Abstract

Research data from the Center for Strategic Studies of Baznas on Zakat Mapping Potential Indicators (IPPZ), which analyzes the calculation of zakat potential based on sectoral and regional zakat objects, shows that Indonesia has the potential for zakat of IDR 233.8 trillion in 2019. However, only 3.5 percent of them can be managed. Therefore, Baznas has collaborated with fintech but it is not yet based on sharia. This study uses the Islamic Economic Research Method (Muamalah) with a descriptive normative approach. The results showed that the digitalization of ZISWAF through fintech was effective and the results exceeded the target. On the other hand, according to some scholars, several forms of fintech operations contain non-Islamic elements. Therefore, the Baznas agreement must explicitly state that fintech should separate ZISWAF funds from other fintech user funds so that they are not considered as float funds to be placed in BI; and do not utilize ZISWAF funds. Neither Baznas, muzakki, nor mustahik can benefit from depositing funds. Sharia fintech is a practical solution for UPZ Masjid to increase zakat inclusion. Unfortunately, Indonesia has no regulations related to sharia fintech.Fintech Syariah Sebagai Solusi Kepatuhan Syariah Dalam Pengoptimalan Pengelolaan Ziswaf Masjid Berbasis ElektronikAbstrakData penelitian Pusat Kajian Strategi Baznas tentang Indikator Potensi Pemetaan Zakat (IPPZ) yang menganalisis perhitungan potensi zakat berdasarkan objek zakat sektoral maupun regional menunjukan bahwa Indonesia memiliki potensi zakat mencapai nilai  Rp233.8 Triliun pada tahun 2019 namun hanya 3,5 persen yang dapat dikelola, oleh karenanya Baznas telah melakukan kerjasama dengan fintech namun belum berbasis syariah. Penelitian ini menggunakan Metode Penelitian Ekonomi Islam (Muamalah) dengan pendekatan deskriptif normatif. Hasil penelitian menunjukkan bahwa digitalisasi ZISWAF melalui fintech berjalan efektif dengan hasil penghimpunan melampaui target namun menurut sebagian ulama, beberapa bentuk operasional fintech mengandung unsur yang melanggar prinsip syariah, oleh karenanya, dalam perjanjian Baznas harus secara tegas menyebutkan agar fintech memisahkan dana ZISWAF dengan dana pengguna fintech lain sehingga tidak dipertimbangkan sebagai dana float yang akan ditempatkan pada BI, tidak mendayagunakan dana ZISWAF, serta baik Baznas, muzakki maupun mustahik tidak mengambil keuntungan dari pendepositan dana, Fintech Syariah merupakan solusi praktis bagi UPZ Masjid agar dapat meningkatkan inklusi zakat, namun di Indonesia belum ada regulasi terkait fintech syariah.Kata Kunci: baznas, fintech syariah, ziswaf masjid.DOI: https://doi.org/10.22304/pjih.v8n1.a3

Abstract

Students face the rapid development of information technology to have such a huge impact in the social aspect of society. In the midst of the covid pandemic, the use of social media is increasing so that the frequency of students exposed to hoax information and potentially become hoax spreaders is getting bigger. This research is normative research with socio-legal science approaches, By looking at how the law regulates phenomena or events that occur in society. The Ministry of Communication and Information of the Republic of Indonesia has established a method of tracking hoaxers and has arranged sanctions for perpetrators of hoaxes in the Information and Technology Law.

Abstract

This article examines the adoption of the principle of confidentiality in the protection of personal data of digital bank customers on positive law in Indonesia. This research is a prescriptive normative with statutory approach. The data used were primary data, secondary data, and tertiary data. Data collection techniques carried out by literature study or document study with deductive syllogism legal material analysis techniques. The results of the research and discussion show that the adoption of the principle of confidentiality in terms of the protection of personal data for digital bank customers can be found in several laws and regulations in Indonesia. Starting from the level of law, government regulation, ministerial regulation, financial services authority regulation, bank Indonesia regulation, and circular letter. The basic provisions of confidentiality stipulated in these regulations are still general in nature and only cover certain matters. Among them are the definition of bank secrets, bank confidential exceptions, the right of customers to get personal data protection, the obligation of digital banks to provide protection of personal data, and certain prohibitions that can harm customers.

Abstract

The civil servant receiving credit may use the Civil Service Appointment Decree (SK ASN) as collateral. However, SK ASN is not a type of security that can be used as collateral, such as fiduciary or pawn. Because it cannot be used as collateral, the practice of ensuring SK ASN does not give rise to property rights. If there is a default, it causes problems, particularly for kreditor. This is normative legal research with a conceptual approach that uses primary and secondary legal materials, as well as data collection techniques in the form of literature studies. The findings revealed that SK ASN is not a collateral object. When a debtor defaults, the characteristics of SK as a valuable letter differ from those of securities that can be liquidated or transferred as debt repayment. SK ASN is only a security guarantee for banks whose position is equivalent to promissory notes. In the event of a default, the consequences of creditors are not prioritized in the repayment of the loan. As a result, the creditors' position is that of a competing creditor, as specified in articles 1131 and 1132 of the civil code. However, civil servant SK has its own risk and profit as a guarantee that is taken into account by a bank when granting credit.

Abstract

  Along with the rapid development of trade between countries, Letter of Credit (L/C) is a form methods within overcoming the payment system carried out by the parties. This must also be accompanied by an anticipatory attitude, therefore there are also many irresponsible parties by utilizing the opportunity as a means to gain profits in an improper way that also harms many other parties. The bank as an important player in the implementation of the L/C must anticipate the banking risks that arise in order to run well.  Therefore, this article aims to analyze the review through the application of law in L/C services to banking risks. This type of research is normative research. The data sources used are primary data sources and secondary data sources and the delivery of data is written descriptively. If one party is dissatisfied because the other party fails to fulfill its obligations under the agreement, the dissatisfied party will receive legal protection as outlined in the regulations governing L/C in both international and national laws. Protection is derived from regulations that typically oversee L/C, such as the Uniform Customs and Practice for Documentary Credit (UCP), Bank Indonesia Regulations, and internal regulations. The primary focus is on recognizing L/C as banking risks designated by the central bank, along with risk management based on internal banking policies and in line with the international practices of UCP.
