Abstract

This research aims to analyze the accountability of village fund management as a prevention of corruption in the accountability of village fund management. and analyze the form of supervision in accountability of village fund management as a prevention of corruption crimes. This type of research is a normative method, using a case approach. The results of the study show that: Accountability of village fund management in preventing corruption can be seen from performance measurement, performance management, and performance budgeting. In the management of village funds, there are still frequent misuse of village funds for the personal interests of village government elements. The form of supervision in the accountability of village fund management in preventing corruption through preventive supervision and repressive supervision. In reality, the rules related to the form of supervision have been regulated by involving various parties. However, in practice there are still many village government elements who easily misuse village funds.

Abstract

Local government is authorised to fulfil the right to legal aid to disadvantaged and vulnerable groups. Such authority is referred to as attributive authority. The regional government's implementation of legal aid is critical because the central government's budget allocation for such aid remains constrained. This is evident from the unequal distribution of funds for legal aid as well as the disparity between the number of legal aid organisations and the number of people in need. In addition to being constrained by the budget, the provision of legal aid under Law No. 16 of 2011 concerning Legal Aid is currently confined to the poor, despite the fact that various laws mandate the provision of legal aid to certain groups.

Abstract

Undang-Undang Cipta Kerja membawa perubahan terhadap pelaksanaan administrasi pemerintahan di Indonesia. Undang-Undang Cipta Kerja secara tidak langsung mengubah hukum acara dan kompetensi absolut Peradilan TUN karena dalam pasal 175 ayat (6) Undang-Undang Cipta Kerja menghapus frasa pengadilan sehingga PTUN(PTUN) tidak berwenang lagi untuk mengadili permohonan fiktif positif. Penelitian ini bertujuan untuk menganalisis kewenangan PTUN dalam menguji sikap diam pejabat pemerintahan pasca berlakunya Undang-Undang Cipta Kerja dan menganalisis pertimbangan hakim dalam memutus perkara sikap diam pejabat pemerintahan. Penelitian dengan metode penelitian normatif ini, menghasilkan penelitian bahwa meskipun permohonan fiktif positif dihapus oleh Undang-Undang Cipta Kerja, masyarakat dapat mengajukan gugatan onrechtmatige overheidsdaad terkait sikap diam pejabat pemerintah yang merugikan masyarakat dan Majelis Hakim mempertimbangkan bahwa penanganan sengketa sikap diam pejabat pemerintah dapat diajukan di PTUN namun penanganannya tidak dapat menggunakan acara persidangan Permohonan Fiktif Positif melainkan acara gugatan tindakan faktual.
