Abstract

AbstrakIndonesia merupakan negara maritime dengan garis panjang terpanjang di dunia dengan potensi air laut yang baik sebagai dasar pembuatan garam. Namun, ironisnya Indonesia belum mampu memenuhi kebutuhan garam nasionalnya. Ketidakmampuan memproduksi garam nasional untuk memenuhi kebutuhan garam dalam negeri mengakibatkan pemerintah mengeluarkan kebijakan impor garam. Tujuan dari penelitian ini ialah untuk meninjau dampak dari impor garam terutama di Kabupaten Jeneponto dan untuk meninjau efektivitas kebijakan pengendalian impor komuditas pergaraman terhadap kesejahteraan petambak garam di Kabupaten Jeneponto. Penelitian ini menggunakan metode kualitatif. Hasil penelitian menunjukkan bahwa dampak dari kegiatan impor garam sangat dirasakan bagi petambak garam di Jeneponto. Meningkatnya impor garam dari tahun ke tahun mengakibatkan harga garam nasional anjlok dan kurangnya permintaan pasar. Hal ini mengakibatkan menurunnya angka kesejahteraan masyarakat khususnya petambak garam. Pemerintah dalam hal ini telah mengeluarkan berbagai kebijakan untuk mengendalikan impor pergaraman. Namun, hingga saat ini kebijakan tersebut belum berdampak positif bagi kesejahteraan petambak garam, justru kebijakan tersebut menimbulkan kekacauan sector pergaraman.Kata Kunci: Efektivitas kebijakan; Pengendalian Impor Garam; Kesejahteraan Petambak Garam

Abstract

This study aims to determine the form of supervision carried out by the government on the fulfillment of the rights of laid-off workers and to analyze the effectiveness of the wage system policy and welfare of laid-off workers using empirical normative research methods that use research materials in the form of primary data obtained from field research and secondary data collected obtained from various laws and regulations, books, articles, and theoretical materials related to the object of research. The results show that the form of supervision carried out by labor inspectors tends to be non-judicial repressive in nature by waiting for complaints from workers/laborers and then making tripartite settlements through mediation. The fulfillment of the rights of laid-off workers/laborers through various government policies cannot run effectively which is influenced by three factors, namely, a) labor regulations that do not contain strict sanctions for violations of the fulfillment of workers' rights, b) law enforcers, namely labor inspectors and Civil servant investigators must have qualified legal knowledge related to employment and be active in conducting supervision, and c) Legal culture, especially workers and employers.

Abstract

Women migrant workers in the domestic sector are the most vulnerable group in the labor structure, mainly due to the lack of formal recognition in national law and weak protection of their basic rights. In Indonesia, despite their significant economic contribution, existing regulations are still partial and do not address the substance of gender-based justice. This article analyzes legal protection for women migrant workers through a feminist legal theory approach to uncover structural inequalities and patriarchal biases in the labor law system. The research employs a normative method with a conceptual and legislative approach, as well as a systematic analysis of primary and secondary data. The results of the study show that domestic workers are still not recognized as subjects of formal employment relationships, leaving them trapped in private workspaces with minimal state oversight. A feminist approach is used to evaluate this injustice and recommend transformative legal reforms, including the ratification of ILO Convention No. 189 and the harmonization of national regulations based on gender justice to provide substantial and inclusive justice for women migrant workers.
