Abstract

Surrogation arises as a result of the development of reproductive technology science with techniques embryo transfer and in vitro fertilization (IVF) techniques. The existence of a surrogate mother both for altruistic and transactional motives have implications for the problem law. Some countries provide different regulations on surrogation. This writing is the Reform-oriented research, which confirms that surrogation does not meet the rules humanitarian values, so the need for reconstruction of health laws against the rules concerning the institutionalization of human organs, reproduction outside of natural pregnancy, the provision of sufficient spare embryos and criminalization policies against advocates, perpetrators and surrogate mother in order to achieve justice and legal certainty. Keywords: surrogation, medicolegal, humanitarian paradigmatic law.

Abstract

Healthy human resources will make it easier for the country to achieve development goals in the field of health The development of health sector in Indonesia currently has double burden, namely the burden of infectious diseases and degenerative diseases. For the prevention of infectious diseases, an immunization program is held in Hospitals, clinics, and physician practices. Programs that are good enough to improve public health status are tainted with the circulation of fake vaccines that are not only a medical problem, but also bring implications to the social and legal fields. The existing regulation has not explicitly set forth the forgery of the vaccine, so in law enforcement it is still based on the interpretation of law enforcers both in determining the material law and the formal law of this medicolegal case. It is worth reviewing the role of the law as a means of social control and social engineering. Through a conceptual approach, legislation and hermeneutics, and based on the humanitarian paradigm, this paper seeks to explore the medicolegal aspect of a fake vaccine holistically, so that law as a public guide in health can provide protection for all stakeholders involved mainly in the production, distribution and Use of the vaccine in medical care. Case studies of fake medicolegal vaccine found that during this time, the handling of fake vaccines has not been specifically regulated and still equated with counterfeit medicines, whereas in terms of substance, the vaccine is different from the drugs. Expectations for the creation of responsive legal protection in the field of medical services in the future, strived by reconstruction of the Health Act, a one-door management system, effectiveness and efficiency of government performance, revitalization of professional association functions and law in terms of socialization, health promotion, education, and advocacy.

Abstract

Tujuan: Artikel ini bertujuan untuk mengelaborasi nilai Pancasila secara substansial dalam wujud Perjanjian terapeutik dengan tujuan memberikan penghormatan tertinggi pada harkat dan martabat manusia yang bermuara pada keadilan dalam dunia kesehatan khususnya pelayanan medisMetodologi: Tulisan ini merupakan hasil penelitian hukum normatif dengan pendekatan undang-undang dan pendekatan konseptual. Pendekatan Undang-undang dilakukan terhadap Undang-Undang Nomor 29 Tahun 2004 tentang Praktik Kedokteran, Peraturan Menteri Kesehatan Nomor 290 tahun 2008 tentang Persetujuan Tindakan Kedokteran. Pendekatan Konseptual dilakukan pada pengkajian nilai Pancasila sebagai dasar untuk  membangun model perjanjian terapetik dalam rangka pembaharuan hukum kesehatan.Temuan: Urgensi rekonstruksi yang memuat tentang prasyarat, bentuk formal versi digital, dan sanksi, yang keseluruhan disusun dan ditetapkan dalam bingkai nilai Pancasila, sebagai wujud pembaharuan hukum kesehatan di era digital.Kegunaan: Perjanjian terapeutik pada era Revolusi Industri 4.0 menggeser metode manual ke arah digital, sehingga perlu adanya pembaharuan hukum untuk meletakan nilai kemanusiaan, permufakatan, dan keadilan, melalui formulasi kontrak yang tepat dan dapat memberikan  perlindungan hukum bagi pelaku dan pengguna layanan kesehatanKebaruan/Orisinalitas: Keberadaan Tenaga Advokasi medis, merupakan novelty dari Perjanjian terapeutik yang kiranya dapat dikonstruksi sebagai hukum positif, dalam rangka pembaharuan hukum kesehatan.

Abstract

Morality is a principle of life based on the values of divinity, humanity and justice, as essential values in human life. This behavior can occur by anyone and anywhere, including among students. In Indonesia's positive law, immoral acts are implicitly regulated in the Criminal Code, the Pornography Law. However, because in the aspect of decency concerning ethical rules, placing criminal law as the ultimum remedium is more appropriate, because if it can still be carried out with social sanctions, then restorative justice will be achieved, in addition to placing criminal law as primum remedium. . Efforts to resolve student immoral cases would be better done with the concept of a minitrial or mini trial, involving the University Ethics and Law Committee (KEHU), students of perpetrators, students of victims, parents/guardians, and witnesses. KEHU acts as a mediator for the parties involved. The completion of the case is when the agreement is signed, and for students, coaching is carried out. The case with the minitrial is as in the Student Code of Ethics. If there is a case related to a criminal act, the minitrial decision can be taken into consideration by the competent authorities.

Abstract

Corruption in Indonesia's construction sector results in material losses and damaged public trust, and slows economic growth. To address this problem, systemic reforms focusing on tender transparency, strict law enforcement, and strengthening oversight institutions are needed. Law No. 2/2017 on Construction Services provides a comprehensive legal framework, but its implementation is often hampered by a lack of inter-agency coordination and weaknesses in supervision and enforcement. This research uses a normative method to analyze regulations related to construction supervision and design a conceptual framework and policy recommendations to improve the effectiveness of supervision. The results show that legal certainty and transparency are key to building public trust and ensuring accountability. The implementation of regulations such as Government Regulation No. 22/2020 and Minister of Public Works and Housing Regulation No. 7/PRT/M/2019, accompanied by consistent sanctions, strengthens trust in the legal and supervisory systems. Systematic supervision and transparent reporting are essential elements to maintain the integrity and effectiveness of construction projects.

