Abstract

AbstrakSecara tradisional,  kesejahteraan adalah suatu kepercayaan bahwa kesejahteraan sosial merupakan tanggung jawab dari masyarakat dan tanggung jawab ini harus dipenuhi oleh pemerintah yang dilaksanakan dalam bentuk negara atau sistem pemerintahan. Demokrasi masih dipandang sebagai sistem yang paling sesuai dalam rangka tercapainya kesejahteraan sosial karena  demokrasi  memberikan  jalan bagi rakyat  untuk  berbicara. Namun, pada praktiknya demokrasi oleh masyarakat awam kerapkali diartikan sebagai pemerintah  yang sebenarnya lebih menekankan kepada demokrasi politik. Artikel ini akan memperlihatkan bagaimana kesejahteraan sosial dianalisis secara akurat dari pemikiran mengenai demokrasi sosial  yang  berjalan beriringan dengan  model demokrasi konsensus  sebagai dasar fundamental dalam menghadapiperistiwa negara dan pemerintahan.Time for People to Speak: Democracy and WelfarismAbstractTraditionally, Welfarism is the belief that social well-being is the responsibility of a community which could only be realized through state or governmental management. It is still believed that  Democracy is the  most  proper system in achieving social welfare, since it permits the people of a country to speak. In practice, however, Democracy is only understood  as a system that gives the governmental rights to the majority of the people. This article, thus, will argue that social wel fare is more precisely analyzed through the notion of Social-Democracy, which goes hand-in-hand  with the consensus model of Democracy as a fundamental base in carrying out state and governmental affairs.DOI: https://doi.org/10.22304/pjih.v1n1.a1

Abstract

Keadaan bahaya atau kedaruratan senantiasa dihadapi oleh setiap negara yang memaksa negara yang bersangkutan melakukan tindakan-tindakan, baik berupa penetapan keadaan bahaya (extraordinary measures) ataupun penetapan aturan (extraordinary rules) untuk memulihkan keadaan bahaya tersebut. Umumnya tindakan-tindakan untuk mengatasinya diatur dalam konstitusi atau undang-undang dasar negara yang bersangkutan agar tindakan dimaksud mempunyai dasar hukum yang kuat. Undang-Undang Dasar 1945 mengatur dua hal kedaruratan, yaitu dalam Pasal 12 yang memberikan wewenang kepada presiden menetapkan keadaan bahaya (extraordinary measures), serta Pasal 22 yang menjadi dasar konstitusional dikeluarkannya peraturan pemerintah pengganti undang-undang oleh presiden (extraordinary rules). Dalam praktik, tidak mudah mengualifikasi suatu keadaan sebagai genting memaksa. Artikel ini menganalisis peraturan pemerintah pengganti undang-undang  dalam perspektif ajaran konstitusi serta prinsip negara hukum. Untuk menghindarkan terjadinya kesewenang-wenangan, perpu perlu memiliki sejumlah limitasi, meliputi makna, ruang lingkup atau materi muatan, proses pembentukan dan pembahasan, serta akibat hukum.  Government Regulation in Lieu of Law from the Perspective of Constitutionalism and the Rule of Law AbstractEvery country has always faces condition of emergency which forces such a country to determine or to decide extraordinary measures and extraordinary rules in order to restore the abnormal condition to become a normal one. In general, those measurements should have been regulated by a constitution in order to ensure that legitimate and legal acts are secured. The Amended 1945 Constitution provides distinct rules in regard to the exigencies, namely Article 12 (extraordinary measures) and Article 22 (extraordinary rules). The latter gives the way to the establishment of government regulation in lieu of law. In practice, however, it is quite difficult to qualify a particular condition as an emergency. This article examines government regulation in lieu of law from the perspective of constitutionalism and the rule of law. It is argued that to avoid arbitrariness as a result of the use of discretion in determining the emergency condition and to ensure that the extraordinary power is in line with constitutionalism and the rule of law principle, it is fundamental to apply limitations upon the use of it which include the accurate meaning of exigencies, limited subject matters of government regulation in lieu of law, the clear procedure of enactment, as well as its well-defined legal implications. Keywords: emergency, abnormal condition, constitusionalism, government regulation in lieu of law, the rule of law. DOI: https://doi.org/10.22304/pjih.v4n2.a1

Abstract

AbstrakSalah satu titik sentral dalam konstitusionalisme adalah persoalan hak asasi manusia. Dalam kaitan ini, konstitusi memiliki peran penting, yang bukan hanya sekadar melakukan jaminan dan proteksi secara tertulis, melainkan pula menyediakan berbagai nilai yang digunakan oleh lembaga peradilan dalam interpretasi serta elaborasi hak-hak tersebut. Artikel ini menjelaskan hubungan antara konstitusi dan hak asasi manusia, yang mencakup persoalan isi dan pengertian hak asasi manusia, tempat hak asasi manusia dalam konstitusi, termasuk dalam UUD 1945, serta akibat pengaturan hak asasi manusia dalam konstitusi. Artikel ini menegaskan bahwa penempatan hak asasi manusia dalam konstitusi tidak semata-mata menjadikannya sebagai hak-hak fundamental yang bersifat mendasar, melainkan pula sebagai hak-hak konstitusional yang tertinggi.Constitution and Human RightsAbstractOne of the central points on constitutionalism is the idea of human rights. Constitution plays a major role by not only inserting human rights articles in aiming to secure and protect these rights, but also providing fundamental values that are used by Court in interpreting and elaborating such rights. This article discusses the relationship between a constitution and human rights, including issues of the meaning and content of human rights, position of human rights in a constitution (including the 1945 Amended Constitution), as well as consequences of inserting human rights norms into a constitution. It is argued that the entrenchment of human rights in a constitutional document does not only give them status as fundamental or basic rights, but it also provides stronger position as the supreme constitutional rights.DOI: https://doi.org/10.22304/pjih.v3.n3.a1

Abstract

Press is manifestation of public soverignty to the power. Press control function covers critic, analytic, and information to the public, so all the activities which are from branches of power based on the public wish and hope. Freedom of press is limited by the press law and code of conduct. The freedom of press can not be used for humaliation, harassment, or interference of judicature process.
