Abstract

Tujuan Penelitian ini untuk menganalisis mengenai saksi penyidik kepolisian yang memberikan kesaksian dalam persidangan tindak pidana narkotika dan untuk menganalisis mengenai keterangan penyidik kepolisian selaku saksi yang dapatkah memberikan kekuatan pembuktian dalam persidangan tindak pidana narkotika. Penenelitian ini menggunakan Pendekatan    perundang-undangan  dan  pendekatan  konseptual.  Hasil  penelitian  ditemui bahwa saksi penyidik atau saksi verbalisan tidak dapat menjadi saksi dalam persidangan karena saksi penyidik atau saksi verbalisan tidak memiliki dasar hukum yang mengatur keberadaanya walaupun saksi penyidik atau saksi verbalisan dapat menjadi saksi dalam persidangan tindak pidana narkotika akan tetapi hanya sebatas menerangkan kebenaran berita acara pemeriksaan apabila terjadi ketidaksesuaian antara keterangan saksi dalam berita acara pemeriksaan dengan keterangan yang disampaikan saksi di muka persidangan dan Keterangan saksi penyidik kepolisian atau saksi verbalisan selaku saksi dapat digunakan dalam persidangan karena kekuatan pembuktian keterangan saksi merupakan alat bukti yang bebas dan tidak mempunyai nilai kekuatan pembuktian yang sempurna serta tidak mengikat hakim

Abstract

 Penelitian ini dilakukan mengenai implementasi AMDAL di daerah perumahan di Tatah Belayung Baru. Lokasi yang dipilih sebagai penelitian merupakan lokasi yang terdampak perubahan lahan pertanian yang berubah menjadi lahan perumahan. Target dari kegiatan ini dilakukan untuk Pemerintah Daerah, Developer dan Masyarakat yang berada di lingkungan tersebut. Implementasi AMDAL ini berpengaruh untuk kebijakan mengenai perizinan yang ada di Tatah Belayung Baru disebabkan daerah tersebut dibuat perumahan. Izin Peruntukan Penggunaan Tanah adalah izin yang wajib dimiliki oleh setiap warga masyarakat yang akan mengubah tanah pertanian menjadi non pertanian. Fungsi dari izin peruntukan penggunaan tanah adalah untuk menekan serta pengendalian alih fungsi lahan yang terjadi. Tanah sawah (tanah pertanian) yang akan diubah ke non-pertaniantentunya haruslah sesuai dengan rencana tata ruang dan wilayah di Tatah Belayung Baru agar terjadi kesimbangan dimasa mendatang. Adanya alih fungsi lahan pertanian menjadi perumahan menyebabkan penyusutan jumlah lahan pertanian terus berkurang, hal ini menjadi masalah bagi pemerintah sendiri untuk menyediakan pasokan pangan. Berkurangnya lahan pertanian dalam arti untuk penyediaan bahan-bahan pangan, juga berakibat rusaknya ekosistem alam sebagai tempat penyerapan air hujan sebagai pencegah banjir.Kata-Kunci: Implementasi AMDAL, Lahan Pertanian, PerizinanThis research was conducted on the implementation of AMDAL in a residential area in Tatah Belayung Baru. The location chosen as the research is a location that is affected by changes in agricultural land that are turned into residential land. The target of this activity is for the Regional Government, Developers and Communities in the environment. The implementation of this AMDAL has an effect on policies regarding existing permits in Tatah Belayung Baru because the area is made into housing. Land Use Permit is a permit that must be owned by every citizen who will convert agricultural land into non-agricultural land. The function of the land use permit is to suppress and control the land conversion that occurs. Paddy land (agricultural land) which will be converted to non-agricultural land must of course be in accordance with the spatial and regional planning in Tatah Belayung Baru so that there is a balance in the future. The conversion of agricultural land into housing causes the shrinkage of the amount of agricultural land to continue to decrease, this is a problem for the government itself to provide food supplies. The reduction of agricultural land in the sense of providing food, also results in the destruction of natural ecosystems as a place to absorb rainwater as a flood prevention.Keywords: AMDAL Implementation, Agricultural Land, Licensing

