection method employed were direct interviews with selected informants, and the collected data were processed in qualitative analysis method. The results showed that the role of the Sarak Opat customary institution in resolving minor cases in the Gayo community in Central Aceh has a strong legal basis as mandated by various national and regional legal policies. Subsequently, the customary institution has two considerations in delegating minor criminal cases to the judiciary. First, the litigants are dissatisfied with the sanctions decided by Sarak Opat. Second, the officials of Sarak Opat lack understanding of their authority as a customary justice institution.

Misuse of distribution of fuel oil (BBM) often occurs illegally, to gain individual or business entity benefits by harming the interests of the general public and the state. This act is against the law and can be subject to criminal penalties as regulated in Law Number 22 of 2001 concerning Oil and Gas. This type of research is empirical law using primary data obtained directly from the field through interviews with related parties, while secondary data obtained through library data in the form of primary legal materials, namely binding regulations, secondary and tertiary materials. Research results show, law enforcement against the illegal distribution of subsidized fuel oil (BBM) has never been carried out by the Central Aceh Resort Police, due to the absence of reports from the public. The efforts of police investigators in overcoming the crime of distributing subsidized fuel oil (BBM) in Central Aceh Regency. First, Supervise the distribution of subsidized fuel in cooperation with local governments, as well as coordinate with owners of Public Fuel Filling Stations (SPBU). Second, urge the public to report to the police if it is found that the distribution of subsidized fuel is illegal.