Abstract

Law Number 17 of 2023 on Health explicitly prohibits all forms of organ trade and commercialization, regardless of the reason. This provision is intended to prevent organ trafficking practices that violate human dignity and ethical principles in healthcare. However, the law does not clearly define the scope or meaning of “organ trade” and “commercialization,” which creates challenges in terms of legal certainty. A particular dilemma arises when a recipient voluntarily gives money to a donor as a token of gratitude, without any prior agreement or transactional intent. This study adopts a normative legal method by analyzing Law Number 17 of 2023 and related regulations. The findings show that current legal provisions do not offer detailed parameters to distinguish between illegal organ trade and voluntary, humanitarian-based expressions of appreciation. As a result, there is an urgent need for supplementary regulations or more detailed implementing provisions to ensure legal clarity, prevent the criminalization of good-faith donors, and provide adequate legal protection for all parties involved in voluntary, non-commercial organ donation.

Abstract

This research analyzed the way in which Indonesia’s anti corruption court combines judicial formalism with scientific proof requirements. Employing a normative and comparative research design, we utilized a doctrinal analysis of Criminal Procedure Code and Anti Corruption Law, micro comparisons to the United States, UK, Singapore, and Indonesia including reliability tests; gatekeeping authority; chain of custody; expert independence. It found systemic epistemic deficits: the lack of an autonomous category for scientific evidence, weak to non existent reliability tests, fragmented chain of custody trade practices, judicial aversion to method and error rate scrutiny and an epistemic imbalance privileging prosecution access to experts and raw materials. Comparative mapping produced a hybrid gatekeeping model which integrates ex ante admission screening and ex post weight attribution, firmly based on validity of method, known error rates, transparent methodology, expert accreditation by the courts, court designated expertise appointment and data disclosure sanctions. We can only trust that rule making of the reliability standard, judicial gatekeeping and ensuring defendants’ rights are necessary in order to ensure due process and legal certainty. These structural changes bring evidentiary practice into closer conformity with scientific rationality, thereby mitigating the risks posed by wrongful convictions and enhancing public confidence in corruption adjudication

Abstract

This study provides a conceptual innovation in policies addressing surrogacy practices in Indonesia from the perspective of the right to reproductive health care. This study applies a normative method using both a statutory and conceptual approach. Referring to Health Law 17/2023, Government Regulation 28/2024, and Ministerial Regulation 2/2025, this study finds that the national legal system has prohibited aspects of surrogacy practices to prevent harm to its values. Instead, the law states that a household is a reciprocal legal obligation, the equivalence and wisdom of which are inherent in their duties as husband and wife and cannot be disturbed by any third party. Therefore, the law prohibits and criminalizes any form of cooperation that would damage the image, meaning, and purpose of married life between the parties concerned. Conversely, the law protects women from bodily exploitation and the commodification of the womb, and ensures that the development of medical technology remains within the law and human values. The study concludes that the prohibition of surrogacy is not a medical obstacle, but rather an active right of the state to judges to ensure that health law serves as a basis for justice.

Abstract

The lack of legal understanding by the parties concerned and the lack of legal protection for both patients and health workers. So the results of the nurses' hard work in providing health services if they are not successful will be faced with the law and even categorized as malpractice with criminal sanctions. Focus problems, namely: Doctors' legal protection of midwives and nurses professionals in medical actions in hospitals.The method used in this study is normative juridical research, which is a study using legislation that includes three layers of legal science consisting of the study of legal science, legal theory and legal philosophy. The results of the discussion found that the delegation of Doctor's authority to the nurse profession in medical action from a legal perspective. Nurses are someone who plays a role in caring for and helping someone by protecting them from pain, injury and the process of aging. It is not in accordance with the regulations of Law No. 38 of 2014 concerning Nursing Article 32 Paragraph (1) and Minister of Health Regulation No. 2052 of 2011 Article 23 Paragraph (1). The nature of the act of giving a medical diagnosis and the determination of medical therapy should not be delegated to nurses of Law No. 17 of 2023. The authority of nurses is as follows: Article 30 paragraph 1 and 2. The two legal umbrellas can certainly make nurses' understanding and protection in carrying out medical duties.

Abstract

Land-related problems are found widely in Indonesia today, particularly related to the National Land Affairs Agency’s data of land unregistered and with no deed or double deed. Thus, government should solve them first to obtain the number of land because the data is different from the actual fact. It is related to the certificate inconsistent with dimension or the object of dispute in the Court. It means that the land deed or certificate no longer guarantees law certainty to the people. Minister of Agrarian Affairs and Spatial Planning/Chairperson of Land Affairs Agency’s Regulation Number 1 of 2021 concerns Electronic Certificate. The result of discussion shows that the electronic system-based land registration will yield electronic document as the output, i.e. electronic certificate that will benefit the people through providing easy access to digital data, evidence of land ownership, and foundation of law certainty guaranty over land ownership right, and freedom from land certificate falsification, legitimate legal evidence, and the expansion of legitimate evidence corresponding to procedural law enacted in Indonesia, constituting the foundation of justice, law certainty, and benefit guaranty to Indonesians.