Abstract

The implementation of direct election toward District Head either in province level or regency level gets a constitutional legitimacy through the second amendment of UUD 1945. It is stated that a governor, regent, and mayor are the heads of province, regency, and city who are elected democratically. The understanding of elected democratically can be interpreted variously. However, UUD 1945 as the constitutional base regulates everything not in detail, only the outline. Thus, there must be a further explanation with the law as the organic regulation. As it is stated in UUD 1945, the stipulations of the articles in the constitution are implemented with the law as the operational base. So, the authority of constitution will explain the stipulations of the articles. Paying close attention to the role of political party in District Head Election (PILKADA), it needs to be paid attention that anybody who wins in Pilkada must have political debt to the parties that have supported him, so the parties will explore and exploit the position of the chosen District Head as the rice barn, and it is worried that the chosen District Head cannot act fairly, wisely, do not pay attention on the peoples interest, but tend to be the instrument of the political parties that have supported him with the reason as the debt of honor. In brief, It is because of the parties then he can get the position as the District Head.Bahwa pelaksanaan Pemilihan secara langsung terhadap Kepala Daerah baik pada tingkat provinsi maupun tingkat kabupaten/kota memperoleh legitimasi konstitusional melalui amandemen UUD 1945 yang kedua. Dinyatakan bahwa bahwa Gubernur, Bupati, dan Walikota masing-masing sebagai Kepala Pemerintahan Daerah Provinsi, Kabupaten, dan Kota dipilih secara demokratis. Pemahaman dipilih secara demokratis itu secara tersurat atau interpretasi gramatikal dapat diartikan macam-macam. Namun UUD 1945 sebagai landasan konstitusional hanya mengatur segala sesuatu secara garis besar. Untuk itu harus ada penjabaran lebih lanjut dengan UU sebagai aturan organiknya. Seperti dinyatakan dalam UUD 1945 bahwa ketentuan pasal-pasal dalam UUD itu dilaksanakan dengan Undang Undang sebagai landasan operasionalnya. Dengan demikian kewenangan UU itulah yang menjabarkan ketentuan pasal tersebut. Mencermati peran dari partai politik pada Pilkada, perlu dicermati bahwa siapapun yang akan menang di Pilkada secara langsung tentu akan mempunyai hutang politik kepada partai pendukungnya sehingga partai-partai pendukungnya akan mengeksplorasi dan mengeksploitasi kedudukan Kepala Daerah terpilih sebagai lumbung padi dan dikhawatirkan, kepala daerah yang terpilih tidak dapat bertindak adil, bijaksana dan memperhatikan kepentingan rakyat dan daerahnya tetapi malah menjadi alat dari partai politik pendukungnya dengan alasan hutang budi karena berkat partai politik yang bersangkutanlah maka dapat duduk menjadi Kepala Daerah.

Abstract

The purpose of this study is to analyze the Hand-Catching Operation (OTT) system carried out by the Corruption Eradication Commission and also how the Effectiveness of the Hand-Catching Operation Position (OTT) carried out by the Corruption Eradication Commission (KPK) in the perspective of legal certainty. The type of research used is normative legal research by collecting andanalyze legal material related to the issue to be discussed. As well as comparing several judge's decisions related to the one in question. The results of this study are that the Hand-Catching Operation is an Illegal Action or an arrest where this action can be a reason for carrying out a Pretrial, in which the meaning of Hand-Catching Operation (OTT) still does not have a clear meaning, legal basis and direction. Because the Hand-Catching Operation (OTT) does not have clear regulatory basis in Corruption Crimes, it follows from the juridical implications of the process of investigating Corruption criminal cases. The Hand-Catching Operation carried out by the Corruption Eradication Commission is also an act of Super Power because it is not contained in the Criminal Procedure Code (KUHAP), so the concept of Hand-Catching Operation is still a question mark against the legal framework

Abstract

This research aims to contribute to the development of criminal law policies addressing the widespread distribution of smartphone applications, both APK and iOS, that are used as tools for unauthorized online loan activities, online fraud, threats, and intimidation. These applications often disguise themselves as legitimate online loan platforms, wedding invitation apps, and parcel delivery services. Upon download, they illicitly debit mobile banking accounts or present themselves as government auction platforms for criminal goods at discounted prices, posing significant threats to consumers, debtors, and the general public. Theoretical framework: The foundation of this research lies in cyber law theory, which endeavors to create legal strategies to address cybercrimes and safeguard the digital community. This study utilizes a multidisciplinary approach, integrating legal analysis, policy assessment, and collaboration with stakeholders. Methods: This study utilized the normative juridical method to examine digital policies by criminalizing illegal smartphone applications through cyber law policies. This approach involves a systematic legal analysis of current regulations, assessing their effectiveness, and suggesting formal legal measures to address new threats posed by unauthorized applications, with an emphasis on protecting digital society from harm. Results and Conclusions: This indicates a pressing need for comprehensive criminal law policies specifically designed to effectively combat these unauthorized applications. Such policies are crucial in preventing and mitigating the harms caused by these applications before they impact society. The author's contribution lies in proposing formal offenses against the creators and disseminators of these applications. malicious applications, thereby bridging the current gap in legal measures to counteract digital criminal activities. Originality/Value: This research underscores the urgency of formulating and implementing cyber law policies to safeguard the public from the detrimental effects of illicit smartphone applications. Its originality lies in proposing innovative legal strategies to proactively address emerging digital threats.
