Abstract

Tujuan: Artikel ini bertujuan untuk mengelaborasi nilai Pancasila secara substansial dalam wujud Perjanjian terapeutik dengan tujuan memberikan penghormatan tertinggi pada harkat dan martabat manusia yang bermuara pada keadilan dalam dunia kesehatan khususnya pelayanan medisMetodologi: Tulisan ini merupakan hasil penelitian hukum normatif dengan pendekatan undang-undang dan pendekatan konseptual. Pendekatan Undang-undang dilakukan terhadap Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, Peraturan Menteri Kesehatan Nomor 290 tahun 2008 tentang Persetujuan Tindakan Kedokteran. Pendekatan Konseptual dilakukan pada pengkajian nilai Pancasila sebagai dasar untuk  membangun model perjanjian terapetik dalam rangka pembaharuan hukum kesehatan.Temuan: Urgensi rekonstruksi yang memuat tentang prasyarat, bentuk formal versi digital, dan sanksi, yang keseluruhan disusun dan ditetapkan dalam bingkai nilai Pancasila, sebagai wujud pembaharuan hukum kesehatan di era digital.Kegunaan: Perjanjian terapeutik pada era Revolusi Industri 4.0 menggeser metode manual ke arah digital, sehingga perlu adanya pembaharuan hukum untuk meletakan nilai kemanusiaan, permufakatan, dan keadilan, melalui formulasi kontrak yang tepat dan dapat memberikan  perlindungan hukum bagi pelaku dan pengguna layanan kesehatanKebaruan/Orisinalitas: Keberadaan Tenaga Advokasi medis, merupakan novelty dari Perjanjian terapeutik yang kiranya dapat dikonstruksi sebagai hukum positif, dalam rangka pembaharuan hukum kesehatan.

Abstract

The rapid advances in economics apparently called for the establishment of a system and customs procedures more effective and efficient, and can improve the flow of goods and documents. Smuggling is an issue that is very deep and rooted in Indonesia, it means removing smuggling is a significant problem. Criminal liability against smuggling apply to the offender himself both individuals and legal entities.

Abstract

The rapid advancement of technology facilitates social interactions from the physical world to the digital realm, making it accessible to everyone, including criminal offenses like defamation on social media. The research questions are: 1) Do the elements of defamation against a prospective council member in Verdict No. 81/Pid.Sus/2021/PN Sgt comply with Article 45 in conjunction with Article 27 Paragraph 3 of the ITE Law and Article 315 of the Penal Code for minor offenses? 2) Is the two-month sentence imposed by the judge in line with the sentencing objectives under the Penal Code in Verdict No. 81/Pid.Sus/2021/PN Sgt? This research employs a normative method with secondary data, using descriptive-analytical techniques analyzed qualitatively with deductive reasoning. The findings indicate that the crime's elements do not align with the minor offense provisions of Article 315 of the Penal Code. The two-month probationary sentence does not meet the sentencing guidelines' objectives. The conclusion is that the verdict does not adequately apply Article 45 in conjunction with Article 27 Paragraph 3 of the ITE Law and Article 315 of the Penal Code, nor does it align with sentencing objectives. Judges should consider legal certainty, justice, utility, and societal values.

Abstract

The crime of sexual intercourse with a minor is a violation of human rights, especially children's rights. In decision Number 130/Pid.Sus/2021/PN.Kpg, the Defendant had sexual intercourse with the victim more than once. The formulation of the problem in this study is whether the actions committed by the Defendant fall within the qualifications of Article 81 paragraph (2) of the Child Protection Law and whether the characteristics of the actions committed by the Defendant meet the elements to be called continuing actions. This study uses a normative research method that is descriptive in nature and uses secondary data. The results of the study and its conclusions are that the actions committed by the Defendant in case Number 130/Pid.Sus/2021/PN.Kpg who had sexual intercourse with the victim by persuading the victim by expressing affection so that the victim would have sexual intercourse have met the qualifications of Article 81 paragraph (2) of the Child Protection Law and meet the characteristics of continuing actions where sexual intercourse is carried out again within a period of time that is not too far away so that the actions committed by the Defendant meet the elements of continuing actions.

Abstract

Komnas Perempuan reported an increase in domestic violence by almost 10 percent in 2024 compared to 2023. The most common form of violence is sexual violence. General data on the total number of cases of violence against women is 445,502 cases. The problems studied are: Is the decision of the Tanah Grogot District Court Number 54/Pid.B/2023/PN Tgt which found the defendant guilty of committing the crime of Article 44 paragraph (1) of Law No. 23 of 2004 concerning the Elimination of Domestic Violence (hereinafter abbreviated as UUPKDRT) appropriate? The research method used, namely normative juridical, especially research on legal principles, is descriptive, the data type uses secondary data, and the conclusion uses deductive logic. This research result and concludes that the court's decision in the case which applied Article 44 paragraph (1) of the Domestic Violence Law was inappropriate. However, the provisions of Article 44 paragraph (4) are more appropriate to be applied because they fulfill all the necessary elements. This is based on the fact that the act's impact on the victim did not interfere with the victim's daily activities.

