Abstract

This research aims to review the dynamics of the teleconference marriage contract law in Indonesia and to analyze the legal provisions from three perspectives: juridical, philosophical, and sociological. This research is library research with a descriptive-analytical method. The primary legal data is in the form of several fiqh opinions and fatwas of the ulama regarding the legal provisions of the marriage contract via teleconference. The results of this study indicate that there are differences of opinion among scholars based on different methods of understanding the al-Quran and hadith texts about marriage and the development of science and technology. In Indonesia, when examined from a juridical-philosophical aspect, the practice of the marriage contract via teleconference can be carried out because the facilities are complete and the requirements can be fulfilled. However, when examined from a sociological aspect, the paradigm of the majority of Muslim communities regarding the sacredness of marriage is still strong so that the permissibility of the practice of the marriage contract is still difficult to accept and apply among them.

Abstract

Law no. 38/1999 on zakat administration was able to be successfully enacted not solely because the roots of democracy had began to grow in the country; but also because this law is based on the rationale purpose of zakat, that is, to help the poor. In this article, furthermore, the state is responsible to protect and provide necessary support for the poor and needy citizens, even though in fact, the state fails to do so, This is of course of great relevance considering the main aim of zakat is to improve the social and economic position of the poor.DOI: 10.15408/sdi.v13i3.556

Abstract

The general aim of this FGD is to analyze the roles of MBOs in Indonesia and the participation of MBOs in the socio-political development of the society. To obtain in-depth qualitative data, the FGD is focused on the two largest MBOs in Indonesia: NU and Muhammadiyah. This is because to the present, the two MBOs represent two mainstreams of Indonesian Islam: modernist and tradisionalist. The FGD also looked at other MBOs which develop in certain cities, such as Perti in Padang and NW in Mataram. These two MBOs are, in fact, traditionally close to NU.DOI: 10.15408/sdi.v17i3.459

Abstract

Tulisan ini membahas tentang reformulasi zakat profesi dalam kerangka kaidah hukum Islam. Sementara ahli, menempatkan zakat profesi dalam logika perdagangan namun sebagian lain menempatkannya dalam konteks pertanian. Perbedaan dua perspektif ini berakibat pada jumlah atau prosentase dan waktu pembayaran zakat profesi. Tulisan ini hendak merumuskan bagaimana zakat profesi dalam teori hukum Islam. Analisis penulis dalam menjelaskan zakat profesi dalam perdebatan hukum ini menggunakan pendekatan al-Qawaid al-Ushuliyyah dan al-Qawaid alFiqhiyyah. Dengan menganalisis data-data kitab fiqh klasik dan kontemporer, tulisan ini menyimpulkan bahwa zakat profesi perlu diletakkan dalam pendekatan filosofi hukum yaitu maqãshid al-syariah dan mas}lahah sehingga ketentuan hukum zakatnya tidak secara kaku mengadopsi rumusan fiqh klasik semata.

Abstract

This study attempts to investigate the innovation model of cash waqf investment at business sectors. Various Investment has been conducting by the waqf board such as: Dompet Dhuafa through its subsidiary Tabung Wakaf Indonesia and Al-Azhar Peduli Umat. By conducting interview to many parties and documentation study this study finds that cash waqf contributes to improvement many sectors related to the poor such as: building health facilities, educational program, and economic program development for the needy.

Abstract

In Indonesia, conflicts of interest regarding matters of religious education in Indonesia were not unique because the state and community interest groups tend to participate with each other in matters of education. The nation's ideological values and religious principles were interrelated, even experiencing interconnectivity. This conflict only occured in certain sub-sub-communities which had not yet fully reached state policy regarding religious education, where this encourages the politicization of education created by sub-dominant powers if an educational policy was not in accordance with the wishes and interests of the sub-dominant powers. This research aimed to identify and analyze the dynamics of negotiation and accommodation of civil society on Pesantren education policy. This research used a qualitative research approach with a case study method. The results of this research concluded that the involvement of Pesantren Kyai played a role in political interests in history before playing a role in legislative politics as happened in the Pesantren policy. The background to the involvement of Kyai in the Pesantren policy was born from the phenomenon that Kyai enjoyed a high social position since Islam entered Java in carrying out negotiation and accommodation efforts. There were two roles played by Kyai in the legal political constellation of the Pesantren policy. First, the formal role, where in this case the Kyai was a politician who has entered the political system. In this way, Kyai in this case also participates in carrying out party plans and activities, for example serving in the people's representative council, campaigns, work meetings and the like. Second, non-formal roles, in this case the Kyai had more status but then they also tried to approach politics itself. Kyai of this kind, structurally could not be said to be politicians, but socially they had a role in developing political circles.

Abstract

This article examines the fatwa of Majma 'al-Buḥuṭ al-Islāmiyyah bi al-Azhar regarding the prohibition of conjoined twin marriages. In the Fatwa, stated that conjoined twin marriages are invalid because it is similar to gathering two sisters in one covenant and giving rise to mafsadah in the form of negative things that arise in marriage. The main data in this study are fatwa al-Azhar on the prohibition of conjoined twin marriage and several documents and literature on conjoined twins. Secondary data in the form of some literature that supports the research theme. The analytical method used is a descriptive-analytical method using the theory of fath al-dharī'ah as a knife of analysis. Based on research results, not all conjoined twins are prevented from getting married. As in the case of craniopagus type conjoined twins. Some negative things as expected by the al-Azhar fatwa can be overcome by this type of conjoined twins. Based on the theory of fath al-dharī'ah, if the greater benefit can be realized, then the prohibition provisions can be allowed. Artikel ini mengkaji fatwa Majma’ al- Buḥuṭ al- Islāmiyyah bi al- Azhar tentang larangan perkawinan kembar siam. Dalam Fatwa tersebut dinyatakan bahwa perkawinan kembar siam secara mutlak tidak sah karena sama halnya dengan mengumpulkan dua saudara dalam satu akad serta menimbulkan mafsadah berupa hal-hal negatif yang timbul dalam perkawinan. Data utama dalam penelitian ini berupa fatwa al- Azhar tentang larangan perkawinan kembar siam dan beberapa dokumen serta literatur tentang kembar siam. Data sekunder berupa beberapa literatur yang menunjang tema penelitian. Metode analisis yang dipakai berupa metode deskripstif-analitis dengan menggunakan teori fath al- dharī’ah sebagai pisau analisis. Berdasarkan hasil penelitian, tidak semua kembar siam terhalang untuk menikah. Seperti dalam kasus kembar siam tipe craniopagus. Beberapa hal-hal negatif sebagaimana yang diduga oleh lembaga fatwa al- Azhar dapat diatasi oleh kembar siam tipe ini. Berdasarkan teori fath al- dharī’ah, apabila kemaslahatan yang lebih besar dapat terealisasi, maka ketentuan yang semula dilarang menjadi diperbolehkan.
