Abstract

ABSTRACTRenewal of the criminal law puts a new conception of Judicial Pardon in the formulation of Article 56 paragraph (2) of the draft of the Criminal Code concept of 2016. The author is believed the existence of the concept in indigenous Indonesian society, so that it can find the best concept is characterized by Indonesia. The article is based on the results of normative legal research with the method of conceptual approach and statue Approach. The concept of Judicial Pardon has appeared in various forms of implementation within the Indonesian Community, including in Indigenous Batak Karo, Lampung Menggala, Minangkabau, Java and Aceh. The concept of forgiveness that exists within indigenous peoples requires the forgiveness of the victim, and does not necessarily eliminate the criminal. There are sanctions provided but the sanctions are not only for the interests of the victim and the perpetrator but also to restore the balance that has been damaged by the crime. The sanctions in the form of indemnification or other forms agreed by the parties including the public, through a peaceful resolution mechanism without involving the Court

Abstract

Judicial Pardon is a new concept formulated in the 2019 Draft of the Criminal Code. The concept refers to the judges’ new powers to forgive defendants who are convicted guilty. However, the formulation of the concept has not been adjusted to the formulation of decision types in the draft of the Criminal Law Procedure. There has to be a harmonization between the Draft of the Criminal Code and the Draft of the Criminal Law Procedure. This article is based on a legal study on the importance of regulating judicial pardon as a form of the court decision. It reveals that judicial pardon is in line with the insignificant principle that if an act already fulfills the elements of a criminal act but is not significant with the essential characteristics of the criminal act, it cannot be declared as a criminal act. However, it is not consistent with the essential nature of a criminal act. In addition, a judicial pardon is a form of shifting punishment towards a flexible balance model from the original one that is absolute. Therefore, it is important to amend the Draft of the Criminal Procedure Law on the types of judges’ decisions. The current judges’ decisions are not compliant with the concept of judicial pardon. The amendment can be processed by adding a decision of conviction without punishment as a type of judge’s decision. The article offers a concept related to legal remedies on judicial pardon as a final and binding decision. Therefore, legal remedies cannot target such decisions.Pengaturan Judicial Pardon Sebagai Bentuk Putusan Pengadilan dalam Pembaharuan Hukum Acara Pidana Indonesia                AbstrakJudicial Pardon merupakan konsep baru yang dirumuskan dalam Rancangan KUHP 2019. Konsep ini merujuk pada kewenangan baru yang diberikan kepada hakim dalam memberikan pemaafan kepada terdakwa yang terbukti bersalah melakukan tindak pidana. Akan tetapi, perumusan konsep tersebut tidak diimbangi dengan perumusan Judicial Pardon sebagai jenis putusan dalam RKUHAP. Dengan demikian, perlu ada harmonisasi antara RUU KUHP dan RKUHAP. Artikel ini ditulis berdasarkan hasil penelitian hukum terkait pentingnya pengaturan Judicial Pardon sebagai bentuk putusan pengadilan. Judicial Pardon sejalan dengan Insignificant Principle. Prinsip ini menyatakan bahwa tidak dapat dinyatakan sebagai suatu pidana terhadap suatu perbuatan yang memenuhi rumusan unsur tindak pidana, akan tetapi tidak sesuai dengan sifat hakiki dari suatu tindak pidana. Selain itu,  Putusan Judicial Pardon merupakan bentuk pergeseran pemidanaan ke arah model keseimbangan yang fleksibel, dari semula bersifat absolut. Sehingga perubahan RKUHAP terkait jenis putusan hakim sangat diperlukan. Jenis-jenis putusan hakim yang saat ini ada dalam KUHAP belum sesuai dengan konsep Judicial Pardon. Perubahan tersebut dapat dilakukan dengan menambahkan putusan salah tanpa pidana sebagai salah satu jenis putusan hakim. Artikel ini menawarkan konsep terkait dengan upaya hukum atas putusan Judicial Pardon dengan menerapkan Judicial Pardon sebagai putusan yang bersifat final and binding. Abstract

Judicial Pardon in Indonesia is the result of comparative studies with several countries including the Netherlands, Greece, Portugal and Uzbekistan. The author tries to discover what legal system underlies the concept of Judicial Pardon applied in some countries and how the concept of judicial pardon is most compatible with the Indonesian Law System. This paper is based on normative legal research with a Historical Approach, Comparative Approach, and conceptual approach. Currently the criminal law is also influenced by the Anglo saxon legal system. Responding to the second issue is more appropriate when incorporating the conception of Islam as well as the customary court in its formulation, where there should be a clear formulation of any crime that can be given by the judges, so that the legal certainty is guaranteed and formulated in the RKUHAP into one type of decision that can be given by the judge for the forgiveness of a judge that is a guilty verdict without punishment.

Abstract

Victims of criminal acts, as individuals who suffer harm, deserve comprehensive protection, particularly in the process of recovering their losses. The enactment of the National Criminal Code has recognised this need by including compensation as an additional form of punishment. However, the current framework has significant shortcomings. Since this additional punishment is not mandatory, victims are not guaranteed compensation, undermining the principle of justice. This study explores the need to reform the existing system to ensure fair and effective restitution for victims. Based on normative research utilising a statutory approach and interpretative analysis, the findings suggest that positioning criminal compensation as a primary form of punishment within the National Criminal Code would better serve justice. By elevating criminal compensation to a primary punishment, the system would provide victims with greater certainty in securing recovery from the perpetrator.

Abstract

This article was written based on the results of research aimed at finding the right choice in resolving cases of sexual violence against children in Aceh, namely between the Child Protection Law or the Qanun Jinayat. This research is empirical legal research with a case study approach. The data collection technique used were interviews with key informants and document studies, namely court decisions. This study found differences in the application of different laws to the same case. Even though children as victims of sexual violence not only have an impact on physical trauma, they also experience psychological trauma which can cause mental disorders. Data for the last 3 (three) years shows that until now law enforcers have not been consistent in applying the law to the settlement of these cases. Our finding is that there are differences of opinion between law enforcers because the two arrangements are specific criminal law in nature. Therefore, the principle of systematic lex specialist is very important as a basis for law enforcement in determining the right choice of law for the settlement of these cases.