Abstract

Punishment for criminal acts of sexual immorality that have a family relationship based on the principle of child protection is the act of the perpetrator, namely the victim's uncle, who committed obscene acts against the victim's child, namely his biological nephew. The formulation of the problem is, what are the principles of child protection in criminal acts of sexual abuse that have family relationships and how to punish perpetrators of criminal acts of sexual abuse against children in family relationships. This research uses a descriptive type of normative research, with secondary data obtained by literature study. The analysis used is qualitative by drawing deductive conclusions. The results of the research, discussion and conclusions in this research are the principles of protection as victims of crime including, without discrimination, the best interests of the child, survival and development and respect for the review of convicted children in case Number 533/Pid.sus/2021/PN.MGL It is not appropriate considering that there was an error in the application of the article by the Public Prosecutor, which was not proportional because it involved the weighting of Article 13 paragraphs 1 and 2 of Law Number 17 of 2016.

Abstract

This research discusses a case between Deni Saputra who was the perpetrator of a crime of domestic violence against his stepfather in decision no. 345/Pid.Sus/PN Bgl. There are two formulations of the problem raised, namely whether the perpetrator of the criminal act meets the elements of the offense of Article 44 paragraph (2) of the Domestic Violence Law and whether the punishment for the perpetrator who caused serious injury is appropriate or not, a prison sentence of 3 years and 6 months is imposed. The research method is descriptive analytical with secondary data analyzed qualitatively, type of research is normative juridical. The results of the research and discussion show that the actions of the perpetrator of the crime of physical violence against the stepfather were considered appropriate in accordance with Article 44 paragraph (2) of the Domestic Violence Law as the punishment was considered too light. The conclusion in this research is that the judge in deciding on a sentence of 3 years and 6 months was not in accordance with article 44 paragraph (2) of the Domestic Violence Law, namely 10 years in prison for the purpose of criminalizing the perpetrator in order to provide a deterrent effect for his actions.

Abstract

Attempt or Evil Conspiracy in the Crime of Class I Narcotics refers to actions where individual attempts or conspires to possess, store, or receive Class I narcotic substances. The key issue examined is whether these actions constitute the criminal offense of Attempt or Conspiracy in the Crime of Class I Narcotics, specifically in the context of Decision Number 282/Pid.Sus/2022/PN.Jkt.Pst. Additionally, the study investigates the types of attempts made by the perpetrator and evaluates whether the verdict aligns with the objectives of punishment. The research utilizes a descriptive normative legal approach, analyzing secondary materials qualitatively with deductive inference. The findings indicate that the acquittal of the perpetrator for attempted conspiracy in the Class I Narcotics Crime, as per Decision Number 282/Pid.Sus/2022/PN.Jkt.Pst, is inappropriate. The perpetrator's actions constitute a form of halted or obstructed attempt, which should be recognized as an offense. The conclusion drawn is that the perpetrator indeed committed an attempt to engage in a narcotics crime, and the verdict fails to meet the objectives of punishment. This highlights the need for a thorough reassessment of the legal interpretation of attempts and conspiracies within narcotics crimes to ensure that judicial decisions effectively serve their intended purpose of deterrence and justice

Abstract

Children as drug abusers must undergo a criminal justice process, children who should not receive criminal justice should receive protection. The existence of a child protection law should be used as a reason to protect all deviant behavior carried out by children. The formulation of the problem in this research is about how the judge considers when imposing a prison sentence on a child who abuses narcotics and what the legal consequences are if the judge does not consider the child's social justice litmas in Decision No. 4/PIDSUS-Anak/2021/PN SRG. This research method uses a normative method, where secondary data is processed qualitatively and conclusions are drawn deductively. The results of the research and discussion illustrate that the judge's consideration of deciding whether a minor should be sentenced to imprisonment violates Law number 35 of 2014 concerning child protection in article 67, article 103 (1). The conclusion is that the legal consequences of the judge not considering the Child Child Protection Research Unit in the decision that there was a discrepancy resulted in the decision being null and void because it violated Law number 11 of 2012 in article 60 paragraph (4)

Abstract

The law enforcement process for corruption cases is not simple because there are still often differences in the sentencing of crimes. The identification problem in writing this journal is what is the basis for the judge's consideration in imposing sanctions on Decision Number 34 / Pid. Sus – TPK / 2021 / PN JKT . PST is in line with Article 197 paragraph (1) letter f of the Criminal Code and how the legal consequences for the judge are not covered as required by Article 197 paragraph (1) letter f of the Criminal Procedure Code which when adjusted to the indictment is used as the basis for the judge's consideration and is also associated with Article 2 paragraph (1) of the Corruption Crime Law. The type of research used is normative, the nature of the study is descriptive, the data used is secondary data. Qualitative is the analysis of the data used and the method of drawing deductive conclusions. In conclusion, the Judge in deciding this case with a criminal offense that is not by the relevant laws in force even under the special minimum provisions that have been determined in the relevant article listed in the public prosecutor's indictment and is the basis for the judge's consideration.
